MR. BRUN: Good afternoon, your Honor.

THE COURT: Good afternoon.


MS. WELLS: Pam WeIIS for the PeopIe.

Oh, I guess Mr. Wanke is not here. Never


mind.
THE COURT: We‘ve head phones for him,

too.

13 MR. BRUN: For the record, James Brun for

15 MR. SCHMIDT: Derrick Schmidt on behan

16 of Mr. Wanke.
17 THE COURT: Can you hear us? Mr. Wanke,

18 can you hear us?


19 THE DEFENDANT WANKE: Yes.
20 THE COURT: Okay.
21 MS. HANNIGAN: Erin Hannigan on behan of

22 Mr. Wanke.

23 THE COURT: Okay. We're set for status

24 today.
MR. SCHMIDT: Yes, your Honor.

I beTieve we were set for status to see
who from the pubTic defender's office wou1d be
representing Mr. Wanke in the first chair capacity

since Mr. Perri withdrew.


I did receive the case yesterday

afternoon. I wi11 be representing Mr. Wanke.

I stiTT need to meet Mr. Wanke as weTT as to kind
of get my footing to be honest with you.

11 THE COURT: Okay. So you and Ms.


12 Hannigan are going to be handTing this case?

13 MR. SCHMIDT: That's correct, your Honor.


14 THE COURT: ATT right. We'TT give you
15 time to meet with Mr. Wanke then and ta1k to him,
16 and we can set it over for another status.

18 MR. SCHMIDT: That wiTT be just fine.

THE DEFENDANT WANKE: Your Honor, I do

have a pro se motion that I maiTed to the circuit

c1erk's office. I don‘t know if the prosecution

got it.
Now he's indicating that he didn't.

MR. BRUN: We have not received any

THE DEFENDANT WANKE: And I sent one to


your Honor, I send one to the prosecutor, I sent
one to the pub1ic defender.
THE COURT: Do you see anything in the

THE DEFENDANT WANKE: I have copies.
THE CLERK: I have a jaiT order from the

18th.
THE COURT: No, we don‘t have it either.
MR. SCHMIDT: Your Honor, I do have a
copy of that.

Mr. Wanke is represented by counse]. We

difficuIt for him to argue his own
disquaTification I guess is what I'm saying.
THE COURT: They do that aTT the time.
THE DEFENDANT WANKE: Okay.

12 arguing any position they need to take.

THE DEFENDANT WANKE: WeII, it seems the

process of getting aTT these attorneys assigned to


my case has been credited to us. It's a Sixth

Amendment right. I don‘t know if charging us with


continuances just to provide me with an attorney

is proper.

THE COURT: W911, you can see why that

wou1d be an abuse if we didn't because then


attorneys coqu bude in time probIems -—
THE DEFENDANT WANKE: Sure.
THE COURT: -- just by shifting cases

back and forth.


THE DEFENDANT WANKE: Sure.
THE COURT: So it is attributabTe to the
defense, and it wi11 be today, too.
October 10 at 9:00 o'cTock.
MS. WELLS: Here's the order, your Honor.

THE COURT: Thank you.
