NATURE OF OBJECT EVIDENCE

Object Evidence
1. It refers to an evidence that is
addressed to the senses of the court.
2. It pertains to the real thing itself which
may be Exhibited, Examined or
Viewed by the court
Note:
 That such evidence is not reliant on
visual alone.
 It covers the entire range of human
senses such as: Hearing, Taste,
Smell and Touch.

Purpose It will enable the court to have its


own first-hand perception of the
evidence.

Example:
If the court would want to know
whether the bolo used in the
crime is sharp or blunt, the object
evidence would be the bolo itself

Effect It is considered to have a


persuasive effect on the part of
the court.

Example:
A display of one’s injury during
the proceeding, which could be
physically seen by the court,
doesn’t need other evidence to
prove that such injury was
sustained by the person.

In case Where Physical Evidence runs


of counter to the Testimonial
Conflict Evidence, the Physical Evidence
shall prevail.
