26 .

Finding regarding whether each planned use complies with the State Lands
Management Plan, particularly whether such uses represent "balanced public
utilization", specific agency statutory author ity, and other legislative or executive
constraints:

a. The use of the subject property as a public beach area with multiple
recreational uses, including traditional saltwater beach recreational activities ,
bicycle & pedestrian trail facilities, beach concessions , water sports , musical
concerts and other special events meets all the requirements set forth in the
State Land Management Plan.

27. Assessment as to whether the Property , or any portion thereof, should be declared
surplus:

a. None of the subject property should be declared surplus.

28. Identification of other parce ls of land within or immediately adjacent to, the Property
that should be purchased because they are essential to management of the Property:

a. There are no other parcels of land within or immediately adjacent to the


property that should be purchased because they are essential to management
of the property.

29 . Description of management responsibilities of each agency, how such responsibilities


will be coordinated, including a provision that requires that the managing agency
consult with the Division of Historical Resources before taking actions that may
adversely affect archaeological or historic resources :

a. The subject property will be managed by the City of Miam i Beach as a public
beach area with multiple recreational uses, including traditional saltwater beach
recreational activities , bicycle & pedestrian trail facilities , beach concessions,
water sports, musical concerts and other special events .

b. All temporary and permanent construction will be permitted by the Department


of Environmental Protection Division of Beaches and Coastal Systems ,
pursuant to Rule 16B-33 of the Florida Administrative Code.

c. Beach concess ion operations will be conducted in accordance with the City's
Rules and Regulations for Beachfront Concess ion Operations, as approved by
the Department of Environmental Protection Division of Beaches and Coastal
Systems.

d. Musical Concerts and other special events will be conducted in accordance with
the specific requirements set forth by the Department of Environmental
Protection Division of Beaches and Coastal Systems .

e. The subject property consists entirely of artificially created or renourished


beaches and a storm protection berm . No archaeological or historic sites or
