MEMORANDUM OF UNDERSTANDING

This Memorandum Of Understanding is made and entered into at

MUMBRA/THANE, on 4th this day of March, 2020 by and between Mrs. Sanobar
W/o Imran Shaikh, aged about 21 years, Indian, inhabitant of Mumbra /
Thane , residing at   present  at R/no. 404, Sahil Apt, Amrutnagar Mumbra / Thane
city 400 612, hereinafter

called and referred to as the party of the FIRST PART A N D Mr. Imran Masor
Shaikh, aged about 26 years, Indian, inhabitant of Mumbai, residing at Ashirwad
Soc, near Diamond Bakery, 3 No. OT Ulhasnagar, Thane hereinafter called and
referred to as the party of the Second Part/Husband;

WHEREAS the Second Part is the Husband of the party of the First / part and they
were married at Mumbra, on 25/10/2017 as per Muslim rites and rituals and that
the said marriage is arrange marriage.

AND WHEREAS, there are 1 minor children  Daughter by name-

Miss. Saniya, aged about 1 years, born out of the said wedlock in Mumbra;

AND WHEREAS, prior to marrying the Second Part/Husband and his father told
that he is working and after the marriage the First party came to know he is not
working so also the Second Part/Husband totally stopped working after his
marriage with First Party/ Wife knew that Mr. Imran Masor Shaikh is drinking and
his family hide from First Party/ Wife;

AND WHEREAS the First Party/ Wife was every time requesting to Second
Part/Husband to do something either business or work for the livelihood of both
parties as well as other family members but all in vain;

AND WHEREAS the minor Daughter Miss. Saniya was born in the year
2018 at Mumbra / Thane and the entire delivery expenses including medical
expenses was born and incurred by the parents of the First Party/ Wife;

AND WHEREAS when the First Party/ Wife failed to pacify/convince the

Second Part/Husband, she compelled to leave the house of matrimonial and came
down to reside with her parents’ house somewhere in the month of December,
2019, thinking in her mind that one day the Second Part/Husband will realize his
responsibilities and come on right way then the First Party/ Wife will live and
enjoy her marital life with Second Part/Husband and since then the First Party/
Wife is living with her parents;

AND WHEREAS right from 12/01/2020,  meeting was gathered/called in

presence of relatives, well-wishers parents of both parties and in last meeting held
somewhere in June, and in that meeting the First party and his parents requested to
present members of the meeting to give ONE MORE CHANCE to Second
Part/Husband and his parents, and after hearing the grievances of First Party/
Wife, it was finally decided and accepted by both parties that the Second

Part/Husband shall  work for the welfare and livelihood of both parties and 1
minor Girl child   and shall bear - day to day expenses, pocket expenses, medical
expenses, clothing and other required expenses to the First Party/ Wife regularly
and also he will give full respect and moral support to the First Party/ Wife for the
welfare, bright future of both parties and 1 minor Girl child at all times and further
neither the Second Part/Husband nor his parents or other family members will
harass, torture, humiliate, insult or picked up quarrels with the First Party/ Wife. It
was also decided that both parties will prepare, sign and execute Memorandum of
Understanding to avoid any inconvenience to the Second party/wife in future or at
any time;

          AND WHEREAS as stated above in detail and to put all true facts on record
to avoid any inconvenience to the parties and also to save the  parties from any
ruinous litigation’s in future or at any time and also for the bright future and
welfare of the parties and 1 minor Girl child, the parties are executing this
Memorandum of Understanding for record and to place before all authorities
concerned, if need arises;

          NOW THIS MEMORANDUM OF UNDERSTANDING IS WITNESSETH

AND IT IS AGREED BY AND BETWEEN THE PARTIES AS UNDER:

1.      That the right from the date and time of execution of this M.O.U. the Second
Part/Husband and his parents shall visit the residence of the parents of the First
Party/ Wife and shall accompany/bright the First Party/ Wife and 1 minor Girl
child   and from that day the First Party/ Wife shall live at her matrimonial house
in joint family and enjoy her happy marital life.

2.      That the Second Part/Husband hereby say, declare and undertake that
henceforth under any circumstances he, his parents or other family members of
Second Part/Husband shall not harass, torture, humiliate, insult, abuse or picked
up quarrel with the First Party/ Wife under any circumstances. 

3.      That the Second Part/Husband hereby say, declare and undertake that he and
his parents, family members shall give full respect and provide moral support to
the First Party/ Wife and 1 minor Girl child  and also give/provide day to day
expenses, pocket expenses, medical expenses, and other required expenses to the
First Party/ Wife and 2 minor children’s regularly.

4.      That the Second Part/Husband hereby say, declare and undertake that he or
his parents, family members shall not discuss/talk on any previous topics /

subjects/issues under any circumstances    nor humiliate or insult the First Party/
Wife on any previous/old topics / subjects / issues.

 5.      The Second Part/Husband hereby say, declare and undertake that in case he
failed to comply and obey the decision taken in meeting held in January, 2020 as
aforesaid in detail, and also disobey conditions of this M.O.U., the Second
Part/Husband and his parents shall be held responsible for all ricks, costs and
consequences and for ruining the life and bright future of First Party/ Wife and 1
minor Girl child, the Second Part/Husband and his parents shall be held
responsible alone and shall be liable to bear all its costs, risks and consequences.

 6.      The Second Part/Husband hereby say, declare and undertake that he is not
having any love affair with any woman or girl and in case he found in love affair
with any woman or girl, then he shall be held responsible alone for the same and
bear its entire costs and consequences.

7.      That the Second Part/Husband hereby say, declare and undertake as and now
he will stop from drinking liquor for betterment his wife and 1 minor Girl child
and other family members of Second Part/Husband.

8.      That to avoid any inconvenience and to avoid from any ruinous litigation,
between the parties the parties have executed this  Memorandum of Understanding
signed/executed  by them and present witnesses for record and to place/submit 
before all concerned / competent  authorities for all necessary purposes, if need
arises.

9. That this Memorandum of Understanding has been executed in good state of

mind, health, without any pressure or undue influence by anybody else by and
between the parties and the parties have signed/executed the same in presence of
each other and witnesses, family members and the contents of this M.O.U. is and
shall be binding upon the parties and their heirs, legal representatives at all times.

          IN WITNESS WHEREOF the parties hereto have hereunto set and
subscribed their respective hands and signature at Mumbra, Thane to this
Memorandum of Understanding, on the day, month and year first mentioned
above.
