AGREEMENT TO LEASE

THIS AGREEMENT TO LEASE is made and entered into between Ms. B. R.


Niveditha D/o, N. Raguraman, Aadhar no. 883906237992, aged 27 Years
residing at Flat no. 001, Soundarya Links, No. 1, Link Road, Seshadripuram,
Bangalore-560020
(Hereinafter referred to as the ‘LESSOR’)
AND
Mr. Kasu Venkata Phanindra S/o Mr. Ventaka Naga Badram, Aadhar no.
695870387223, aged 21 Years and Mr. Kasu Venkata Nagendra S/o Mr.
Ventaka Naga Badram, Aadhar No. 911176379966, both Students of REVA
University, Bangalore, and both having permanent residence at B-34, Pedda
Vidhi, Machavaram, Ambajipeta, East Godavari, Andhra Pradesh - 533214

(Hereinafter referred to as the ‘LESSEES’)

The terms the ‘LESSOR’ and the ‘LESSEES’ shall mean and include their heirs,
successors, legal representatives, administrators, executors and assigns of the
respective parties. Now this agreement witnessed as follows:

And whereas the ‘LESSOR’ is the absolute owner of the premises bearing the
Flat no. 303, Third Floor, Nation Property Green View Apartment, No. 23, 4 th
Cross, 2nd Main, Muneshwara Nagar, Kattigenahalli, Bangalore - 560063. The
LESSOR is in actual possession and enjoyment of the said property more
particularly described herein under in the schedule and herein be referred as the
scheduled premises. The ‘LESSOR‘ has intended to let out the property.

The ‘LESSEES’, who are in need of such property, approached the ‘LESSOR’.
After mutual consultation between the parties, the ‘LESSOR’ has agreed to let
out and the ‘LESSEES’ have agreed to lease the scheduled premises on
monthly rent basis for a period of 11 (Eleven) Months from the ‘LESSOR’ on
the following terms and conditions into writing .
1. The ‘LESSORS’ has agreed to lease the scheduled premises to the
‘LESSEES’ for a period of 11 (Eleven) Months from 20-08-2018 to 31-
07-2018, on a monthly rent of Rs. 13,000/- (Rupees Thirteen Thousand
Only) which includes towards the rent, furnishing and electrical fixtures
& fittings in the said scheduled premises and the maintenance charges on
actual. The ‘LESSEES’ have agreed to take on lease the scheduled
premises for the above said period subject to payment of the total sum of
Rs. 13,000/- (Rupees Thirteen Thousand Only) and the maintenance
charges per month, payable before 5th of every month.
2. That in addition to the monthly payment reserved, the ‘LESSEES’ shall
also be liable to pay the utility charges like electricity consumption
charges , water charges and other charges regularly which is payable by
the first week of each month to the concerned authorities. The receipts of
the same shall be kept with the ‘LESSEES’ and handed over to the
‘LESSOR’ whenever it is sought.
3. The tenancy month shall be the English calendar month commencing
from the first day of every month and ending with the last day of same
month.
4. All the repairs/breakdowns/maintenances to the
equipments/fittings/electrical/plumbing/sanitation/drainage/premises ahs
to be taken care by the ‘LESSEES’
5. That the ‘LESSEES’ have paid a sum of Rs. 50,000/- (Rupees Fifty
Thousand Only) as a security deposit to the ‘LESSOR’ before this
agreement, which shall be refundable free of interest at the time the
‘LESSEES’ vacating the scheduled premises after deducting the arrears of
rent or any other charges payable by the ‘LESSOR’ if any.
6. That the ‘LESSEES’ shall use the scheduled premises for residential
purposes only
7. That the ‘LESSEES’ shall not sublet the scheduled premises or any part
thereof to anybody or individual without the written consent of the
‘LESSOR’
8. That the ‘LESSEES’ shall not erect any permanent structure or make any
alterations or additions or changes to the scheduled premises without the
written consent of the ‘LESSOR’
9. The ‘LESSEES’ shall not cause any damages to the schedule premises
10.That the ‘LESSEES’ shall be subject to all the rules, regulations and bye-
laws of the local prevailing rules and the Apartment Owners Association
in the enjoyment of the scheduled premises.
11. That the ‘LESSEES’ shall give 3 (THREE) months advance notice to the
‘LESSOR’ if they intend to terminate the agreement before the expiry of
the lease period.
12. That if the ‘LESSEES’ desire to continue the lease period after 11
(Eleven) Months, they shall be at liberty to do so for a further period of 11
(Eleven) Months more subject to all the above conditions and subject to
payment of 10.75% increase in the monthly rent, and be executing a
Addendum to this agreement in that regard.
13. That the monthly rent shall be paid before 5th of every month by the
‘LESSEES’ for the previous tenancy month.
14. That the ‘LESSEES’ shall be liable to maintain the scheduled premises in
clean and neat manner and shall not cause any nuisance or disturbance to
the occupiers of the other premises nearby.
15. That the ‘LESSEES’ at their own cost replace all the spoiled/damaged
bulbs, electrical fittings, appliances, other plumbing and wiring works etc.
during the lease period
16. That the ‘LESSEES’ shall not keep any explosive or combustible articles
in the scheduled premises
17. That the ‘LESSEES’ shall hand over the premise after the tenancy period
in a cleaned / hygienic condition.
18. The ‘LESSOR’ or their representative shall be entitled to enter upon the
premises with prior appointment to inspect the same and satisfy that the
premise is being used in accordance with the terms of tenancy.
19.The ‘LESSOR’ shall pay the property tax, rates and cess of the scheduled
premises to the concerned authorities.
20. The ‘LESSEES’ shall keep the scheduled premises in good condition and
shall not cause or let to suffer and damage thereto. The ‘LESSEES’
whenever needed shall at his cost carry out the necessary routine repairs
of sanitary, plumbing, electrical, carpentry etc. inside the premise. The
‘LESSEES’ shall be liable to reimburse the ‘LESSOR’ any loss or
damage to the structure, fixtures and fittings of the premises, during the
lease period and the same shall be deducted by the ‘LESSOR’ out of the
security deposit paid by the ‘LESSEES’
21. The ‘LESSEES’ shall use and enjoy the premises with most care and
caution without damaging or breaking any of the amenity, accessories,
fittings etc; and in such an event, the ‘LESSEES’ shall make good the loss
to the ‘LESSOR’. The ‘LESSOR’ shall be entitled to deduct such amounts
to make good such damage or loss from out of the security deposit.
22. The ‘LESSEES’ shall arrange for painting of internal walls, ceiling etc.
with Asian Paints or Burger or Nerolac Brand Emulsion Paint prior to
vacating the house.
23. It is hereby agreed that the matter which are not specifically referred to
the above that rises the period of lease shall be settled by mutual
understanding between the parties.
That the ‘LESSOR’ hereby confirms that a sum of Rs. 50,000/- (Rupees Fifty
Thousand Only) has been received as security deposit from the ‘LESSEES’.
SCHEDULE
All that piece and parcel of land and building being Flat No. 303, in Third Floor, in
the building known as “Nation Property Green View”, situated at No. 23, 4 th Cross,
2nd Main, Muneshwara Nagar, Kattigenahalli, Bangalore – 560063 along with 234
Sq. Ft., along with car parking and the flat having a built up area of 890 Square
Feet (inclusive of all common area) and being bounded on the:-
North By : Lobby followed by Flat no. 302
South By : Site no. 26
East By : Site no. 19 and 20
West By : Flat no. 304

FITTINGS
Electrical Fan – 3 Nos., Philips Tubelights – 3 Nos., False Ceiling Lights – Nos.,
False Ceiling Strip Light with Remote – 1 No., Bathroom Lights – 2 Nos., Kitchen
Light – 1 No., Bathroom Fittings, Room Wardrobes, TV Fixtures, Window Screen
Fittings, Kitchen Shelves and storage spaces
