1. a) “All contracts are agreements and all agreements are not contracts.” Comment.

b) A wanted to buy the steel utensils owned by B. At a dinner party A asks B for the price of the
utensils, saying that he might buy 10 serving bowls and serving spoons. B quotes the price.
Later on, A sent a text message to B saying he would like to buy three serving bowls and five
serving spoons. But because of a typographical error the message got sent as “send the serving
bowls and five serving spoons”. B sent 10 serving bowls and five serving spoons. A returned
five serving bowls.
Discuss the validity of the agreement between A and B.

2. a) Define Bailment & pledge. Also, trace the difference between the two.

b) As T was going out of station, S agrees to look after his opium-cultivation, which was not
allowed in law, and also his business of bakery shop. For this service T promises to give him a
salary of Rs. 8000/- per week. In accordance with the provisions of the Indian Contract Act,
examine the validity of the agreement between S and T.
3. a) What do we mean contract of indemnity and guarantee. Differentiate between the two.

b) Alok has entered into a contract with Mansi for selling his scooter to her. The terms and
conditions of the contract are fixed. Before execution of the contract Alok asks Mansi if she is a
minor, to which she answers in the negative. After gaining possession of the scooter, Alok files
a suit in the court for the money that Mansi owes him. Mansi pleads that she is a minor and
therefore, the agreement is void. Is Mansi entitled to plead her minority? Explain.
