FACTS OF THE CASE:

On May 25, 2017, on or around 5:33 in the afternoon, the victim, Armando Serviento,
was driving along McArthur Highway, Tarlac City, Tarlac when the car driven by one Vicencio
Guerrero, legal age, single and resident of Brgy. Cut-cut II, Capas, Tarlac hit the rear of the
victim’s car causing the latter to be thrown away from his seat through the windshield resulting
in several broken ribs, a fractured skull and numerous facial injuries.

Vicencio Guerrero was using his cellphone while driving and was snatched out from
his hand by one who bypassed him. He was chasing the rider of the motorcycle when his car
collided with the car of Armando Serviento.

The incident also caused the total wreck of vehicle 1 rendering the same of no further
use. Further, driver of vehicle 1 was immediately brought to NYP Multi-Specialty Hospital.
