The following notification will be published in the Tamilnadu Government


Gazette.

NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 of the


Constitution of India, the Governor of Tamilnadu hereby makes the following rules:
The rules hereby made shall be deemed to have come into force on the
dates noted against each post.
From

1. Godown Superintendent 17.11.64

RULES

The General and the Special Rules applicable to the holders of the
permanent posts in the Tamilnadu Ministerial Service shall apply to the following
temporary posts sanctioned from time to time for the Civil Supplies Department
subject to the modifications specified in the following rules:

1. Godown Superintendent

2. Circle Officer

3. Assistant Rationing Officer

4. Assistant City Supply Officer

5. Supervisors

6. Office Manager

7. Senior Superintendent

8. P.A. to Assistant Commissioner(CS)

2. CONSTITUTION:

The posts shall each constitute a distinct category in the said service.

3. APPOINTMENT:

Appointment to the posts shall be made as follows:

i) By promotion from among the holders of the post of ordinary grade


Superintendent in the Civil Supplies and Consumer Protection Department or

ii) By recruitment by transfer from category of Deputy Tahsildars from the


Tamilnadu Revenue Subordinate Service if no suitable candidate is available for
promotion in Civil Supplies and Consumer Protection Department.

4. APPOINTING AUTHORITY:

The Appointing Authority for the post shall be Joint Commissioner of Civil
Supplies.

5. QUALIFICATION:
No person shall be eligible for appointment to these posts unless he has
completed two years of service as Ordinary Grade Superintendent in the Office of
the Commissioner of Civil Supplies or is an approved probationer in the category
of Deputy Tahsildar.

6.PAY:

There shall be paid to the holder of the posts mentioned in rule 1 a monthly
pay calculated in the following scale of pay:

From 17.11.64 to 1.10.70 In the Scale of Pay of Rs.250-15-400


From 2.10.70 onwards In the scale of Pay of Rs.425-25-700

7. SAVING:

Nothing contained in these rules shall adversely affect any person


appointed to any of the posts specified in rules 1 prior to the date of the publication
of these rules in the Tamilnadu Government Gazette.

ORDER:

The following notification will be published in the Tamil nadu Government


Gazette.
NOTIFICATION

In exercise of the powers conferred by the proviso to Article 309 of the


Constitution of India, the governor of Tamilnadu hereby makes the following rules:-

The rules hereby made shall be deemed to have come into froce on the 1st
December 1956.

RULES

The General Rules applicable to the holders of the permanent posts in the
Tamilnadu General Subordinate Service shall apply to the temporary posts of
Drivers, sanctioned from time to time for the Civil Supplies Department subject to
the modifications specified in the following rules:-

2. CONSTITUTION:
The post shall constitute a distinct class in the said service

3. APPOINTMENT:
Appointment to the posts shall be made by direct recruitment or by transfer
from any other class or by recruitment by transfer from any other service.

4. APPOINTING AUTHORITY: The appointing authority for the post shall be


the Assistant Secretary (Establishment) in the office of the Commissioner of Civil
Supplies and Consumer Protection

5.QUALIFICATION: No person shall be eligible for appointment to the post


unless he possesses the following qualifications specified below:-

a.Must not complete the age of 30 years if recruited direct.


b.Must possess a certificate of competency as driver issued by a competent au-
thority under the Government of Tamil Nadu.

6. PROBATION: Every person appointed to the post shall from the date of
which he joins duty, be on probation for a total period of 2 years on duty within a
continuous period of 3 years.

7. PAY: There shall be paid to the holders of the posts a monthly pay
calculated in the following scale of pay:

From 1.12.1956 to 31.5.1960 Rs.30-1-45


From 1.6.1960 to 1.10.1970 Rs.70-1-80
From 2.10.1970 onwards Rs.150-4-170-5-225

8. SAVING: Nothing contained in these rules shall adversely affect any


persons appointed to the post prior to the date of publication of these rules in the
Tamilnadu Government Gazette.

The following notification will be published in the Tamil Nadu Government

NOTIFICATION

In exercise of the powers conferred by the provision to Article 309 of the


Constitution of India, the Governor of Tamil Nadu hereby makes the following
amendments to the special rules for the Tamil Nadu General Service (Section 16
in Volume II of the Tamil Nadu Services Manual, 1969)

The amendments hereby made shall be deemed to have come into force on
the 17th March, 1969 so far as the category of Assistant Secretary to
Commissioner of Civil Supplies in concerned. So far as the category of Deputy
Commissioner of Civil Supplies is concerned, the amendments shall be deemed to
have come into force on the 2nd March, 1978.

AMENDMENTS

In the said Special Rules,

(i) in Part.I, after the entries relating to Class LXIV the following Class and
entries shall be added, namely:-

"Class LXV Deputy Commissioner of Civil Supplies, Civil Supplies


Department;

Assistant Secretary to the Commissioner of Civil Supplies, Civil Supplies


Department"

(ii) in Part II after the entries relating to Class LXIV the following Class and
entries shall be added.

"Class LXV Deputy Commissioner of Civil Supplies, Civil Supplies


Department;

Assistant Secretary to the Commissioner of Civil Supplies, Civil Supplies


Department"

2. Constitution:- This class shall consist of the following categories of officers


namely:-

Category (1) - Deputy Commissioner of Civil Supplies

Category (2) - Assistant Secretary to the Commissioner of


Civil Supplies

3. Appointments:- Appointment to the two categories shall be made as follows:-

Supplies or

(2) Recruitment by transfer from the Tamil

Recruitment by transfer of the post of
Personal Assistant to the Civil Supplies;

4. Qualification: (a) Age: No person shall be eligible for appointment
to the category of Assistant Secretary to the
Commissioner of Civil Supplies if he has
completed 55 years of age and to the
category of Deputy Commissioner of Civil
Supplies if he has completed 57 years of age
on the first day of July of the year in which
the selection for appoint is made.

(b) Other qualifications: No person shall be eligible for promotion


to the category of Deputy Commissioner
of Civil Supplies unless he has put in a
service of not less than six years as
Assistant Commissioner of Civil Supplies
or Assistant Secretary to the
Commissioner of Civil Supplies

(2) No person shall be eligible for promotion


or for recruitment by transfer from the
Tamil Nadu Ministerial Service to the
category of Assistant Secretary to the
Commissioner of Civil Supplies unless he
has put in a service of not less than five
years as Selection Grade Superintendent or
Personal Assistant to the Assistant
Commissioner of Civil Supplies.
Explanation:
For the purpose of computation of the service, the services of a Selection
Grade Superintendent rendered previously as Personal Assistant to the Assistant
Commissioner of Civil Supplies and / or Senior Superintendent in the office of the
Commissioner of Civil Supplies will also be reckoned with.

5. Probation:-
Every person appointed to either of the categories in the class shall, from

the date on which he joins duty be on probation for a total period of two years on
duty within a period of 3 years.

Provided that rules 4 and 5 shall not apply in the case of Deputy Collectors
and District Revenue Officers belonging to the Tamil Nadu Civil Service/

6. Preparation of annual list of approved candidates:

For the purpose of drawing up of the annual list of approved candidates for
appointment to the posts in the class by promotion or recruitment by transfer, the
crucial date on which the candidates should be qualified shall be the first
September of every year.

Amendments to Special rules for Tamil Nadu General Service
(G.O.Ms. No. 692, Food and Co.operation 15th December 1980)

No. SRO B-625/80. In exercise of the power conferred by the proviso to


article 309 of the constitution of India the Governor of Tamil Nadu hereby makes
the following amendments to the special rules for the Tamilnadu General Service
(Section 16 in Volume II of the Tamil Nadu Service Manual, 1969).

The amendments hereby made shall be deemed to have come into force on
the 17th March 1969, so far as the category of Assistant Secretary to
Commissioner of Civil Supplies and Consumer Protection is concerned. So far as
the category of Deputy Commissioner of Civil Supplies is concerned the
amendments shall be deemed to have come into force on the 2nd March 1978.
AMENDMENTS
In the said special rules:
(i) In part I, after the entries relating to class LXIV the following Class and
entries shall be added namely;
“Class LXV Deputy Commissioner of Civil Supplies, Civil Supplies and Consumer
Protection Department.

Protection Department'.

Commissioner of Civil Supplies”.
2. Constitution: This Class shall consist of the following categories of Officers

Commissioner of Civil Supplies / holders of the post of Superintendent / P.A to
*Assistant Commissioner of Civil Assistant Commissioner of Civil Supplies in the
Supplies Civil Supplies Department.
*2. Recruitment by transfer from the Tamil
Nadu Civil Service the ratio for the appointment
from the above category shall be 2:1.

(4) QUALIFICATION :(A) Age: No Person shall be eligible for appointment to the
category of Assistant Secretary to the Commissioner of Civil Supplies / * Assistant
Commissioner of Civil Supplies and to the category of Deputy Commissioner of
Civil Supplies if he has completed *** 57 years of age on the first day of July of the
year in which the selection for appointment is made.
(b) Other Qualification:
**(1) No person shall be eligible for promotion to the category of Deputy
Commissioner of Civil Supplies unless he has put in a service of not less than six
years as Assistant Commissioner of Civil Supplies/ Assistant Commissioner of
Civil Supplies (Inspection) or Assistant Secretary to the Commissioner of Civil
Supplies and Consumer Protection.

(2) No person shall be eligible for recruitment by transfer to th category of


Assistant Secretary to the Commissioner of Civil Supplies and Consumer
Protection / Assistant Commissioner of Civil Supplies unless he has a put in a
service of not less than five years as Superintendent or Personal Assistant
Commissioner of Civil Supplies or in both.
(3) No person shall be eligible for promotion to the category of Assistant Secretary
to the Commissioner of Civil Supplies and Consumer Protection / Assistant
Commissioner of Civil Supplies unless he has passed the Account Test for
subordinate Officers , Part – I.

Explanation : For the purpose of computation of the service, the service of a
Selection Grade Superintendent rendered previously as Personal Assistant to the
Assistant Commissioner of Civil Supplies and / or Senior Superintendent in the
Office of the Commissioner of Civil Supplies and Consumer Protection will also be
reckoned with”.

2. The Rules hereby made shall be deemed to have come into force on the
1st April 1980.
RULES:
The General Rules applicable to the holders of the permanent posts in
Tamil Nadu General service shall apply to the holders of the temporary. post of
the Assistant Commissioner of Civil Supplies (Inspection)sanctioned from time to
time for the Civil Supplies and Consumer Protection Department subject to the
modifications specified in the following rules.
2. CONSTITUTUION:
The post shall constitute a distinct class in the said service.
3. APPOINTMENT:
Appointment to the post shall be made.
1. By Direct recruitment or
2. By recruitment by transfer from the category of Technical Assistant in the
Office of the Commissioner of Civil Supplies and Consumer Protection.

4. QUALIFICATION: (A) Age: - No person shall be eligible for appointment to the


post by direct recruitment, if he has complected or will complete 30 years of age on
the first day of July of the year in which the selection for appointment is made.

Provided that the age limit may be relaxed up to 40 years in respect of


persons who have 2 years previous experience in Roller Flour Milling Industry.

(B) Other Qualifications: No person shall be eligible for appointment to


the post by the method specified in column (1) of the Table below unless the
possesses the qualification specified in the corresponding entries in column (2)
thereof:

(2) Recruitment by Transfer Must have completed eight years of service as


Technical Assistant.

5. PROBATION : Every Person Appointed to the post of Direct recruitment shall


from the date on which he joins duty be on probation for a total period of two years
on duty within a continuous period of three years. Provided that in the case of
those appointed by recruitment by transfer the period of probation shall be one
year on duty within a continuous period of two years.

6. PAY: There shall be paid to the holders of post a monthly pay calculated in
the scale of Rs. 750-50-1350.

7. SAVINGS: Nothing contained in these rules shall adversely affect any person

appointed to the post specified in the rules prior to the date of publication of these
rules in the Tamil Nadu Government Gazette.
NOTIFICATION . II

1. The post of *JUNIOR Technical Assistant in the Civil Supplies and


Consumer Protection Department will be brought within the purview of the
Tamil Nadu Public Service Commission and classed as “Non -Technical “
and included in Group II Service for the purpose of Direct Recruitment .
Amendment to the Tamil Nadu Public Service Commission regulation will be
issued separately from Personnel and Administrative Reforms (per. M)
Department.
2. In exercise of the powers conferred by the provision to Article 309 of the
Constitution of India, the Governor of Tamil Nadu hereby makes the
following rules.

3. The rules hereby made shall be deemed to have come into force on the 1st
April 1980.

RULES:
The General Rules applicable to the holders of the permanent post in
the Tamilnadu General Subordinate Service shall apply to the holders of the
temporary post of ** Technical Supervisor Technical Assistant and * Junior
Technical Assistant sanctioned from time to time for the Civil Supplies and
Consumer Protection Department subject to the modifications specified under the
following rules.

2. CONSTITUTION : The post shall each constitute a separate category in a


distinct class in the said service
3. APPOINTMENT : Appointment to the post specified in column (1) below shall
be made by the methods specified in the corresponding entries in Column (2)
thereof.

ORDER:
In the circumstances stated by the Special Commissioner and
Commissioner of Civil Supplies and Consumer Protection in the letters read above
and in order to provide better promotional avenues to the staff of the Civil
Supplies and Consumer Protection Department, which is confined only to the City
and belt areas, the Government pass the following orders:-

i) The post of Deputy Commissioner of Civil Supplies shall be filled up from the
District Revenue Officer only if qualified and suitable departmental personnel are
not available for promotion, without fixing any ratio.

ii) The posts of Assistant Commissioner of Civil Supplies and Assistant Secretary
to Commissioner of Civil Supplies and Consumer Protection shall be filled up from
the departmental candidates and Deputy Collectors in the Tamil Nadu Civil Service
in the ratio of 2: 1 respectively.

iii) Service qualification for Assistant Commissioner of Civil Supplies and Assistant
Secretary to Commissioner of Civil Supplies and Consumer Protection for

promotion as Deputy Commissioner shall be reduced from 6 years to 2 years.

iv) Service qualification for Personal Assistant to Assistant Commissioner of Civil


Supplies for promotion as Assistant Commissioner/Assistant Secretary shall be
reduced from five years to two years.

v) The post of Assistant Secretary to Commissioner of Civil Supplies and


Consumer Protection shall be re-designated as “Assistant Commissioner” and the
post of Personal Assistant to Assistant Commissioner as “Administrative Officer”.

2. The Special Commissioner and Commissioner of Civil Supplies and Consumer


Protection is requested to send necessary proposal for amending the relevant
service rules to the Government for approval.

ORDER:
The Government in their orders second to fifth read above issued
orders framing adhoc rules for the posts of Assistant Commissioner (Inspection),
Technical Supervisor, Technical Assistant and Assistant Technical Assistant in the
office of the Commissioner of Civil Supplies and Consumer Protection. One of the
qualifications prescribed in the adhoc rules for appointment to the post of
Technical Assistant by promotion is possessing a Certificate of diploma in “Flour
Milling Technology”.

2) The Commissioner of Civil Supplies and Consumer Protection has stated


that the Government of India rescinded the Wheat roller Flour Mills (Licensing and
Control) Order , 1967, in October 1986. As the training course of “Flour Milling
Technology” conducted by Central Food Technology Research Institute, Mysore is

very expensive , the Commissioner of Civil Supplies and Consumer Protection has
suggested to substitute the training course by 'Storage and Inspection of
Foodgrains'. conducted by the Indian Grain Storage Institute at Hapur, Uttar
Pradesh or its field Station at Hyderabad as a qualification in the place of training
course on 'Flour Milling Technology ' for Technical Assistants and Junior Technical
Assistants. The Commissioner of Civil Supplies and consumer Protection has also
proposed the method of direct recruitment of candidate for the post of Technical
Assistant with the qualification of M.Sc.Degree in chemistry/zoology/Botany as
main subject , prescription of probation of two years on duty within a continuous
period of three years for the direct recruitment to the post of Technical Assistant,
and reduction of service qualification from five years to three years for Technical
Assistants for promotion as Technical Supervisor.

3. The Government after careful examination have decided to accpt the proposal
of the Commissioner of Civil Supplies and Consumer Protection except the
qualification of M.Sc. Degree in Chemistry / Zoology/Botany as main subject. The
Government consider B.Sc. Degree in the above discipline would be adequate.

4. The Public Service Commission was consulted in the matter and it has
suggested to bring the post of Technical Assistant under its purview in view of the
scale of pay of the post etc. and to classify the post as 'Technical' . It has also
suggested to raise the age limit from 28 to 30 years for the direct recruits to the
post of 'Technical Assistant and Assistant Technical Assistants. Accordingly, the
following Notifications will be published in the Tamil Nadu Government Gazette.:-

In exercise of the powers conferred by the proviso to Article 309 of the

amendments to the rules published with Food and Co.operation, Notification SRO
No. 271/81 dated the 3rd June 1981 at pages 292-293 of Part III – section 1(b) of
the Tamil Nadu Government Gazette, dated the 24th June 1981 as subsequently
amended.'
2. The amendments hereby made shall come into force on the In exercise of
the powers conferred by the proviso to Article 309 of the Constitution of India, the
Governor of Tamil Nadu hereby makes the following amendments to the rules
published with Food and Cooperation, Notification SRO No. 271/81 dated the 3rd

Government Gazette, dated the 24th June 1981 as subsequently amended.'

2. The amendments hereby made shall deemed to have come into force on the
29th September 1988.

AMENDMENT
1) In the said Rules, in rule 5, in sub – rule (b) in the Table, the entries .
“Must have obtained a certificate or diploma in Flour Milling Technology ' in item
(2) in Column (2) against, the entry Technical Assistant in Column (1) thereof, shall
be omitted.
NOTIFICATION- II
In exercise of the powers conferred by the proviso to Article 309 of the
Constitution of India, the Governor of Tamil Nadu hereby makes the following
amendments to the rules published with Food and Co.operation, Notification SRO
No. 271/81 dated the 3rd June 1981 at pages 292-293 of Part III – section 1(b) of
the Tamil Nadu Government Gazette, dated the 24th June 1981 as subsequently
amended.'
2. The amendments hereby made shall come into force on the 7th May 2002.

AMENDMENTS
1. In the said Rules, in rule 3, for the entries in column (2), against the entry'2
Technical Assistant in column (1) thereof, the following entries shall be substituted
namely:
i) By direct recruitment , or
ii) By promotion from the post of Junior Technical Assistant'
2. in rule 5 --
(1) in sub – rule (a), for the expression '28 years of age ' the expression 'the age of
30 years' shall be substituted:
(2) in sub – rule (b) in the Table, for the entries, “I Technical Supervisor” and “2
Technical Assistant ' in column (2) thereof, the following entries shall , respectively,
be substituted namely: -

1.Technical Must have completed three years of services as Technical


Assistant.
Supervisor

2. Technical i) Must possess a degree in Science with Chemistry , Zoology or


Botany as main subject for appointment by direct recruitment.
Assistant
ii) Must have completed five years of service as Junior
Technical Assistant for appointment by Promotion'.

3. for rule 6, the following rules shall be substituted:
Probation:

(a) Every person appointed to the posts of Technical Assistant and Junior
Technical Assistant by direct recruitment, shall from the date on which he joins
duty, be on probation for a total period of two years on duty within a continuous
period of three years.

(b) Every person appointed to the posts of Junior Technical Assistant by


recruitment by transfer from the category of Assistant in the Civil Supplies and
Consumer Protection Department shall from the date on which, he joins duty , be
on probation , for a total period of one year on duty within a continuous period of
two years.

6A TRAINING:
Every person appointed to the post of Technical Assistant by direct recruitment
and to the post of Junior Technical Assistant by direct recruitment or by
recruitment by transfer, shall complete the long term training course in “Storage
and Inspection of Food grains' imparted by the Indian Grain Storage Institute at
Hapur, Uttarpradesh or at its field station at Hyderabad the period of Probation'
6B – Preparation of annual list of approved candidates:
i. For the purpose of preparation of the annual list of approved candidates for
appointment to the posts of Technical Supervisor and Technical Assistant,
by promotion, the crucial date on which a candidate shall possess the
prescribed qualification shall be the first September of every year.
ii. For the purpose of preparation of the annual list of approved candidates for
appointment to the post of Junior Technical Assistant by recruitment by
transfer, the crucial date on which the candidates shall possess the
prescribed qualification shall be the first September of every year '.

I am directed to state that Thiru R. Balakrishnan and Thiru
P.V.Sankanarayanan, Superintendents Office of the Commissioner of Civil
Supplies and Consumer Protection who have completed 2 years Tahsildar training
have requested for exemption from the Taluk Supply Officer training for promotion
as Administrative Officer in Civil Supplies and Consumer Protection Department.
The Commissioner of Civil Supplies and Consumer Protection has rejected the
representations of Thiru R. Balakrishnan and Thiru
P.V.Sankaranarayanan Superintendents in the proceedings dated 21.11.2003
stating that the exemption from Taluk Supply Officer training cannot be given since
the Taluk Supply Officer training is the pre-requisite qualification for further
promotion as per the orders of the Government.

2. Thiru R. Balakrishnan and Thiiru P.V. Sankaranarayanan made an


appeal to the Government against the above said order.

3. In this connection I wish to point out that even though the training as
Taluk Supply Officer for a period of one year is prescribed as a pre-requisite
qualification for promotion to the post of Administrative Officer in the executive

order the Adhoc rules have not yet been amended to that effect. In the Writ
Petition filed by Thiru P.S. Venkataraman - vs - the Government in Writ Petition
No.32491/2002 and in Writ Miscellaneous Petition No.47227/2002 and Writ
Miscellaneous Petition No.1457/2002 of the High Court of Madras it has been
clearly spelt out that panels for a post, should be prepared with reference to
statutory rules and not with reference to executive orders. In view of this, the
Panel of the post of Administrative Officer should be prepared with reference to
Statutory rules. Hence the question of equating the Tahsildar Training with that of
Taluk Supply Officer training or granting exemption from undergoing the Taluk
Supply Officer training for promotion to Administrative Officer does not arise.

4. In view of the above position, after careful examination the Government


have decided to allow the appeal petitions of Thiru R. Balakrishnan and Thiru
P.V.Sankaranarayanan Superintendents, Office of the Commissioner of Civil
Supplies and Consumer Protection and accordingly Commissioner of Civil
Supplies and Consumer Protection is directed to take necessary action to promote
Thiru R. Balakrishnan and Thiru P.V. Sankaranarayanan Superintendents as
Administrative Officer in their turn without insisting for Taluk Supply Officer training,
if they are otherwise eligible for such promotion.

NOTIFICATION

In exercise of the powers conerred by sub-section (2) of section 30 of the


Consumer Protection Act, 1986 (Central Act 68 of 1986), the Governor of Tamil
Nadu hereby makes te following amendments to the Tamil Nadu Consumer
Protection Rules, 1988:-

AMENDMENTS

In the said Rules-

1. In rule 2-
(1) after clause (c), the following clause shall be inserted, namely:-

"(cc)'District Council' means the District Consumer Protection Council established


for a district under sub-section (1) of section 8A of the Act."

(2) after clause(i), the following clause shall be inserted, namely:-

"(ii)"State Council" means the Consumer Protection Council for the State of Tamil
Nadu established under sub-section (1) of section 7 of the Act."

2 after rule 9, the following rules shall be added, namely:-

"10.Composition of official and non-official members of the State Council under


clause (b) of sub-section (2)of Section 7,-

(1) The State Council shall consist of the following official members and non official
members under clause (b) of sub-section (2) of section 7, namely:-

(2) The term of office of the non-official members of the State Council shall

(3) A non-official member of the State Council may, by writing under his
hand and addressed to the Chairman of the State Council, resign from his
membership in the State Council. Any vacancy in the case of non-official member
caused by resignation or otherwise, shall be filled, from the persons belonging to
the same interest to which the member belonged, by the Government of Tamil

Nadu and such person shall hold office so long as the member whose place he fills
would have held office.

(4) The Government of Tamil Nadu may, after giving reasonable


opportunity, remove any non-official member of the State Council at any time. The
vacancy so caused shall be filed in as indicated in sub-rule(3).

11. Procedure for meeting of the State Council:-

The State Council shall observe the following procedure in regard to the
transaction of its business, namely:-

1. The meeting of the State Council shall be presided over by the Chairman in
the absence of the Chairman, the State Council shall elect a member from
among themselves to preside over that meeting of the Council.

2. Every meeting of the State Council shall be called by giving notice of not
less than ten days in writing to every member.

3. Every notice of a meeting of the State Council shall specify the place, date
and hour of the meeting and shall contain the statement of business to be
transacted thereat.

4. No proceedings of the State Council shall be invalid merely by reason of


existence of any vacancy in or any defect in the establishment of the
Council.

5. The State Council may require the presence of any officer of the
Government of Tamil Nadu or the Central Government at its meeting as
special invitee on any subject of importance to consumers.
12. Allowances to Members to attend meeting of the State Council:-

The State Consumer Protection Council is classified as First Class


Committee. The non-official members of the Committee are permitted to avail the
Daily Allowances/Travelling Allowance for attending the meeting as per the orders
issued by the Government in Finance Department then and there. The Members
of Parliament and the Members of Legislative Assembly are eligible to draw the

Daily Allowance/Travelling Allowance admissible to them as per the orders issued
by the Loksabha Secretariat and the Tamil Nadu Legislative Assembly Secretariat
for attenting the Council meetings.

(2) The term of office of the non-official members of the District Council shall
be for a period of three years.

(3) A non-official member of the District Council may, by writing under his
hand and addressed to the Chairman of the District Council , resign from his
membership in the District Council. Any vacancy in the case of non-official
members caused by resignation or otherwise, shall be filled from the persons
belonging to the same interests to which the member belonged and such person
shall hold office so long as the member whose place he fills would have held
office.

(4) The Government of Tamil Nadu may, after giving reasonable


opportunity, remove any non-official member of the District Council at any time.
The vacancy so created shall be filled in as indicated in sub-rule (3).
14. Procedure for meeting of the District Council:-

The District Council shall observe the following procedure in regard to the
transaction of its business, namely-

ORDER:
In the Government Order first read above orders have been issued to
constitute the District Consumer Protection council under the Consumer Protection
Act, 1986 (Central Act 68 of 1986) to discuss all matters relating to Consumer
Protection and Public Distribution System and suggest appropriate measures for
improving the system and in the Government Orders second read above , the
State Consumer Protection Council has been established under the Consumer
Protection Act, 1986 (Central Act 68 of 1986) with effect from 5.11.1993 and
22.5.2002 respectively. In his letter 3rd read above, the Commissioner of Civil
Supplies and Consumer Protection has sent proposals to the Government for
reconstitution of the State and District Consumer Protection Council.

2. The Government hereby order the reconstitution of the State


Consumer Protection Council consisting of official and non-official members with
Hon'ble Minister for Cooperation Food and Consumer Protection as its Chairman
and Secretary to Government, Cooperation, Food and Consumer Protection
Department as its Member Secretary and the same to reconstitute the District
Consumer Protection Council consisting of official and non-official members with

concerned District Collector as its Chairman.

3. The tenure of the State and District Consumer Protection Council and
District Consumer Protection Council shall be three years on and from the date of
notifying in the Tamil Nadu Government Gazette and it shall meet not less than
twice in a year at such time and place as the Chairman may decide. The object of
the Council is to promote and protect the rights of the consumers laid down in
clauses (a) to (f) of sections 6 of the Consumer Protection Act 1986 within the
State and within the District.

4. The Government direct that the State Consumer Protection Council


reconstituted in para 2 above shall be a First Class Committee and the District
Consumer Protection Council shall be a Second Class committee for the purpose
of drawal of Travelling Allowance and Daily Allowance to the non – official
members. The Travelling allowance bills of non -official members shall be paid
from out of the State funds the commissioner of Civil Supplies and Consumer
Protection is hereby authorized to draw an amount of Rs. 10,000/-(Rupees Ten
thousand only) as advance and make payment to non -official members in cash on
the day of meeting itself and to adjust the amount by presenting necessary
adjustment Travelling allowance bills after the meeting is over. the Government,
further delegate the above powers to draw and disburse the amount of Daily
Allowance and Travelling allowance to non – official members of the State
Consumer Protection Council to the Commissioner of Civil Supplies and consumer
Protection, Chennai – 600 005 . The District Collectors are authorized to draw and
disburse the Travelling Allowance and Daily Allowance of the non -official
members of the District Consumer Protection Council.

6. The Notification I and II appended to this order shall be published in English in


the Tamil Nadu Government Gazette and in Tamil in all the District Gazettes. The
Malayalam version will also be published in the District Gazettes of Kanyakumari,
Tirunelveli and the Nilgiris Districts. Six copies of the Notifications are sent to the
Tamil Development, Religious Endowments and Information (Translation)
Department. That Department is requested to forward immediately the Tamil
and Malayalam version of the Notifications to the Works Manager, Government
Central Press, Chennai – 79 who is requested to arrange for the immediate
publication the District Gazette concerned.
