EXTRAJUDICIAL SETTLEMENT OF ESTATE

KNOW ALL MEN BY THESE PRESENTS:

This Extrajudicial Settlement made and entered into by and among :

, a Filipino, of legal age, widow and a resident of;

, a Filipino, of legal age, single and a resident of;

, also a Filipino, of legal age, married and;

WITNESSETH:
The above-named parties, all of legal age, are the surviving legitimate heirs of the late, who
died intestate on______.(a copy of his Death Certificate are hereto attached as Annex A)

That to the best knowledge and information of the parties hereto, said deceased is without any
outstanding debts in favor of any person or entity;

That said deceased, at the time of his death, left a parcel of land, more particularly described as
follows:

That the above-described real property being conjugal partnership property, the one-half (1/2)
portion of which shall pertain to the surviving spouse;

That pursuant to section 1, Rule 74 of the Rules of Court the parties hereto being all of legal
age and with full civil capacity to contract, hereby by these presents, agree to divide and adjudicate,
as they hereby divide and adjudicate, among themselves the estate of, consisting of his one-half (1/2)
share in the real property above-described, in the following manner;

1. TO– one-third (1/3) as her share from the estate of her deceased husband;

2. TO – one-third (1/3) as her share from the estate of her deceased father;

3. TO – one-third (1/3) as his share from the estate of his deceased father;

That in the event that any other property of the decedent should ever be found which is not
included hereinabove, the parties hereto further agree as they do so agree to settle and distribute the
same in like manner and proportion as herein established;
