AFFIDAVIT

I, APPLE JADE LICUANAN, of legal age, Filipino, and residing

at No. 2345 Barangay 245, Pasay City, Philippines, after having been
sworn in accordance with law, do hereby depose and state that:

1. I am the wife of Miguel E. Fontanilla (“Miguel”) , 39 years old

and married;

2. On November 29, 2019, Miguel, told me that our neighbor and

also his best friend, Samuel Pascual (“Samuel”) asked him if
he could work in their construction site as a replacement of their
plumber , to which I agreed. My husband also told me that the
location of the construction site is at Brgy. 169 Caloocan City;

3. On December 2, 2019, at around 4:45 in the morning, While we

were having breakfast, Samuel arrived. He said that he will
accompany Miguel to the construction site. My Husband and
Samuel left at exactly 5 o’clock in the morning;

4. At around 5:10, My husband “video called” me and I saw that

that he was riding a jeepney. He told me that they were on their
way to Monumento;

5. I received a text from Miguel at around 7:03 later that morning,

telling me that they arrived safely at the construction site;
 6. At around 6 o’clock in the evening while I was doing house
chores, Miguel together with Samuel arrived;

7. On the same day, while having dinner, At around 6:30 in the

evening, we were surprised when police officers knocked on our
door and invited my husband for some clarificatory questions
for allegedly Raping NICA JENINE NACILLA (“Nica”). My
husband can never do that, he is always been a good husband
and father to our child; and

8. I am executing this Affidavit to attest to the truth of the foregoing

facts and that the highest interest of justice will be served.

IN WITNESS WHEREFORE, I have hereunto set my hand and this 3rd

day of December 2019, at Pasay City, Philippines.
