AFFIDAVIT OF WITNESS

I, REX NAKIKITA, 35 years of legal age, Filipino, single, a

construction worker and resident of Barangay Poblacion, Oslob, Cebu,
Philippines, 6025, after having sworn in accordance with law, do hereby
depose and state THAT:

1. That I personally know Juan De Mesa and Maria Isabel

Dalisay as they are residents of Barangay Poblacion, Oslob, Cebu.
That Juan De Mesa is a tricycle driver in the said barangay and that
Maria Isabel was the daughter of Elena Dalisay, a reseller of dried
fish in Oslob.

2. That last June 27, 2019 about 7 o’clock in the evening, I

saw Juan De Mesa, driving his tricycle with body number 006, and
Maria Isabel Dalisay as the passenger enter the cemetery while I
was waiting for my companion because we were to paint the
graves of the Pedro family that evening in preparation for the death
anniversary of one of their family members the next day.

3. That after I bought and ate ‘balut’ or around 20 minutes

after they entered the cemetery, I saw Juan De Mesa driving his
tricycle and leaving the Oslob Public Cemetery and Maria Isabela
Dalisay running after the tricycle begging to Juan De Mesa to
brought her home because she was afraid to be alone in the
cemetery.
4. I pitied Maria so I shouted at Juan "Hoy, ang bata
nigukod! Pasakya oy!" (Hey, the child is running after you! Give
 her a ride!). Juan slowed down the vehicle and let Maria Isabel
Dalisay ride with him.

5. That evening, I saw that Juan De Mesa have done

something to the teenager, Maria Isabel Dalisay as she was only
wearing her “sando” while carrying her school polo shirt, skirt and
bag on her hand when she was running after Juan’s tricycle.

6. I executed this affidavit to attest the truthfulness of the

foregoing facts and to support the filling the Criminal Case against
Juan De Mesa for violation of the crime of Rape in relation to R.A.
7610.
