1. PURPOSE
This document is compiled to ensure that all Professional consultants, Contractors and
services providers are made aware of their legal liabilities as per the Occupational Health
and Safety Act, Act 85 of 1993 and the relevant Acts pertaining to their legal
responsibilities.
2. SCOPE
This document is limited to all Service providers and Contractors of Thomo
Developments.
3. OBJECTIVE
The Regulations and sections within this document are there to highlight certain
regulations and sections within the Occupational Health and Safety Act. The legal
information within this document is there to assist and to ensure that aspects of legal
issues are taken care of and that all Professional consultants, Contractors, sub
Contractors and services providers have one and the same set of legal regulations so as
to prevent any confusion.
This document must be completed to ensure all parties understand and take
cognisance of their legal responsibilities. A Copy of this document must be initialled on
every page, signed and returned to Thomo Developments to be kept on file for future
reference. It is the responsibility of each business Unit to ensure that there will be a
signed copy of each of these signed legal documents on file at any given time.
This document does not purport to be an exhaustive canvassing of all issues and duties
imposed by the Occupational Health and Safety Act, Act 85 of 1993 and Regulations
governing the duties and obligations of a Contractor performing duties i.t.o. an
agreement with the client.
The various duties imposed on a Contractor are more fully described in the OHS Act,
Act 85 of 1993 and its regulations and the Contractor should acquaint himself
therewith before commencing with any work
4. DEFINITIONS
“OHSAct” means the Occupational Health and Safety Act, Act 85 of 1993 and
Regulations
“MHSAct” means the Mine Health and Safety Act, Act 29 of 1993 and Regulations
“danger” means anything which may cause injury or damage to persons or property
“employee” means any person who is employed by or works for an employer and who
receives or is entitled to receive any remuneration or who works under the direct
supervision of an employer or any other person

“employer” means any person who employs or provides work for any person and
remunerates that person expressly or tacitly undertakes to remunerate him, but excludes
a labour broker
“hazard” means a source of or exposure to danger
”machinery” means any article or combination of articles assembled, arranged or
connected and which is used or intended to be used for converting any form of energy to
performing work, or which is used or intended to be used, whether incidental thereto or
not, for developing, receiving, storing, containing, confining, transforming, transmitting,
transferring or controlling any form of energy
“mandatary” includes an agent, a contractor or subcontractor for work, but without
derogating from his status in his own right as an employer or a user
“premises” includes any building, vehicle, vessel, train or aircraf
“remuneration” means any payment in money or in kind or both in money and in kind,
made or owing to any person in pursuance of such person’s employment
“risk” means the probability that injury or damage will occur
“safe” means free from any hazard
“user” in relation to plant or machinery, means the person who uses plant or machinery
for his own benefit or who has the right of control over the use of plant or machinery,
but does not include a lessor of, or any person employed in connection with, that plant
or machinery
“work” means work as an employee or as a self-employed person, and for such purpose
an employee is deemed to be at work during the time that he is in the course of his
employment, and a self-employed person is deemed to be at work during such time as
he devotes to work as a self-employed person
“work-place” means any premises or place where a person performs work in the course
of his employment
5. RESPONSIBILITY
It is the responsibility of each person within each company to comply and to maintain
and to adhere to all legal requirements at all times. The Contractors attention is drawn to
the following Acts as amended from time to time, but is not all inclusive or limited to and
that may be applicable and must be adhered to at all times:
Compensation for Occupational Injuries and Diseases ACT 130 of 1993,
Water Act No. 54 of 1956, and
Atmospheric Pollution Prevention Act No. 45 of 1965,
Occupational Health and Safety Act No. 85 of 1993,
Environmental Conservation Act No. 73 of 1989.
Hazardous Substances Act No.15 of 1973,
National Building Regulations and Building Standards Act No.103 of 1977,
National Environmental Management Act No. 107 of 1998,
National Road Traffic Act No. 93 of 1996,
National Water Act No. 36 of 1998,
Relevant By-laws.

10.1.3 Provide proof that you are registered with a compensation fund and in
good standing
10.1.4 Provide adequate funds for health and safety in the tender to ensure
compliance
10.1.6 Have your approved health and safety plan available on site
10.1.7 Provide Thomo Developments with your Health and Safety Plan before
work commences
10.1.8 Ensure the Health and Safety Plan is implemented and maintained for
the duration of the contract
10.1.10 Provide your sub-contractors with this health and safety specification
10.1.12 Ensure sub-Contractors have health and safety plans implemented and
maintained
10.1.13 Stop any work which is not in line with the health and safety plan
10.1.16 Ensure that sub-Contractors have provided adequate funds for health
and safety in the tender to ensure compliance
10.1.17 Discuss and approve the health and safety plan with every sub-
Contractor
10.1.18 Ensure that every sub-Contractor‘s approved health and safety plan is
available on site
10.1.20 Ensure that sub-Contractors reporting to you, are competent and have
the resources to carry out the construction work in a safe manner

10.1.21 Ensure that all the above requirements are applied to all sub-Contractors
appointing further sub-Contractor
10.1.22 Ensure sub-Contractors provide you with all information that may affect
the health and safety of any person because of construction work carried
out by that sub-Contractor
10.1.24 Have a safety file where all the required documentation is kept and
available on site
10.1.25 On completion, hand over a consolidated health and safety file t Thomo
Developments which includes all documents required in terms of the Act
and regulations, drawings, designs, materials used and other information
concerning the complete structure.
10.1.29 Allow the full-time safety officer input at the design stage and into the
health and safety plan
10.1.33 The safety officer has the authority to stop any unsafe work
10.1.35 Ensure the risk assessment is part of the health and safety plan
10.1.42 Consult with your health and safety committee or with a representative
of the employees on the development, monitoring and review of the risk
assessment

10.1.43 Inform, train and instruct all your employees regarding all hazards and
work related procedures (Proof to be supplied to E+PC Operations)
10.1.45 Ensure that all ergonomically related hazards are analysed, evaluated
and addressed in the risk assessment
10.1.46 Ensure that all persons entering the premises including visitors are given
induction upon them entering the site
10.1.47 Ensure that every person on site has in his/her possession proof by
means of a certificate/sticker that he/she has had induction training.
Proof to be kept on the person whilst on site
10.1.49 Elect and appoint a health and safety representative if twenty or more
employees
10.1.50 Elect and appoint health and safety representatives for every 50 persons
or part thereof
10.2.2 The fall protection and rescue plan to be implemented and maintained
10.2.3 Discipline to be enforced in respect to the fall protection and rescue plan
10.2.4 The fall protection and rescue plan to include a risk assessment on
elevated height work and the procedures and methods to
address the risks
10.2.5 The fall protection and rescue plan to include the process for evaluating
the employee’s physical and psychological fitness to work at
elevated heights
10.2.6 The fall protection and rescue plan to include the programme of training
in respect to elevated height work
10.2.7 The fall protection and rescue plan to include the procedure addressing
the inspection and maintenance of the fall protection equipment
10.2.8 Records to be kept in place in respect to the fall protection and rescue
plan
10.2.10 The Contractor to ensure that all openings in floors, edges, slabs,
hatchways and stairways are adequately protected
10.2.11 The Contractor to ensure that all elevated height work is performed
from a position as if working from a ladder or scaffold
10.2.13 The Contractor to ensure that fall prevention and fall protection
equipment is suitable and of sufficient strength
10.2.14 The Contractor to ensure that fall prevention and fall protection
equipment is securely attached

10.2.15 The Contractor to ensure that fall arrest equipment is only used where it
is not reasonably practicable to use fall prevention equipment
10.2.16 The Contractor to take suitable and reasonable steps to prevent a person
who may fall from being injured by the protection equipment or
surrounding environment
10.3 Structures

10.3.13 All Contractors to ensure that all drawings are kept on site and are available for
inspection by an inspector, other Contractors, Thomo Developments
,Thomo Developments’ agent or employees
10.4.1 The Contractor to ensure that all formwork and support work operations are
carried out under the supervision competent person appointed in
writing
10.4.2 The Contractor to ensure that all formwork and support work structures are
adequately designed, erected, supported, braced and maintained so
that they will be able to support all anticipated loads
10.4.3 All drawings pertaining to formwork and support work kept on site and are
available for inspection by an inspector, Contractor, Thomo
Developments,’ Thomo Developments agent or employees
10.4.4 The Contractor to ensure that all formwork and support work structures are
inspected and checked for suitability by a competent person before
being used
10.4.5 The Contractor to ensure that all formwork and support work structures are
inspected by a competent person before, during and afer placement of
concrete or any other imposed load and thereafer on a daily basis until
the structure is removed
10.4.7 The Contractor to ensure that should weakened formwork or support structure
be detected, that they are immediately reinforced
10.4.8 The Contractor to ensure that adequate steps are taken to:
• Secure deck panels against displacement; and •
Prevent any person from slipping on support work
10.4.9 The Contractor to ensure that persons will not be affected by the use of
solvents or any oils or other similar substances
10.4.10 The Contractor to ensure that upon pouring concrete, it gains sufficient
strength before the support work is removed
10.4.11 The Contractor to ensure that safe access has been provided for all support
work
10.4.12 The Contractor to ensure that all employees involved in support work have
been adequately trained and instructed to perform this work in a safe
manner
10.4.13 The Contractor to ensure that the foundations of the form work are adequate
to sustain the load that is applied
10.5.1 The Contractor to ensure that all excavation work is carried out under the
supervision of a person that is competent and has been appointed in
writing
10.5.2 The Contractor as far as is reasonably practicable evaluate the stability of the
ground before excavation work begins
10.5.3 The Contractor to ensure that suitable and sufficient steps are taken to prevent
persons from being trapped due to a collapse

10.5.4 The Contractor to ensure that no person enters or work in an excavation which
has not been cut back to at least the maximum angle of repose
measured relative to the horizontal, and where the ground is unstable,
without shoring/bracing is in place
10.5.5 The Contractor to ensure that the shoring is so designed and constructed to be
strong enough to support the sides of the excavation
10.5.6 The Contractor to ensure that the sides of the excavation are not overloaded
10.5.7 The Contractor to ensure that adjacent structures and building are supported if
they can be affected by the excavation
10.5.8 The Contractor to ensure that there is a safe and convenient access to the
excavation no more than 6 meters from any worker
10.5.9 The Contractor to ensure that all locations of gas, electricity, water and similar
services have been established prior to the excavation work being
carried out
10.5.10 The Contractor to ensure that all bracing and shoring is inspected:
• daily, prior to commencement of each shif;
• afer every blasting operation • afer an unexpected fall of ground;
• afer substantial damage to supports; and
• afer rain
10.5.11 The Contractor to ensure that when any excavation is made, and it is accessible
to the public or is adjacent to public roads or thoroughfares or by which
persons can be endangered, it shall be adequately fenced at least 1m
high as close to the excavation as practicable
10.5.12 The Contractor to ensure that when any excavation has been done and it is
accessible to the public or is adjacent to public roads or thoroughfares
or by which persons can be endangered, warning illuminants or any
other clearly visible boundary indicators are provided at night and where
the visibility is poor
10.5.13 The Contractor to ensure that the precautionary measures required in terms of
confined spaces (Government Notice No. R. 1031 of 30 May 1986) are
met
10.5.14 The Contractor to ensure that when explosives are required to carry out an
excavation, the explosives regulations are adhered to
10.5.15 The Contractor to ensure that warning signs are posted next to an excavation in
which persons are working or carrying out inspections or tests
10.6.1 The Contractor to ensure that all demolition work is carried out under the
supervision of a person that is competent and has been appointed in
writing
10.6.2 The Contractor to ensure that a competent person carries out a detailed
structural engineering survey of the structure to be demolished

10.6.4 The Contractor to ensure that during the demolition process, a competent
person carries out inspections of the structure as required in terms of
the method statement and to ensure that the structure does not
prematurely collapse
10.6.5 The Contractor to ensure that when any structure is being demolished, all roofs,
floors or other parts are not overloaded with debris
10.6.6 The Contractor to ensure that when any structure is being demolished, all
practical precautions are taken to prevent the collapse of the structure
when any part of the frame is removed (framed buildings)
10.6.7 The Contractor to ensure that when any structure is being demolished,
adequate shoring is in place to prevent any collapse
10.6.8 The Contractor to ensure that when any structure is being demolished, no
person works under unsupported overhangs that have not been
adequately shored
10.6.9 The Contractor to ensure that when any structure is being demolished,
adequate shoring is in place to prevent an adjoining building from
collapsing
10.6.10 The employer to ensure that when any structure is being demolished, all
shoring is designed and constructed to be strong enough
10.6.11 The Contractor to ensure that when any structure is being demolished, the
location and nature of electricity, water, gas or similar services are
established and that steps are taken to render persons safe
10.6.12 The Contractor to ensure that every stairwell used, and every floor where work
is being performed is adequately illuminated
10.6.13 The Contractor to ensure that safe means of access is provided to every part of
the building site
10.6.14 The Contractor to ensure that a catch net or platform is erected to protect
persons from being injured by falling objects
10.6.15 The Contractor to ensure that no material is dropped to any point that falls
outside the exterior walls unless the area is effectively protected
10.6.16 The Contractor to ensure that when waste and debris is disposed of
from a height through a chute, that the chute:
• is adequately constructed and rigidly fastened;
• if inclined at an angle of more than 45 degrees to the horizontal, is
enclosed on all four sides;• is fitted with a gate at the bottom
to control flow; and
• is discharged into a container or an enclosed area surrounded by
barriers
10.6.17 The Contractor to ensure that the chute is designed to be strong enough
10.6.18 The Contractor to ensure that all the floors on which work is being carried out
on, are of adequate strength and are able to sustain their load
10.6.19 Where the risk assessment has indicated the presence of asbestos, the
Contractor to comply with the requirements of the Asbestos Regulations
10.6.20 Where the risk assessment has indicated the presence of lead, the Contractor
to comply with the requirements of the Lead Regulations
10.6.21 Where explosives are used in the demolition process, the Contractor to ensure
that a method statement is in place, and that the work is carried out
under the supervision of a competent person
10.6.22 The Contractor to ensure that all waste and debris is removed from site as soon as
possible

10.8.1 All Contractors that make use of scaffolding, shall have on site a copy of SANS
10085-1 as amended
10.8.2 All Contractors to ensure that all scaffolding is in compliance to SANS 10085-1
10.8.3 The Contractor carrying out scaffolding work, shall appoint a competent person
in writing to supervise all scaffolding operations
10.8.4 The Contractor to ensure that all scaffold erectors, team leaders and inspectors
are competent to carry out their work
10.8.6 All scaffolding shall be inspected afer inclement weather and the results
recorded in a register
10.9.1 Every Contractor to ensure that all suspended scaffolding complies with SANS
51808:1991 / EN 1808 or SANS 1903
10.9.3 Every Contractor to ensure that when suspended scaffold work is carried out,
that all erectors, operators and inspectors are competent to carry out
their work
10.9.7 The Contractor making use of a suspended scaffold, shall forwarded to the
provincial director a copy of the certificate of system design, together
with a copy of the design calculations, sketches and test results and for
what purpose the scaffold is to be used
10.9.8 All Contractors making use of a suspended scaffold shall make sure that
the outriggers:

10.9.9 All Contractors making use of a suspended scaffold shall make sure that:
• the safety factor of the structure is such that it can carry the load;
• the suspension rope and the safety rope are separately connected
to the outrigger;
• each person on the scaffold wears a safety harness attached at all
times to the
• platform or the structure;• the hand or power driven
machinery used for raising or lowering of the suspended scaffold is so
designed and maintained to prevent the uncontrolled movement of the
platform;
• the lifing equipment is so installed for easy inspection;
• the ropes are connected vertically above the working platform; and
• when there are only two connecting ropes that they are so fitted to
ensure that stability of the platform
10.9.12 The Contractor to ensure that the suspended scaffold is inspected by the
competent person or the inspector daily prior to being made use of
10.9.13 The inspection to include the following:
• all connection bolts are secure;
• all safety devices are functioning;
• all safety devices have not been tampered with or vandalised;•
the maximum mass load of the platform is not exceeded;
• that the occupants make use of safety harnesses;
• that there are no visible signs of damage to the equipment; and
• that all reported operating problems have been addressed
10.9.14 The Contractor to ensure that all records of tests and inspections are available
for inspection
10.9.15 The Contractor to ensure that all employees working on or with a
suspended scaffold are:
• physically and psychologically fit for this environment and are in
possession of a medically certificate of fitness;• competent to perform
the work; and
• are trained
10.9.16 The Contractor to ensure all workers have been trained on the following:
• how to access and egress the platform safely;
• how to correctly operate;• the hazards of the job;
• the procedures to follow in the case of an emergency, the

10.9.17 The Contractor to ensure that the moving of the suspended scaffold is done by
trained and competent persons under the supervision of the appointed
competent person
10.9.18 The Contractor shall have the results of the move recorded
10.9.19 The Contractor to ensure that afer use, the suspended scaffold is so isolated
that no person will be placed in any form of danger
10.10.1 The Contractor to ensure that every boatswain chair is securely suspended
10.10.3 The Contractor to ensure that an inspection is carried out prior to and a
performance test immediately afer the boatswain chair has been
erected
10.10.4 The Contractor to ensure that all boatswains chairs are inspected on a daily
basis prior to use
10.11.2 Every builders hoist tower shall have a clear and unobstructed space of 900
mm for over travel
10.11.3 Every builders hoist tower to be enclosed on all sides at the bottom
10.11.4 Every builders hoist tower to be enclosed on landings where moving parts
may be accessible
10.11.6 Every builders hoist tower to be provided with a gate on each landing
10.11.7 Every builders hoist tower landing gate to be at least 1 800 mm high
10.11.8 Every builders hoist tower gate to be kept closed at all times whilst the
conveyance is not on that landing
10.11.9 The builders hoist to be supplied with an efficient braking system which will
hold the hoist in position when the power is off
10.11.10 Articles that are carried in the conveyance are so held that they cannot be
displaced whilst the hoist is in motion
10.11.12 A notice to be posted indicating the maximum mass load and prohibiting
persons from travelling therein

10.13.1 All explosive powered tools to be provided with a protective guard around the
muzzle
10.13.2 The firing mechanism to be so designed that it will only fire if held against the
surface at a force of twice its weight
10.13.3 The firing mechanism to be so designed that the angle of inclination is not more
than 15 degrees from the right angle when fired
10.13.4 Only cartridges that are suitable to explosive powered tools permitted to be
used
10.13.9 Warning notices to be posted whenever explosive powered tools are in use
10.13.10 The operator of such a tool to be provided with suitable eye and ear protection
10.13.11 The operator of such a tool to be instructed in the operation, maintenance and
use of such tool
10.13.12 The issuing of nails, cartridges or studs to be controlled and done in writing by a
person appointed in writing
10.13.13 The issuing of nails, cartridges or studs shall be recorded in a register signed by
the recipient on receipt
10.14.1 The Contractor to ensure that when making use of tower cranes that the
following are adhered to:
• the effects of the wind forces on the structure are taken into
consideration;
• account is taken of the bearing capacity of the ground on which the
tower is to stand;
• the bases for the tower cranes and tracks for the rail mounted tower
cranes are firm and level;• the tower cranes are erected a safe
distance from excavations;
• there is sufficient clear space available for erection, operation and
dismantling;
• operators are competent; and
• operators are physically and psychologically fit and in possession of a
medical certificate of fitness
Safety load units are in place and tested
Load testing takes place prior to use
10.14.2 All cranes and lifing gear such as chain slings, steel wire slings, rope
slings, shackles, chain blocks etc. to be numbered, recorded in a register
and inspected monthly. (NOSA register to be used)

10.14.3 Only a competent person shall do the monthly inspection on lifing equipment
10.14.4 Mobile cranes to have outriggers secured on a stable solid footing prior to use
10.14.5 All cranes and other lifing gear shall have a valid load test certificate available
on site BEFORE it may be used
10.14.7 The Approved Inspection Authority shall provide Thomo with a copy of its
certification/registration
10.14.8 If the load to be lifed exceeds 3 tons, a lifing study shall be compiled and
provided to Thomo
10.15.1 The Contractor to ensure that all construction vehicles and mobile plant are of
an acceptable design and construction and are used according to their
design
10.15.2 All construction vehicles and mobile plant to be maintained in a good working
order
10.15.3 All construction and mobile equipment to be operated only by workers who
have been trained and certified as competent
10.15.4 All construction and mobile equipment to be operated only by workers who
have been declared fit physically and psychologically and is in possession
of a medical certificate
10.15.5 All construction vehicles and mobile equipment shall have safe and suitable
means of access
10.15.6 All construction vehicles and mobile plant shall be properly organised and
ensure there is a method of signals in place
10.15.7 All construction vehicles and mobile plant are prevented from falling into
excavations, water or any other area lower than the working area by
installing adequate edge protection
10.15.8 The operators of construction vehicles and mobile plant to be protected from
falling material or from being crushed in the case of the vehicle rolling
10.15.9 All construction vehicles and mobile equipment to be fitted with electrically
operated acoustic signalling devices and a reversing alarm
10.15.10 All construction vehicles shall be inspected daily prior to use, by an appointed
competent person and the inspection recorded in a register
10.15.11 Persons shall only be allowed to ride in a construction vehicle when in a safe
position provided for this purpose
10.15.12 The Contractor shall ensure all pedestrians on construction sites are adequately
protected
10.15.13 The Contractor shall ensure sufficient and suitable traffic routes on site
10.15.14 The Contractor shall ensure there are sufficient and suitable traffic signs on the
construction site

10.15.16 All bulldozers, scrapers, loaders and other similar mobile plants, when being

10.15.17 All construction vehicles and mobile plant shall be fitted with at least two
working headlights and two working taillights when in operation
10.15.18 When tools and materials are transported together with employees, such tools
and materials shall be firmly secured to prevent movement
10.15.19 All vehicles used to transport employees, shall be fitted with fixed seats of
adequate number for the employees being transported and the use
thereof shall be enforced.
10.15.20 When employees are working adjacent to or on public roads, they shall be
supplied with and required to wear reflective indicators
10.16.1 The Contractor to ensure that before construction commences, and during the
progress thereof, adequate steps are taken to establish the presence of
and guard against any danger to the workers in respect to electrical
cables or apparatus
10.16.2 All electrical installations and machinery shall be strong enough to withstand
the working conditions
10.16.3 In those areas where it cannot be established where electrical devices are,
ensure that employees working with tools that could come into contact
with such devices, are protected by means of rubber insulated gloves or
insulating the handles of the tools
10.16.4 All temporary electrical installations shall be inspected at least once a week by a
competent person and such inspection shall be recorded
