AGREEMENT FOR LEAVE AND LICENCE

THIS AGREEMENT FOR LEAVE AND LICENSE is executed on this the ____ day

of September, 2018 (Two Thousand and Eighteen).

BETWEEN

(1)SMT. XXX, wife of Sri XXX, by occupation –House Hold Work, (2) SRI XXX, son of Sri
XXX, by occupation Service, both by faith Hindu, by nationality Indian, are permanently
residing at XXX and presently residing at XXX hereinafter called and referred to as the "THE
FIRST PARTIES / LICENSOR " (Which term shall unless excluded by or repugnant to the
context be deemed to include her heirs, executors, administrators, legal representatives) of the
FIRST PART.

AND

SRI XXX (Aadhar No. 0000000000), son of XXX, aged about 26 years, by faith - Hindu,
by occupation – Service, permanently residing at XXX, herein after called the

LICENSEE (which terms expression shall remain and include his heirs, executors,
administrators, representative and assigns) of the OTHER PART.

WHEREAS the party of the first part is the absolute owner in respect of the Flat/Unit

which is more fully set forth and described in the Schedule “B” herein below.

AND WHEREAS that for a long time the Licensor herein has been thinking to get some

income from such schedule flat and on coming to know such intention of the Licensor, the

Licensee herein directly approached the Licensor to allow him to stay at the schedule flat

against which he shall pay the necessary charges and afterwards there was some discussion

among the parties herein and certain terms and conditions were settled and to avoid

misunderstanding among the parties all such terms and conditions are reduced in writing

herein below : -

a) That the Licensor shall allow the Licensee to occupy the flat mentioned in the Schedule

“B” hereunder written as Licensee.

b) That the monthly License Fee would be Rs. 8000.00 (Rupees Eight Thousand only)

payable within 4th day of every month as per English Calendar Month to the Licensor

and the Licensor shall grant the receipt thereto to the Licensee.

c) The Licensee shall deposit Rs. 8000/- (Rupees Eight Thousand only) and keep

deposited the said amount as security deposit/money advance/money to be advanced for

the due observance and performance of this Agreement with and to the licensor and same

will be returned at the time of evacuating the flat/expiry of this agreement.

d) That the monthly Electricity Bill would be payable every month or mentioned in

electricity bill as per English Calendar to the concern office and the Licensee shall

handover the receipt thereto to the Licensor.

e) That the monthly Maintenance Bill would be payable within 3rd day of every month

as per English Calendar Month to the secretary of the said building/premises and the

Licensee shall handover the receipt thereto to the Licensor or otherwise directed in the

Memorandum of the ‘XXX APARTMENT’.

f) The Licensee shall pay the yearly festival (Durga Puja, Kali Puja etc.) donations time to

time from their own. The Licensee shall pay the maintenance charges for the premises as

and when require.

g) That if the Licensee fails to pay the license fee for a consecutive two months, then the

Licensee shall be defaulter and in that case the Licensee shall have to vacate the premises

without any notice and shall have to hand over the same to the Licensor.

h) That the Licensee shall use the schedule flat for the residential purpose only and for no

other purposes and will be strictly adhere/maintain peace keeping of the norms prescribed

in the said Memorandum.

i) That the Licensee shall not transfer the schedule flat to a third party either full or part

thereof for any purpose.

j) That the Licensee shall undertake the minor repair works with the prior intimation to the

Licensor and the Licensor shall have full right to inspect the schedule flat at any time but

subject to prior intimation to the Licensee.

k) That the Licensee shall get the supply of water through the existing arrangement and no

additional arrangement to be provided.

l) That the Licensee shall maintain the schedule premises inhabitable conditions.

m) That the instant agreement shall remain in force for 11 (Eleven) months with effect

from the month of 1st day of August, 2018 to 30th day of June, 2019.

n) That the license fee shall be increased 10% of expiry of this agreement subject to

satisfaction of the both parties.

o) That if circumstances arise beyond control for any cause of action/any short of reasons,

as soon as the Licensor demands to vacate the schedule flat the Licensee shall be bound to

vacate the same without any hesitation.

p) The licensee hereby agree and covenants with and to the licensor that the licensee under

no circumstances whatsoever transfer or assign in any manner whatsoever benefit of this

present to any other person and accepts and acknowledges that licensor has allowed

licensee to use and occupy the Licensed flat/unit only and in no manner has granted any

right interest in the licensed flat/unit or any right to transfer or heritable right in respect of

the licensed flat/unit.

q) The licensee shall use and occupy the licensed flat/unit for residential purpose only and

in no manner cause nuisance, damage, disturbance, annoyance, inconvenience or

interference to the occupiers of neighboring premises.

r) The licensee shall not use the licensed flat/unit for any illegal or moral purpose or carry

out any activity or do anything, which constitute breach of any law.

s) That the instant arrangement absolutely temporary in nature.

t) That either of the parties have liberty to receive and/or cancel the agreement by giving

one month prior/advance notice.

That if there is any dispute in between the parties herein, the either of the parties herein

shall have liberty to proceed according to the jurisdiction of the schedule premises.

SCHEDULE “A"ABOVE REFERRED TO


{(i.e. the entire property at premises/Holding No, XXX Address}

ALL THAT piece and parcel of land containing by estimation of an area measuring 5
(five) cottahs l (one) Chittak 35 (thirty- five ) sq.ft be the same a little more or less lying
and situate at upon which a partly three storied and a Partly G + 3 storied building named
“XXX APARTMENT” is standing and the said property is butted and bounded as follows
;-

ON THE NORTH : Land of C.S. Dag No.351.


ON THE SOUTH : 8’ ft. Wide Common Passage.
ON THE EAST : Land of Dag Nos. 252 and 253.
ON THE WEST : 12'ft. Wide Common Passage.

THE SCHEDULE "B" REFERRED TO ABOVE


(i .e. the flat owner/ the first parties / licensor
SMT. XXX AND SRI XXX)

ALL THAT piece and parcel of one self-contained Flat measuring more or less 725 Sq.ft.
Built up area being Flat No. G-B. on the Ground Floor, North-East Side , consisting of 2

bed rooms, one kitchen, one dining-cum-drawing, Two toilets along with all fittings ( Fan,
Lights etc.) and fixtures together with undivided proportionate share of land along with
undivided interest in common areas and facilities being the portion of Premises/Holding
No. 000, …….. , and also being the part of the Building named “XXX APARTMENT”
lying and situate at Mouza-Tentulberia , P.S. Sonarpur , within the limits of the Rajpur-
Sonarpur Municipality, Ward No. 6, in the District of 24 Parganas (south).

IN WITNESS WHEREOF the parties hereto put their hands seals on the day month, year
