JUDICIAL AFFIDAVIT OF PROSECUTION WITNESS GARY MIRANDA

This Judicial Affidavit of Gary Miranda is executed to serve as his direct testimony of the
instant case

PURPOSE

This judicial affidavit of the prosecution witness GARY MIRANDA is being offered to
prove that the defendant committed the crime of Qualified theft.

PRELIMINARY STATEMENT

The person examining me is Atty. Juan Dela Cruz with address at 98 Valero Street,
Makati City. The examination is being held at the same stated address. The questions are
asked in the English language but are translated in Tagalog, which I speak and fully
understand. I hereby give my answers in full consciousness that I do so under oath and I am
aware that I may face criminal liability for false testimony or perjury for false statements made
or given by me.

OFFER OF TESTIMONY

The testimony of the witness Gary Miranda is being offered to prove that he is an
eyewitness to the crime of Qualified Theft. He will testify what he has seen on the day of the
commission of the crime and what transpired on the day of 7th day of January 2020.

The witness will identify the accused in open court as the person who committed the crime.

1. Q: Mr. Witness, will you please tell the Honorable Court your name, age and other personal
circumstances?

A: My name is Gary Miranda, 40yrs old, I live in #01 Dian Street, Makati city, and I am
currently employed as a security guard of Perillo Supermarket in Filmore street,
Makati city

2. Q: Do you personally know the defendant in this case, and if so, will you please point to him
before this honorable court?

A: Yes, (Witness points at the defendant)

3. Q: On the day of the commission of the crime, or on January 7, 2020, were you on duty,
meaning were you physically present at Perillo Supermarket?

A: Yes, sir

4. Q: Why was the defendant put on surveillance on that day?

A: Because the manager was informed by the store merchandiser Jona Mendes of the
defendant’s unusual request

5. Q: And what is this unusual request made by the defendant?

A: The defendant asked Mendes not to put price tags on the five (5) boxes of canned goods
he requested allegedly ordered by a customer

6. Q: Will you please tell the honorable court what transpired during the surveillance?

A: We saw the defendant place the five boxes of canned goods in his garbage bin which he
covered with trash

7. Q: Did you see where the defendant placed these stolen items afterwards?

A: Yes, we found it the following day placed near the entrance where the garbage are being
collected.

8. Q: In connection to this case, do you remember having executed a judicial affidavit?

A: Yes, Atty.

9. Q: Is this the judicial affidavit?

A: Yes, sir

10. Q: Is this your signature that appears on the affidavit?

A: Yes, Atty.
