MOTION FOR PROVISIONAL DISMISSAL


(WITH AFFIDAVIT OF CONSENT)

COMES NOW, the Accused, XXXXXXXXXXXXX assisted by


the Public Attorney’s Office, through the undersigned counsel, unto
this Honorable Court, most respectfully avers that:

1. The Accused, XXXXXXXXXXXXXXXXXXXXXXXXXXX,


were charged with the crime of Less Serious Physical Injuries based
on an Amended Information dated XXXXXXXXXXXX filed by Office of
the Provincial Prosecutor. The private complainant in this case is one
XXXXXXXXXXXXXX, Filipino, of legal age and resident of
XXXXXXXXXXXXXXXX, Quezon.

2. On XXXXXXXXXXX, both the Accused were arraigned and


pleaded NOT GUILTY to the crime charged.

3. On XXXXXXXXXXX, the undersigned counsel moved for the


provisional dismissal of the case on the ground that the private
complainant is no longer interested to pursue the case. However,
only accusedXXXXXXXXXXXXXXX appeared and accused
YYYYYYYYYYYYYYY failed to appear on the said date of hearing.
With the conformity of the Office of the Public Prosecutor and the
accused XXXXXXXXXXXXXXX, the Honorable Court provisionally

dismissed the case with respect to the accused
YYYYYYYYYYYYYYYY

4. Despite several re-settings of the case, accused


XXXXXXXXXXXXXXXXXX failed to appear on the scheduled dates
of hearing due to a complicated pregnancy. The private complainant
also failed to appear on the said dates.

5. Under Rule 117 of the Revised Rules on Criminal


Procedure:

“Section 8. Provisional dismissal. — A case shall not be


provisionally dismissed except with the express consent
of the accused and with notice to the offended party.

The provisional dismissal of offenses punishable by


imprisonment not exceeding six (6) years or a fine of any
amount, or both, shall become permanent one (1) year
after issuance of the order without the case having been
revived. With respect to offenses punishable by
imprisonment of more than six (6) years, their provisional
dismissal shall become permanent two (2) years after
issuance of the order without the case having been
revived. (n)”

The Supreme Court has held that a case is provisionally


dismissed if the following requirements concur:

1) the prosecution with the express conformity of the


accused, or the accused, moves for a provisional
dismissal (sin perjuicio) of his case; or both the
prosecution and the accused move for its provisional
dismissal; (emphasis supplied)

2) the offended party is notified of the motion for a


provisional dismissal of the case;

3) the court issues an order granting the motion and


dismissing the case provisionally;

4) the public prosecutor is served with a copy of the order


of provisional dismissal of the case.1

6. A provisional dismissal may be grounded on reasons other than


defects found in the information.2 There may be a provisional

dismissal of the case even when the trial proper of the case is already
underway provided that the required consents are present.3 In the
case at bar, the Accused XXXXXXXXXXXXXXXXXXXX, is
respectfully moving for a provisional dismissal (sin perjuicio) of her
case on the ground of the lack of interest of the private complainant
to pursue the case further.

WHEREFORE, it is respectfully prayed that the case against


the accused XXXXXXXXXXXXXXXXXXX be provisionally dismissed
pursuant to Rule 117, Section 8 of the Revised Rules on Criminal
Procedure.

Other reliefs just and equitable under the circumstances are


likewise prayed for.
