OTHER MEASURES INTEGRATED THERETO AND FOR THE
PURPOSE ADOPTING A NEW SPORTS INCENTIVE ORDINANCE FOR
THE CITY OF BAGUIO.”

 Atty. Brenner L. Bengwayan, Secretary to the Sanggunian, said that public


consultation is a venue for the legislators to gain inputs from the experts of
different community. Aside from the fact that it is a requirement of law, it is
also found out that ordinances that have undergone public consultations are
more effective, more implementable because of the inputs of the
participants.

The Sangguniang Panlungsod (City Council), Committee on Youth Welfare and


Sports Development, invited the following personalities or their representatives, to wit:

2. Representative from the University of the Cordilleras
3. Representative from Saint Louis University
4. Representative from the City Administrator’s Office
5. Representative from the Baguio Olympics
6. Representative from the different 128 Barangays in the City of Baguio
7. Representative from the Kick-boxing and Boxing Associations
8. Representative from the Accounting Office, City Hall, Baguio City
9. Representative from the Sports Office
10. Representative from the Max Fusion
11. Representative from the Organization or Association representing the
Taekwondo
12. Representative from the University of Baguio Athletic Office
13. Representative from the Philippine Military Academy

 Hon. Levy Lloyd B. Orcales, Chairperson of the Committee on Youth Welfare


and Sports Development, thanked all the participants and said that they are
expecting experts from the sports community will give inputs to help the

legislators in the City Council to craft a comprehensive sports code which will
cover all aspects of sports in the City of Baguio, most especially on the
promotion of sports activity not only in the schools but as well as in the grass
roots level. The incentives of the athletes must be given proper attention not
only by the City but as well as the people.

(Series of 2014)

CREATING AND ESTABLISHING THE BAGUIO CITY SPORTS


PROMOTION AND DEVELOPMENT COUNCIL AND PROVIDING
FUNDS TEHREOF.

 All participants said that they are not aware of the said Ordinance.

 Ms. Jonalyn Pagada, Head of the Agenda and Information Management


System said if there are Ordinances that are not being implemented then
they can be improved and incorporated in the proposed sports code.

EXPLANATORY NOTE
 It is anchored in the Philippine Constitution

SECTION I. Title

SECTION II. Creation


- There is hereby created in the City of Baguio a City Sports Promotion and
Development Council (CSPDC) which may be known for brevity as City
Sports Council.

SECTION III. Composition


- The City Sports Council shall be composed of the Honorable City Mayor as
Chairman and of members to be named in the appropriate implementing order
to be issued by the City Mayor following identification of chosen, selected or
appointed representative of the sports discipline, institution, association,
group, offices or officer, to wit:

a) Sports and Recreation Division of the City Administrator’s Office;


b) Department of Education (DepEd) Division Superintendent;
c) Department of Education (DepEd) Division Office Sports
Committee/Officer;
d) Baguio City Police Office (BCPO)
e) Baguio Correspondents and Broadcasters Club (BCBC) or media;
f) Coach/trainer, combative sports;
g) Coach/trainer, non-combative sports;
h) Athletes’ Organization;
i) Umpires/referees’ organization;
j) Chair, Sangguniang Panlungsod (City Council) Committee on Education,
Culture and Historical Research;
k) Chair, Sangguniang Panlungsod (City Council) Committee on Youth
Welfare and Sports Development;
l) Chair, Sangguniang Panlungsod (City Council) Committee on Tourism,
Special Events, parks and Playgrounds;
m) President, Liga ng mga Barangay [Association of Barangay Councils
(ABC)], Baguio City Chapter;

The Sports and Recreation Division of the City Administrator’s Office shall
serve as the secretarial of the City Sports Council.

ADMINISTRATIVE ORDER COMPOSING THE BAGUIO CITY


SPORTS PROMOTION AND DEVELOPMENT COUNCIL (CSPDC)

o Ms. Jonalyn Pagada said that this was the last Administrative Order signed
by the former City Mayor for the creation of the Baguio City Sports Promotion
and Development Council. It is based on the existing Ordinance. The
composition of the Sports Council as enumerated in the said AO is the same
as that of the existing Ordinance.

o A participant said that the composition of the Sports Council has too many
members that is why, they do not convene anymore. There was a suggestion
made that the composition be reduced in a number that is more manageable
so that suggestions can be introduced by the members of the council. At least
seven members would comprise the council or a maximum of fifteen
members.

o A participant from the Administrator’s Office said that there must be a


proportionate representation coming from the government and private
sector. At least 60 percent from the government and 40 percent from the
private sector.

o Hon. Vladimir D. Cayabas said that they should review first the composition
of the council for them to be able to determine the office that the members
represent.

o A participant said that on the combative side of the council, it should be


composed of clustered groups. Combative as one. Non-combative is a big
group, wherein ball games, board games, batted games can be created
because there are different experts on the said games and they cannot relate
on each game that they are into.

o A participant said that if it is possible to carry the Philippine Olympic


Committee especially the sports on the representation and not clustering. If
they can create the Philippine Olympic members as the Local Sports
Association. So in this case, there will be representatives from the different
sports and they will be recognized.

o Hon. Vladimir D. Cayabas said that the composition must be reviewed for
them to be able to appoint a particular office or organization and they will be
the one who will appoint their official representative/s.

o Hon. Betty Lourdes F. Tabanda agrees because if they put down names it is
only limited to those persons. If the said persons will no longer be active in
the association or in the sports, a new order will be issued again in order to
replace them. The Proposed Sports Code deals more on accreditation and
incentives but there should be specific provisions in the Code on the
development of the athletes not only those who win. Rather, there must be a
provision in the Code for the allocation of funds for the trainings and
incentives of those who are developing for them to be able to discover new
talents and for them to be able to win.

o Hon. Levy Lloyd B. Orcales said that the suggestions made by the Hon.
Tabanda will be taken for the development of the Sports Code. With regards
to the composition, there is a recommendation or suggestion from the City
Administrator’s Office under the City Sport’s Office they included the
Committee on Tourism because they are trying to push forward the City of
Baguio with the advocacy of sports tourism. The Chairman of the Committee
on Tourism on the City Council will be included as member of the sports
council. Other members will be coming from the representatives of sports
oriented NGO’s, representative from a civic related NGO and representative
from private schools. They will convene and they will select who will
represent them in their group in the sports council. However, the opinion of
the people must be heard on who shall be the members of the council.

o Hon. Betty Lourdes F. Tabanda noticed that they are concentrating on Dep-
Ed sprots but they also have to consider that there are other collegiate sports
like BBEAL and others. Is it possible to include the collegiate not on the
development but in the membership?

o All participants are amenable to the amendment of the composition of the


sports council.

SECTION 3. COMPOSITION – The City Sports Council shall be composed of the


Honorable City Mayor as Chairman and of members to be named in the
appropriate implementing order to be issued by the City Mayor following
identification of chosen, selected or appointed representative of the sports
discipline, institution, association, group, offices or officer, to wit:

a) Sports and Recreation Division of the City Administrator’s Office


b) Department of Education (DepEd) Division City Superintendent;
c) Baguio City Police Office;

o Some participants said that they are amenable that the BCPO is not
needed in the Sports Council.

o Hon. Vladimir D. Cayabas said that if there is a representative from


the BCPO then they can justify their inclusion in the council.

o A participant said that for the security and protection especially if
there is a game in the City, the presence of the BCPO is needed.

o Hon. Vladimir D. Cayabas said that even if they are not members of
the committee, if their presence will be requested, it is still part of
their mandate.

d) Baguio Correspondents and Broadcasters Club (BCBC) or media;

o A participant said that the presence of media is necessarily since


broadcasting is needed if there are events or games conducted in the
City.

o Hon. Vladimir D. Cayabas said that that BCBC is an organization of


the media men but not all media practitioners are members in the
club but they can still be included.

e) Combative Sports representative;

o A participant said that one representative only which will be chosen


by the members.

o A participant said that they agree with the suggestion but it is much
better if the combative sports will be federated. The president of the
combative sports will be the official representative of the group in the
council.

f) Non-combative Sports representative;

o A participant reiterated the first suggestion that the non-combative


sports should be clustered.

o A participant said that the clustering should be represented by one


representative for each game. Like ball games, board games, batted
games, bracket games, athletics.

o A participant said that even in the Combative Sports there should be


clusters or their will be coordinators or representatives per event.

o A participant said that a council is being develop wherein they can


convene effectively. The suggestion that per game or event is great
but they must also consider that our representative in the council
should only be one.

o A participant said that regarding the clustering of events there might


be problems that might arise.

o A participant said that based on the query, in the National Sports


Association there is an accredited representative from Baguio. It is
better to involve these people for them to have an easier access with
the linkage in PSC and the mother association or the NSA. In addition,
in each event, there is an assigned coordinator, it is but proper to
include them.

o Mr. Gaudencio Gonzales, Head of Sport’s Office, Baguio City, said
that the Local Sports Association are under the umbrella of the
National Sports Association. The City of Baguio based on its policy, is
not recognizing those clubs, associations or local organizations which
does not belong with their umbrella organizations. In the case of Local
Sports Association they should be accredited for them to be
recognized. The aim of the City of Baguio is to unify all Sport’s
Association in Baguio.

o A participant said that only combative sports will be given the


convention to have the representation.

o A participant said that it is the time to have a federation for the


combative sport. The problem with the NSA is that even if there is a
request for accreditation, it is being denied. They suggested that the
clubs and organizations be accredited with the city and the city will
get the accreditation from the NSA so the city decides to avoid
factions in different clubs or organizations.

o A participant from the extreme sports and e-sports said that they
should also be given the chance to represent them in the council. They
will be included as the 6th cluster in the non-combative sports. And
since they are numbers in its composition, they will choose between
themselves who will represent them in the council.

g) Athletes Organization

o Hon. Levy Lloyd B. Orcales asked what this organization is and who
they are representing.

o A participant said that this is no longer existing since the last time
they convened was 2014.

o All participants are amenable that the representation of the athletes’


organization be removed in the council.

h) Umpires/referees’ organization

o A participant said that this is no longer existing. All of them are


amenable to remove this representation in the council.

i) Chair, Sangguniang Panlungsod (City Council) Committee on


Education, Culture and Historical Research

o All participants are amenable to retain this representative.

j) Chair, Sangguniang Panlungsod (City Council) Committee on Tourism,


Special Events, Parks and Playgrounds

o All participants are amenable to retain the committee membership.

k) Chair, Sangguniang Panlungsod (City Council) Committee on Youth
Welfare and Sports Development

l) President, Liga ng mga Barangay [Association of Barangay Councils


(ABC)] Baguio City Chapter

m) President, Pederasyon ng mga Sangguniang Kabataan, Baguio City

o All participants are amenable to remove the committee membership


since it is the same with the Chairperson of the Committee on Youth
Welfare and Sports Development.

n) Sports coordinator, Private Secondary Schools


o) Sports coordinator, Public Secondary Schools
p) Sports coordinator, Public Elementary Schools
q) Sports coordinator, Private Elementary Schools

o A participant suggested that there should only be one (1) private


schools representative and one (1) DepEd representative.

o A participant said that EPS and SGAD Chair should also be a member
of the Sport’s Council and one (1) representative from private
elementary and secondary schools;

o A participant said remove all the representatives from the public and
private secondary and elementary schools and DepEd Superintendent
and MAPE representative.

r) Representative from the Paralympic.

ORDINANCE NUMBERED 20
(Series of 2016)

REPEALING ORDINANCE NUMBERED 092, SERIES OF 1994, AND OTHER


MEASURES INTEGRATED THERETO AND FOR THE PURPOSE ADOPTING A
NEW SPORTS INCENTIVE ORDINANCE FOR THE CITY OF BAGUIO.

Explanatory Note

Section I. Title
- This Ordinance shall be known as “The Baguio Based Athletes and Coaches
Incentives and Benefits Ordinance of 2016”

o A participant asked what is a Baguio based since there are instances wherein
an athlete is studying in Baguio but he is originally from other places outside
Baguio.

Section II. Declaration of Policy

Section III. Definition of Terms

a) Baguio based athlete – is an individual who, by himself, or as a member of a team, is


allowed to participate in any individual or team sports competition in representation of

the city by reason of his enrolment in a school in the city, membership in an accredited
sports club, organization or discipline, located and operating within the City of Baguio,
official function or simply his residency in the City of Baguio. A team composed of said
Baguio-based athletes participating in team competitions for the same representations
aforementioned is included in the definition. An athlete with disability as defined under
RA 7277, otherwise known as the “Magna Carta for Disabled Persons” is not excluded
from the definition.

o A participant said that athletes residing in the City of Baguio should be given
priority.

o A participant from the City Sport’s Office said that as to funding, the City is
trying its best to give each athlete their incentives.

o Hon. Vladimer D. Cayabas said that the Baguio-based athlete does not mean
that the athletes should come from Baguio City since it is not a Baguio
citizen’s athlete. There are three (3) elements: a) one who is officially enrolled
in a university or schools, b) he is a member of an accredited sports club,
organization or discipline, c) must be a resident of the City of Baguio.

o A participant said that in the Batang Pinoy they have players who are
residing outside Baguio. If will limit the players to those who are only in the
City of Baguio, then there will be problems in the future.

o All participants are amenable to the definition of Baguio-based athletes.

o A participant said that there must be a revision as to the incentive


requirement wherein barangay residence certificate is a must.

b) Baguio-based athlete – is one who by reason of his enrolment in any school in the City of
Baguio, membership in any recognized or accredited sports club, organization or
association in the City of Baguio or residency in the City of Baguio, has qualified and is
allowed to represent the city in an individual or team sports event in a regional, national
or international sports competition. It includes an athlete with disability as defined under
RA 7277, otherwise known as the “Magna Carta for Disabled Persons”.

o All participants are amenable to the definition of Baguio-based athlete.

c) Baguio-based coach – is a duly organized or accredited coach by the Philippine Sports


Association, Philippine Olympic Commission, National Paralympics Commission or
other similar sports bodies, including international or foreign sports bodies, who is
registered as such in the roster of coaches of the city and is thus assigned and handling
the training and/or participation of a Baguio-based athlete or team for, at least, a regional
sports competition.

o A participant said that the Philippine Olympic Commission should be


Philippine Olympic Committee and Philippine Sports Association to Philippine
Sport Commission.

o A participant from the Accounting Office, Baguio City said that as to


incentive there are certain problems that arises, since if there are delegates
from the national the listing of the coaches and athletes attached are not
specified therein. Suggestion was made that it is better to specify the name of
the coach and the names of the respective athletes under the coach.

o A participant said that in the definition of the Baguio-based coach, some
coaches will not qualify for the reason that they are not recognized or
accredited coach by the Philippine Sports Association and Philippine Olympic
Commission but they are DepEd recognized coaches.

o A participant said that DepEd recognized coaches are included since in the
definition of Baguio-based coaches, it is indicated therein that those
registered in the roster of coaches of the city and is assigned and handling
the training and or participation of a Baguio-based athlete is considered as
such.

o A participant suggested that there should be a more stringent process on


how the head coach shares the incentive to other coaches. Since an athlete
has a head coach, therefore the incentive cheque goes under the name of the
head coach.

o A participant said that there should be an elimination per category who will
be the coach. In 2020, the elimination of per category will now be
implemented.

o Hon. Vladimer D. Cayabas said that there is difference between benefits and
incentive. They should also take into consideration the benefits that are to be
given to our coaches and athletes.

o A participant in the Sport’s Office said that if the DepEd results of city meet is
not feasible then there will be another system of elimination that will be
implemented.

o A participant said that there must be an Ordinance in the City of Baguio that
will be proposed that all athletes must undergo a selection process.

o A participant said that the selection or elimination should be a program of


the city for the athletes or coaches to prepare themselves for the upcoming
events. There should be a system to be developed for the elimination process.

o A participant from the Sport’s Office said that thru the Baguio Olympics’ city
athletes will be created. They will be having a pool of athletes wherein they
will cover all events.

d) National Sports Commission – is one organized, recognized, and accredited as such by


the Philippine Olympic Committee (POC), the Philippine Sports Commission (PSC) or
by the National Paralympics Commission, Philippine (NPC-PHIL) like the Palarong
Pambansa and Philippine National Games.

o A participant from the Sport’s Office said that there should be an


amendatory ordinance to include competitions of the NSA’s since this
association has a lot of events. If they have a delegation, there must be an
elimination so that the athlete will represent the City of Baguio not per club
or organization.

o A participant in the Accounting Office said that according to the definition of


national sports commission it requires that the event should be organized,

recognized and accredited. It is then suggested that it is much better to state
“recognized and/or accredited”. They also have to consider how many
national sports competition can an association conduct to avoid problems as
to funding.

o A participant said that the Ordinance is so much driven. There should also be
an exception to the rule.

o A participant from the Accounting Office said that before the disbursement
of the funds as to sports incentives must comply with the rules and
regulations.

o Hon. Levy Lloyd B. Orcales said that there must be an amendment to the
ordinance.

o Hon. Francisco Roberto A. Ortega VI said that it is time to develop the sports
development in the city.

o A participant said that they should also include that of the motor sports since
it is high time for them to be recognized since the city have a lot of
champions in this kind of event.

o A participant asked if it is possible for them to have separate or bigger


incentives for national open games.

e) An international sports competition – is any of sports competition listed under any of the
categories of international sports competitions as provided under RA 10699 that will
include the World Olympics and the Asian Games.

o A participant from the Accounting Office said that they are qualified as long
as it is defined in the ordinance and anchored in RA 10699. Since RA 10699
enumerates the events that are considered international sports competition.
If the athlete joined the said event then, then they are entitled to the
incentives.

o A participant suggested that those participants in the events that are not
enumerated under RA 10699 should also be given incentives since they are
considered representatives in the City and the Philippines.

f) Regional sports competition – is one sanctioned as such by the appropriate accrediting


agency like the Cordillera Administrative Region Athletics Association (CARAA) and
the qualifying legs of the Philippine National Games and the Batang Pinoy. A supposed
national sports competition or event may be considered and treated merely as a regional
sports competition in the implementation of this ordinance when the number of regular
participants thereto shall have been reduced by twenty five percent (25%) based on the
number of participants in the last staging of the same or on the number of expected,
targeted or invited participants for a new event.

SECTION IV. BENEFITS AND PRIVELEGES OF BAGUIO-BASED ATHLETES AND


COACHES.

a) The final screening of qualified Baguio-based athletes and coaches shall be done and
undertaken by the City Sports Promotion and Development Council. An accreditation and

identification shall be given by the Sports and Recreation Division of the Office for City
Administration (OCA-SRD).

b) The accredited and identified Baguio-based athletes and coaches shall be entitled the
following benefits and privileges to wit:

b.1. Priority and free use of sports facilities belonging to the City for such period as may
be necessary to train or prepare for a competition in accordance with the schedule as may
be arranged with the administrator of the facility;
b.2. Free medical and dental consultations and services in the city health and dental
clinics or units and also in government hospitals and other facilities as may be assigned
or coordinated in the preparation or conduct of sports competition;

b.3. Appropriate medical assistance for treatment incurred in trainings supervised or


arranged in preparation for a competition or in sports competition in accordance with
guidelines the OCA-SRD shall adopt for implementation;

b.4. Uniform allowances and financial assistance in participations in national or


international sports competitions as provided and allowed in the OCA-SRD budget and in
accordance with the adopted guidelines and programs as well as accounting and auditing
requirements;

b.5. Free parking privileges in available parking spaces or terminals of sports facilities
owned by the city while training or preparing for a sports competition;

b.6. Automatic city recognition and commendation for a win or medal tallied in any
national or international sports competition;

b.7. Other benefits as may be provided in sports competitions to be attended or


participated in and also as may be hereinafter be arranged, coordinated or provided by the
host, organizer or by the city delegation or OCD-SRD.
SECTION V. CASH INCENTIVES.
- In addition, wins or medal tallies on national or international sports
competitions shall entitle the winning athletes and their coaches to cash
incentives as provided hereunder, to wit:

SECTION VI. RATIONALIZATION.


- To ensure full assistance and attention to their athletes, the cash incentives of
coaches in an international competition shall not exceed thirty thousand pesos
(P 30,000.00) pursuant and consistent with Section 5.b, Philippine currency
and in a national competition, it shall not exceed twenty thousand pesos (P
20,000.00) pursuant and consistent with Section 5.b.

By legislation and on special considerations, national athletes who are


Baguio-based and professional athletes who are likewise Baguio-based, as
well as, their coaches may be granted special cash incentives in addition to
national cash incentives or cash prizes granted or earned in their incentives.
SECTION VII. FUNDING.
- Funds for the implementation of this Ordinance shall be allocated annually as
part of the budget for the OCA-SRD.
SECTION VIII. REQUIREMENTS AND PROCEDURES OF AVAILMENT.
- Complying with accounting and auditing requirements, the OCA-SRD shall
adopt and implement simple procedures and guidelines for the immediate
release if the cash incentives of athletes and coaches. As much as possible, the
system shall consider having all possible requirements already submitted in
the accreditation or listing of athletes and coaches so that release of incentives
will become ministerial with the certified results of the competition.
The guidelines shall also include provisions for delisting and the cancellation
of privileges that the City Sports Development Council may appropriate to
adopt.
SECTION IX. SEPARABILITY.
SECTION X. EFFECTIVITY.

o Hon. Levy Lloyd B. Orcales said that as to medical expenses or medical aid of
the athletes, there are free assistance being given by the EMS or CDRRMC.

o A participant said that as to medics, there should be a specific medic


assigned for sports.

o A participant suggested that if there are events it should be registered ahead


of time with the Sport’s Office so they can assist in the delegation of medical
group.

NATIONAL SPORTS EVENTS


1. The Philippine National Games
- PNG is the most elite in terms of competitiveness because in the Philippine
National Games athletes compete with the national team. So it is a mandatory
for the national players to compete in the Philippine National Games.

2. Batang Pinoy
- Recently, Philippine became the champion for three consecutive years. There
is a funding source amounting to 1.2 million. Batang Pinoy has regional
elimination and national championship. The issue on Batang Pinoy was
brought out to the Philippine National Games because of the cash prize. Under
the Batang Pinoy it’s 3 million and under the Philippine National Games it’s 5
million.

3. All women’s Martial Arts Festival


- The events are Arnis, Fencing, Judo, Karatedo, Muaythai, Pencak Silat,
Taekwondo, Wrestling and Wushu.

4. PHILSPADA
- The fund of this sport was already transferred to PDAO who is in charge with
the activities of those athletes with disabilities. Although the fund was already
transferred there is still a need for PDAO to coordinate with Sports Division.

6. Palarong Pambansa
- The City Government of Baguio is giving additional allowance to the athletes
amounting to P2, 000.00 for athletes and coaches. This is a monetary help
extended to athletes in order for them to perform well. This is also in addition
to the allocation made by DepEd.

INSTITUTIONALIZED SPORTS EVENTS


1. Baguio Little League- This event has sports funding amounting to one
hundred two thousand.

2. Football, volleyball league are sport events supported by the City Government
of Baguio.

3. The Baguio Learn to Swim. This is a summer activity. Interested parents who
want their children to join or participate in this event will be accommodated.
The City will shoulder the honoraria of the trainer or coaches of swimming.
4. Children’s games- This is a new program adopted from the Philippine Sports
Commission. The concept is good for the children and in this event
Indigenous game ball will be included in order also to cater various Filipino
games such as kadang-kadang, sanggol, sack race etc.
5. Mr. Baguio- This event is made through resolution of the City Council.

6. PhilAm Golf

HOSTING AND FINANCIAL SUPPORT

- This is a support extended by the City Government of Baguio to host a
national events that will be conducted in the city.

FINANCIAL ASSISTANCE
- This is a contingency fund where they get the fund for pocket money of those
athletes who lack monetary support especially if they compete abroad subject
to accounting and auditing rules and procedures of the City.
- On top of the presentation of the Sports Office, he emphasized that they really
need facilities and the City should provide facility in the multi-level.

DEVELOPMENT PROJECT AT THE BAGUIO ATHLETIC BOWL


PARKING LEVEL (PERSPECTIVE)
- On the rooftop, there are two basketball courts. There is a rooftop garden that
can also be utilized as an activity area. In the first level, parking. Second level,
youth center and either multipurpose or all indoor games such as table tennis,
badminton, etc. There is six lanes for bowling lanes and billiard tables.

- This project was conceptualized way back 2016. The City has allotted 60
million under the Supplemental Budget unfortunately this project was not
completed nor even pushed through because of budget constraint which is
amounting to 300 to 400 million in order to make this project successful. The
60 million was used to build the swimming pool.

RECOMMENDATIONS FROM THE PARTICIPANTS


- City Council to craft a policy and include the Out of School Youth to
participate in sports competition.
- Available spaces in Baguio Athletic Bowl may be used while the project
development is ongoing.

Presentation on the process of incentive from the Accounting Office

- Basic requirements for all types of disbursement as provided by COA


Circular 97-004
- Certificate of availability of fund as certified by the proper officer;
- Existence of lawful insufficient allotment duly obligated as certified by the
Budget Office. This serves as proof of payment for the incentive;
- Approval of claim or expenditure by the City Mayor;
- Complete documentation to establish validity of claim. (Accounting Office)
- Legality of transaction and conformity of the expenditure to existing laws and
regulations. There should be legal basis like ordinance. The accounting Office
cannot deny any claim if there is a legal basis.

- Official list of delegates(specified list of athletes, coaches)
- Official results to tally in the certified medal tally.

- Issues raised on the process of incentives
- How many months or days are given in order to submit the listing of names or
payroll for the release of the amount being requested?
 IRR states that submission of official results for competition shall be
submitted within 2 months to OCA SRD after the event including
needed documents for verification like payroll preparation, liquidation
and accounting procedures. Non- submission of results during the
prescribed period shall automatically mean forfeiture of the claim.

 There are so many requirements to provide just to claim incentives,


pabalik-balik sa Accounting.

 Under the Citizens Charter, once the documents are submitted to the
Accounting Office, they are mandated by law to act on it within three
working days. Below are the requirements and procedures of
availment of incentives.

 Invitation letter from the sports event organizer, local sports


association letter of intent to participate in said event addressed to the
City Mayor;

 Official delegation list, indorsement f the CSPDC through its Chair.

 Updated copy of LSA accreditation and/ or certificate of affiliation;

 Updated barangay clearances of winning athletes and coaches;

 Official result issued by the event organizer;

 Certificate of participation; and

 Newspaper clippings, pictures and other documents as may be required


to support the claim.

 National sports competition-organized and accredited.

 National Sports Competition like the Palarong Pambansa, Philippine


National Games, Batang Pinoy, PHILSPADA and All Womens. What
is common in national competition is there is elimination in the
national and there is also competition of different sports discipline.
- Amend the sports incentive code of the City of Baguio and then write specific
provision.

- Clarifying the definition of national competition as stated in the ordinance.


Put parameter in the definition and at the same time to put the minimum.

- How are they going to amend the ordinance?

 There is a suggestion to lower the incentive prizes in order to include
other invitational.
.
 Better to increase additional funds in order to accommodate all
athletes.

- With regards to the limited number of coaches, Sir Gudz stated that they are
only working on a certain amount or certain budget therefore athletes and
coaches should share the prizes considering that the City could not
accommodate everything. He mentioned that they could also identify the
specific number of athletes or number of coaches in the ordinance.

- There is a suggestion to invite the NSA and join in the organizing of Local
Sporting events.
- Additional function of the council is to check and review if it is qualified for
incentive.

- Submit the list of sporting events or calendar of sporting events in order to


specify in the ordinance.

- The Office of the Sports and Recreation is open for suggestions.

- In order to qualify the local events that were categorized as national it might
as well get certification from NSA that the City will organize national event
and make it as LGU based promoting tourism in the same manner invite other
LGUs to make it national events.

- Asking for benefits of the officers of sports clubs, technical officials and
coaches to be considered.

Budget Office on incentives

- There will be no problem on incentives as long as supported by ordinance.


The first regulation of the City Budget is there should be budget proposal. It is
not only incentives but also the travel allowance, accommodation are given
and being claimed therefore it is required to submit project proposal.

- The City Government of Baguio allotted 22, 787 million pesos for the sports
activity of the City and 6, 356, 384 million for the incentives and prizes of
athletes and coaches.

Below are suggestions and inquiries manifested by the participants


regarding incentives:

o For as long as it is compliant with all existing ordinances and all laws of the
city it can proceed with the release of the incentives but if it would require
clarification on the documents submitted there is a need to deal with the
concerned offices.

o Pamadayaw event to include in the programs and activities of the City with
cash incentives.

o Players who are not part of the National Team joining international events
that do not fall under 10699 receive reasonable cash incentive since they
represent the City and the country.

o Free medical during the competition.

o Extend their help to the athlete until she or he will recover.

o Since there are limited categories of Arnis in the Palarong Panlungsod it is


suggested that a separate selection of players and coaches shall be
implemented for Batang Pinoy, Phil. National Games, Phil. Women’s’
Martial Arts and World Martial Arts Festivals and National Arnis
Competition organized by PEICAF.

o The Baguio Learn to Swim is for all ages and there are lady coaches.

PROPOSED SPORTS CODE OF THE CITY

- This is actually the creation of the commission, how does this differ to the
CSPDC?

 The proposed ordinance is actually a proposal of the City Vice-Mayor and


this inquiry will be forwarded to the Vice-Mayor as principal author of the
proposed measure.

 According Hon. Orcales, there were only four existing sports ordinances
in the City of Baguio. These are Incentive Code, Creation of the City
Sports and Promotion Development Council, Fun Run Ordinance and the
Swimming Pool Ordinance. In addition to this, there is also selection
process, accreditation process and the increase of the incentives to the
athletes.

o The participants agreed to include all four sport ordinances and be part of the
sports code ordinance of the City of Baguio.

- Do we need the Baguio Sports Commission?


 There is no need to create this Baguio Sports Commission.
 Section 17, provisions on penalties to be imposed to athletes,
coaches and trainers shall be carried to the sports code ordinance.
 Also include in the penalty provision of the said code, “after
thorough investigation.” An investigative body will investigate all
coaches, trainers and athletes subject to the penalties required.
 All coaches and trainers will have certificate that they undergone
extensive training.
 Equip all the coaches and trainers with necessary training for them
to be able to respond concerning to sports nutrition, sports
rehabilitation and sports medicine.

- Departmentalization of City Sports Office and increase the number of sports


officer in the Sports Office in compliance to the CSC rules. This will be done

especially if the City of Baguio is going into a great performance in terms of
sports.

- Inclusion of fun run ordinance, swimming pool ordinance and changes in the
City Sports and Promotion Council.

- Include support on the trainings and preparation of athletes and their


respective coaches. It should be included in the provision the support and
assistance to be extended to the coaches and athletes while preparing for the
competition.

- Include darts and board games as a recognized sports in the City of Baguio.

- Proposed amendatory ordinance regulating the darts clubs shall be crafted in


order to address the concern of the Darts Federation of the Philippines.

- There shall be a provision in the sports code that Baguio Sports Day be
included in order to give due recognition to past and current Baguio Athletes,
institutionalized and be funded.
- Training allowance given by CARAA to be adopted.

- Promote the City of Baguio not only as greenest city or safest city but also as
sports city, it is also sports tourism.

- It’s better to carry the specific occasion in line with promoting the city sports
tourism such as Panagbenga Sports Tournament, Baguio Day Sports
Tournament, etc.

- Suggestions from the gym owners having their own ID systems that will
suffice the requirements for cash incentives.

- Hon. Orcales encouraged everyone to submit directly in his office their


concerns and suggestion in writing specifically on the recommendations they
wish to include in the proposed sports code ordinance.

DRAFT OF ADMINISTRATIVE ORDER

PRESCRIBING THE COMPOSITION AND FUNCTIONS OF THE BAGUIO CITY SPORTS


DEVELOPMENT COUNCIL
WHEREAS, the City Government recognizes through its 15 point agenda the
importance sports development by empowering the youth by focusing on leadership
skills training, sports and other diverse alternative programs.
WHEREAS, the Ordinance No. 16, series of 2014 requires the creation of City Sports
Promotion and Development Council
WHEREAS, the City of Baguio Sports Promotion and Development Council (CSPDC)
which may be known for brevity as City Sports Council is hereby created composed of
the following:
- City Mayor as Chairperson

The Sports and Recreation Division of the City Administrator’s Office shall serve as the
secretariat of the City Sports Council.
The City Sports Council shall exercise the following functions pursuant to Ordinance
No.
14-2016:

a) Serve as a sports advisory council for the city to meet quarterly and as the need
arises;
b) Recommend the formulation or adoption of sports activities, plans, policies and/or
programs;
c) Meet immediately upon its creation to consider the need of appointing additional
members from sectors that may have to be represented and to adopt its rules of
procedures that will include the regularity and conduct of its meetings and the
designation or tasking of members of certain functions or duties;
d) Conduct local sports summits or consult with sports associations/organizations
and other public and private entities concerned to identify needed sports actions,
activities or programs for the city;
e) Monitor or assist in the implementation of the sports promotion and development
programs and activities; and
f) Perform such other functions it may be further authorized or allowed to undertake.
Section 5. Funding. - The City Sports Council shall be funded from the funds of the
Sports and Recreation Division of the City Administrator’s Office.

o All participants are amenable that the date of meeting will be set quarterly
or as a need arises.

o All participants are amenable to the proposed administrative order.
