COMPLAINT-AFFIDAVIT

I, Roger Dimaampao, of legal age, Guardian of the herein 15 year

old victim Areola Marrie L. Malibugan and a resident of P-6 Brgy. San Juan,
Surigao City to represent my said victim after being sworn in accordance with
law depose and say that:

1. That the respondent Jose A. Gonzales is a Public Officer;

2. That the victim knew of the respondent because they had a past
sexual relationship;
3. That the respondent knew that the victim was a minor, but despite
such knowledge, continued to have a sexual relationship with the
victim.
4. That the victim and the respondent had been in a relationship for
almost 2 years from 2016 to 2018.
5. That during 2016 to 2018 three (3) sexual encounters have occurred
between Jose A. Gonzales and the victim.

I executed the foregoing Complaint-Affidavit to represent my

daughter in this case, attest to the truth of the facts stated and for the purpose
of charging respondent with the crime of rape.

INFORMATION

The undersigned, City Prosecutor, upon a sworn complaint originally filed

by the Guardian of the victim, ROGER DIMAAMPAO, accuses JOSE A.
GONZALES of the crime of RAPE, committed as follows:

That on several occasions from 2016 - 2018, in Surigao City, Philippines,

and within the jurisdiction of this court, the above-named accused, JOSE A.
GONZALES, did then and there wilfully, unlawfully, and feloniously raped a 12
year old child named AREOLA MARRIE L. MALIBUGAN.
