1. PURPOSE
This document is compiled to ensure that all Professional consultants, Contractors and
services providers are made aware of their legal liabilities as per the Occupational Health
and Safety Act, Act 85 of 1993 and the relevant Acts pertaining to their legal
responsibilities.
2. SCOPE
This document is limited to all Service providers and Contractors of Thomo
Developments.
3. OBJECTIVE
The Regulations and sections within this document are there to highlight certain
regulations and sections within the Occupational Health and Safety Act. The legal
information within this document is there to assist and to ensure that aspects of legal
issues are taken care of and that all Professional consultants, Contractors, sub
Contractors and services providers have one and the same set of legal regulations so as
to prevent any confusion.

Note: It is still and will be the responsibility of every Professional consultant,


Contractor, sub Contractor and services provider to make themselves conversant with
the various Acts pertaining to their profession at all times.

This document must be completed to ensure all parties understand and take
cognisance of their legal responsibilities. A Copy of this document must be initialled on
every page, signed and returned to Thomo Developments to be kept on file for future
reference. It is the responsibility of each business Unit to ensure that there will be a
signed copy of each of these signed legal documents on file at any given time.

This document does not purport to be an exhaustive canvassing of all issues and duties
imposed by the Occupational Health and Safety Act, Act 85 of 1993 and Regulations
governing the duties and obligations of a Contractor performing duties i.t.o. an
agreement with the client.

The various duties imposed on a Contractor are more fully described in the OHS Act,
Act 85 of 1993 and its regulations and the Contractor should acquaint himself
therewith before commencing with any work
4. DEFINITIONS
“OHSAct” means the Occupational Health and Safety Act, Act 85 of 1993 and
Regulations
“MHSAct” means the Mine Health and Safety Act, Act 29 of 1993 and Regulations
“danger” means anything which may cause injury or damage to persons or property
“employee” means any person who is employed by or works for an employer and who
receives or is entitled to receive any remuneration or who works under the direct
supervision of an employer or any other person

“employer” means any person who employs or provides work for any person and
remunerates that person expressly or tacitly undertakes to remunerate him, but excludes
a labour broker
“hazard” means a source of or exposure to danger
”machinery” means any article or combination of articles assembled, arranged or
connected and which is used or intended to be used for converting any form of energy to
performing work, or which is used or intended to be used, whether incidental thereto or
not, for developing, receiving, storing, containing, confining, transforming, transmitting,
transferring or controlling any form of energy
“mandatary” includes an agent, a contractor or subcontractor for work, but without
derogating from his status in his own right as an employer or a user
“premises” includes any building, vehicle, vessel, train or aircraf
“remuneration” means any payment in money or in kind or both in money and in kind,
made or owing to any person in pursuance of such person’s employment
“risk” means the probability that injury or damage will occur
“safe” means free from any hazard
“user” in relation to plant or machinery, means the person who uses plant or machinery
for his own benefit or who has the right of control over the use of plant or machinery,
but does not include a lessor of, or any person employed in connection with, that plant
or machinery
“work” means work as an employee or as a self-employed person, and for such purpose
an employee is deemed to be at work during the time that he is in the course of his
employment, and a self-employed person is deemed to be at work during such time as
he devotes to work as a self-employed person
“work-place” means any premises or place where a person performs work in the course
of his employment

5. RESPONSIBILITY
It is the responsibility of each person within each company to comply and to maintain
and to adhere to all legal requirements at all times. The Contractors attention is drawn to
the following Acts as amended from time to time, but is not all inclusive or limited to and
that may be applicable and must be adhered to at all times:
 Compensation for Occupational Injuries and Diseases ACT 130 of 1993,
 Water Act No. 54 of 1956, and
 Atmospheric Pollution Prevention Act No. 45 of 1965,
 Occupational Health and Safety Act No. 85 of 1993,
 Environmental Conservation Act No. 73 of 1989.
 Hazardous Substances Act No.15 of 1973,
 National Building Regulations and Building Standards Act No.103 of 1977,
 National Environmental Management Act No. 107 of 1998,
 National Road Traffic Act No. 93 of 1996,
 National Water Act No. 36 of 1998,
 Relevant By-laws.

6. SECTION 37(2) CONTRACT


ARRANGEMENTS AND PROCEDURES FOR CONTRACTORS ON THE PREMISES
(Initial all pages, sign where applicable and supply a certified copy of your valid
Workmen’s Compensation Fund Letter of Good Standing and Public Liability Insurance
before commencing with any work on site)
OCCUPATIONAL HEALTH AND SAFETY ACT 85 OF 1993 AND ITS REGULATIONS
In terms of Section 37(2) of the Occupational Health and Safety Act 85 of 1993 and its
regulations, henceforth referred to as the OHS Act, the provision of Section 37(1) of the
same act applies to all Professional consultant, Contractor sub Contractor or service
providers hereinafer described as “The Contractor” and any of the Contractors’ agents,
sub-Contractors and third parties (hereinafer referred to as the “Contractor”), in as far
as Thomo Developments, shall not be responsible or liable for the actions or inaction’s
whatsoever in contravention of the OHS Act taken by the employees of the Contractor, in
the fulfilment of the contract undertaken by the Contractor.
As an employer in your own right, you, the Contractor is obliged to comply with all the
provisions of the OHS Act while on the premises/ property /site of Thomo
Developments. The Contractor shall also be required to comply with the conditions and
safety procedures of Thomo Develoments.
Thomo Developments hereby reserves the right to cause all work undertaken by the
Contractor, that is in contravention of the OHS Act and that has come to the attention of
Senior Management - Thomo Developments to cease, until satisfied that such
contravention has been rectified. Non-compliance to Thomo Developments’
arrangements and procedures will adversely affect future contracts, while serious non-
compliance may lead to immediate expulsion from the premises. Any claim resulting due
to non compliance by the Contractor will be recalled and claimed from the Contractor
7. REQUIREMENTS, ARRANGEMENTS AND PROCEDURES FOR CONTRACTORS
It is a condition of this contract that the Contractor and its employees be covered in
terms of the Compensation for Occupational Injuries and Diseases Act 130 of 1993, as
amended. A copy of the certificate of good standing with the Compensation
Commissioner shall be attached to the signed copy of this legal document. Furthermore,
the Contractor certifies that such cover will not expire during the execution of the task
nor will the Contractor become in arrears with any payment due to the Commissioner or
any other documentation required by the Commissioner.

7.1 The Contractor agrees to the following rules:


7.1.1 The Contractor shall have available a copy of the Occupational Health
and Safety Act, Act 85 of 1993 and Mine Health and Safety Act, Act 29

of 1996 if applicable and compile a site safety file according to this


procedure.
7.1.2 Any Contractor shall ensure that Contractor’s employees are made
aware of who the Contractors first aiders are and will be aware of
where the First Aid box is kept.
7.1.3 Any Contractor with more than 5 (five) employees at any time on the
premises / property / site shall have available their own first aid box
for prompt first aid.
7.1.4 Any Contractor with 10 (ten) or more employees shall have at least
one competent and valid first aider on the premises / property / site
at their workplace. Should there be fify or more employees on the
premises a further first aider for every fify employees or part thereof
shall be available., at all times
7.1.5 Any Contractor with less than 10 (ten) employees on the premises /
property / site shall ensure that such employees are made conversant
with the first aider at the workplace.
7.1.6 The Contractor shall keep up to date and available for inspection all
applicable legally required registers as per the Occupational Health
and Safety Act, Act 85 of 1993.
7.1.7 The Contractor shall make himself and his employees conversant with
Thomo Dvelopments’ emergency and evacuation procedures.
7.1.8 The Contractor shall not misuse anything, which is supplied in the
interest of health and safety.
7.1.9 The Contractor shall adhere to all Thomo Developments’ safe working
procedures.
7.1.10 Working Hours:
7.1.10.1 Normal working hours shall be between 07h00 and 16h30
on Mondays Thursdays and Fridays until 15:00. When
necessary On Saturdays as arranged.
7.1.10.2 The Contractor shall not engage in work outside these
hours except by specific arrangement with Thomo
Developments acting through the appointed Thomo
Developments’ employee, Tshokolo Manoko but there
shall be no onus on Thomo Developments to grant such
permission and such permission is a concession to, and not
a right of the Contractor. The cost of any Thomo
Developments or other supervision necessary to be in

attendance whilst the Contractor is working outside normal


hours shall be for the Contractor's account
7.1.11 Injuries on Duty
All injuries/incidents no minor they may appear at the time, must be reported
immediately to the following:
7.1.11.1 Tshokolo Manoko the Thomo Developments responsible
person. Should an injured employee of a Contractor be
transported to hospital by ambulance, the names,
telephone numbers and Workmen's Compensation
registration number of the Contractor and his appointed
official will be registered at the hospital as the responsible
parties. An authorised representative of the Contractor
shall, within 12 hours of the occurrence of such an injury,
make formal arrangements with the hospital pertaining to
treatment, discharge, settlement of accounts etc,
associated with the injured employee.
7.1.11.2 The relevant authorities, i.e. Department of Labour,
Department of Minerals and Energy, South African Police
Services, Workmen’s Compensation Commissioner, etc.
7.1.11.3 Should work be performed on a Mine premises, also to the
Mine safety official
7.1.12 All injuries shall be investigated as soon as possible and the
investigation report handed to the Thomo Developments responsible
person.
7.1.13 Get first aid for cuts and scratches.
7.1.14 The introduction of ignition devices into specified restricted areas is
prohibited. These include matches; lighters and other non-intrinsically
safe items such as battery powered hearing aids, radios, cameras,
cellular telephones, calculators and normal electrical power tools.
7.1.15 Smoking is permitted only in designated safe smoking areas.
7.1.16 Safety devices must not be interfered with and can only be modified,
attended to or bypassed with proper written authorisation from the
responsible Thomo Developments Person. No person or equipment
shall block fire hydrants, emergency equipment, building exits,
walkways, etc.
7.1.17 It is prohibited to indulge in horseplay, fighting or malicious damage.
7.1.18 Personnel safety

7.1.18.1 Walkways and stairs and their handrails, where provided,


must be used.
7.1.18.2 Climbing or standing on equipment, machinery or pipelines
is prohibited unless authorised where alternatives are
impracticable.
7.1.18.3 Avoid loose clothing when working with machinery or
equipment. Long hair must be secured in such a manner
that it cannot be entangled in machinery.
7.1.18.4 Under no circumstances shall personnel enter storage
tanks without the written authority of the Thomo
appointed person.
7.1.19 Safety equipment
The Contractor must supply all his employees with the necessary
equipment at his own expense. The following Thomo Developments
guidelines must be followed:
7.1.19.1 Head protection:
7.1.19.1.1 Wearing of hard hats is compulsory and all
employees shall be provided with hard hats by the
Contractor.
7.1.19.1.2 All hard hats shall be of a SABS approved type
7.1.19.1.3 Hard hats must be inspected regularly and the inner
lining particularly must be checked
7.1.19.2 Safety footwear
7.1.19.2.1 All Contractor's employees engaged in activities
that has a potential for foot injuries must wear
safety shoes/boots of a type approved by the SABS
7.1.19.2.2 All Contractors’ employees must wear safety
shoes/boots at all times whilst within the working
area.
7.1.19.3 Eye and face protection
7.1.19.3.1 Applicable eye protection shall be used by both the
person carrying out the job and his helper/s during
any of the following operations: welding, cutting,
grinding or drilling, chipping, chiselling or scaling,
high-pressure jet cleaning, any work involving
corrosive or hazardous chemicals, drawing samples

of any material from equipment under pressure or


where there is danger of splashing, sandblasting
and when opening equipment which is or was
under pressure.
7.1.19.4 Safety harnesses
7.1.19.4.1 To be worn by all persons working in an elevated
position except when work is performed from a
scaffold, which is fitted with proper handrails, or
when fixed handrails are in position. NO SAFETY
BELTS SHALL BE USED.
7.1.19.5 Hand protection
7.1.19.5.1 For general purpose e.g. handling of material,
cutting, grinding, welding, etc. leather gloves must
be worn.
7.1.19.5.2 Whenever corrosive liquids (Acid, Caustic's or
petroleum products) are handled, PVC gloves must
be worn
7.1.19.6 Vehicles
7.1.19.6.1 Vehicles must be kept in a roadworthy condition at
all times.
7.1.19.6.2 Vehicles and equipment of the Contractor enter the
site at his own risk.
7.1.19.6.3 Vehicle drivers must obey speed limits and traffic
regulations.
7.1.19.6.4 Vehicles or equipment may not be placed or parked
in such a way that they obstruct any fire-fighting
equipment or traffic, or prevent personnel from
carrying out their duties.
7.1.19.6.5 For construction vehicles and mobile plant, see
section 10.15 in the Health & Safety Specifications
section.
7.1.19.6.6 It is the responsibility of the Contractor to follow all
policies regarding vehicles that the customer may
have.

7.1.19.7 Hand tools


No hand tools will be allowed which do not comply with
Thomo Developments general safety standards, e.g.: Files

without handles, mushroomed chisels heads, cracked or


damaged hammer handles.
7.1.19.8 Rubbish and scrap
7.1.19.8.1 The Contractor is compelled to keep his place of
work and the environment clean and free of waste
or rubbish. Disposal of construction rubble and
scrap is the responsibility of the Contractor.
Dumping of construction rubble anywhere on site is
not permitted and the Contractor shall make his
own arrangements with the local authority for
dumping. It is the responsibility of the Contractor to
liaise with the mine/customer regarding the policy
of rubbish/scrap on site.
7.1.19.8.2 Hazardous waste as defined by the Environmental
Conservation Act, shall be disposed of only at a site
classified H:h which is registered to accept these
wastes. A waste manifest shall be obtained and
handed to Thomo Developments.
7.1.19.9 Thomo Developments DIVISION PERMIT TO WORK
The following work may only be performed when the person is in
possession of a properly completed and signed Thomo Developments
“Permit to work”, “Hot Work Permit”, “Lock-out Permit” and/or
“Confined Space Entry Permit” as required is in his possession:
o Potential Atmospheric deviations from normal
o Hot work in a hazardous zone and in general areas
o Entry into a confined space
o Decontamination of any container / tank / pipe
o Isolation of electric energy
o Physical isolation
o Rigging and lifing
o Excavations
o Erecting scaffolds
o General work in a hazardous zone
7.1.19.10 Emergency situations
7.1.19.10.1 Any employee of a Contractor must
immediately report any fire or other emergency
situation.
7.1.19.10.2 The Contractor shall acquaint himself with
emergency procedures and must comply with the
directives thereof.

7.1.19.10.3 The Contractor shall be subject to the health,


safety, environment and security rules of Thomo
Developments.
8 INDEMNIFICATION
The Contractor hereby certifies that all contracting workmen recognize the inherent
hazards that exist on the premises / property / site of Thomo Developments and that the
Contractor:
 Enters the property entirely at his/her own risk and therefore the Contractor waives
any claim of whatsoever nature against Thomo Developments, its employees, agents
and/or mandatories in respect of any loss, damage and/or injury whether same is the
result of any negligent act or omission on the part of Thomo Developments, it’s
employees, agents and/or mandatories or other independent Contractors or by a
third person or by way of defective equipment or materials supplied by the company,
and further the Contractor;
 Hereby indemnifies Thomo Developments, its employees, agents and/or
mandatories against any claims from the Contractor’s employees and/or from any
other person, arising and being caused in the manner set out above.
 Hereby are specifically informed of certain applicable sections and regulations as
prescribed in the Occupational Health and Safety Act, Act 85 of 1993, namely;

NB. The list above is not all inclusive and it is the responsibility of the Contractor and his subcontractors,
agents and employees to ascertain all the relevant/applicable acts and regulations, and comply therewith.

10 HEALTH AND SAFETY SPECIFICATIONS


10.1 General:

 Dismantling fixed plant exceeding 3,0 meters in height,


and/or

 Construction work will exceed 30 days or more than 300


person days, and/or

 Excavation work deeper than 1,0 meters required, and/or

 Construction work will exceed 3,0 meters above ground level


or a landing.

10.1.2 Have a copy of the notification form available on site

10.1.3 Provide proof that you are registered with a compensation fund and in
good standing

10.1.4 Provide adequate funds for health and safety in the tender to ensure
compliance

10.1.5 Provide a documented health and safety plan based on these


specifications

10.1.6 Have your approved health and safety plan available on site

10.1.7 Provide Thomo Developments with your Health and Safety Plan before
work commences

10.1.8 Ensure the Health and Safety Plan is implemented and maintained for
the duration of the contract

If you are the Principal Contractor, you shall:

10.1.9 Ensure co-operation between Contractors to ensure compliance to the


construction regulations

10.1.10 Provide your sub-contractors with this health and safety specification

10.1.11 Appoint all sub-Contractors in writing

10.1.12 Ensure sub-Contractors have health and safety plans implemented and
maintained

10.1.13 Stop any work which is not in line with the health and safety plan

10.1.14 Audit sub-Contractors monthly/weekly to ensure compliance to the


health and safety plan

10.1.15 Obtain proof that sub-Contractors are registered with a compensation


fund and in good standing prior to commencement of the contract

10.1.16 Ensure that sub-Contractors have provided adequate funds for health
and safety in the tender to ensure compliance

10.1.17 Discuss and approve the health and safety plan with every sub-
Contractor

10.1.18 Ensure that every sub-Contractor‘s approved health and safety plan is
available on site

10.1.19 Provide Thomo Developments with a comprehensive and updated list of


all Contractors on site accountable to you including the agreements, the
parties and the type of work to be done.

10.1.20 Ensure that sub-Contractors reporting to you, are competent and have
the resources to carry out the construction work in a safe manner

10.1.21 Ensure that all the above requirements are applied to all sub-Contractors
appointing further sub-Contractor

10.1.22 Ensure sub-Contractors provide you with all information that may affect
the health and safety of any person because of construction work carried
out by that sub-Contractor

10.1.23 Inform all sub-Contractors of the hazards identified in the risk


assessment BEFORE any work has commenced and at times that may be
determined by the risk assessment

10.1.24 Have a safety file where all the required documentation is kept and
available on site

10.1.25 On completion, hand over a consolidated health and safety file t Thomo
Developments which includes all documents required in terms of the Act
and regulations, drawings, designs, materials used and other information
concerning the complete structure.

10.1.26 Appoint a full-time employee as the construction supervisor in writing


(the construction supervisor is not allowed to supervise another site)

10.1.27 Appoint one/two competent employees to assist the construction


supervisor

10.1.28 Appoint a full-time safety officer

10.1.29 Allow the full-time safety officer input at the design stage and into the
health and safety plan

10.1.30 Keep record of the input given by the safety officer

If a full-time safety officer is appointed, ensure that he/she has:

10.1.32  At least five years construction/operations experience

 A SAMTRAC (NOSA or equivalent) qualification

 HIRA (Hazard Identification & Risk Assessment)

 First Aid Level 1

 Fire fighting course

10.1.33 The safety officer has the authority to stop any unsafe work

10.1.34 Appoint a competent person in writing to carry out a risk assessment


BEFORE any construction work is started

10.1.35 Ensure the risk assessment is part of the health and safety plan

Ensure the risk assessment include the following:

10.1.36 Identification of the risks and hazards

10.1.37 Analysis of the risks and hazards

10.1.38 Include a documented plan of safe procedures to mitigate, reduce or


control the risks and hazards

10.1.39 A monitoring plan, and

10.1.40 A review plan

10.1.41 Ensure that a copy of the risk assessment is available on site

10.1.42 Consult with your health and safety committee or with a representative
of the employees on the development, monitoring and review of the risk
assessment

10.1.43 Inform, train and instruct all your employees regarding all hazards and
work related procedures (Proof to be supplied to E+PC Operations)

10.1.44 Ensure that the training is done by a competent person

10.1.45 Ensure that all ergonomically related hazards are analysed, evaluated
and addressed in the risk assessment

10.1.46 Ensure that all persons entering the premises including visitors are given
induction upon them entering the site

10.1.47 Ensure that every person on site has in his/her possession proof by
means of a certificate/sticker that he/she has had induction training.
Proof to be kept on the person whilst on site

10.1.48 Ensure that the induction training is given by a competent person

10.17.3 The MSDS shall be available on site for every hazardous substance

10.17.4 Every person that uses, transport, store or dispose of a hazardous substance
shall be trained and retrained every year. Thomo shall be provided with
proof of training by a competent person.

10.17.5 All flammable liquids and hazardous substances used on site shall be stored in
such a manner that they would not cause any fire, explosion or other
hazards and are adequately ventilated

10.17.6 All employees working with flammable liquids and hazardous substances shall
be provided with and must use the appropriate PPE

10.17.7 All employees required to use, transport or dispose of flammable or hazardous


substances, shall be trained in the correct use of the appropriate PPE

10.17.8 In those instances where flammable liquids are used, persons to be prohibited
from smoking and signage to be accordingly posted

10.17.9 All flammable liquids and hazardous substances shall be kept locked in an
appropriate reasonably fire resistant container, cage or room and access
control to be exercised

10.17.10 Adequate fire fighting equipment to be provided with adequate and appropriate
signage

10.17.11 All containers holding flammable liquids to be kept tightly closed and empty
containers to be removed off site

10.17.12 Only the amount of flammable liquid or hazardous substance required for one
day’s work may be removed from the storage facility at any time

10.17.13 Where flammable liquids are decanted, the container into which and from
which are being decanted, shall be bonded and earthed

10.17.14 Steps shall be taken to ensure that no flammable material such as cotton waste,
paper, cleaning rags etc are stored with flammable liquids

10.17.15 Bulk storage of flammable liquids shall comply with the requirements of the
local fire department.

10.18 Gas cutting and welding equipment
