COURT FOR LEAVE TO EFFECT EXTRATERRITORIAL
SERVICE OF SUMMONS UPON NON-RESIDENT
DEFENDANT MARIBETH DEIPARINE MELGAR

I, DANILO LLANOS DEIPARINE, of legal age, Filipino, married with

present residence and postal address at Barangay Sabang, Sibonga,
Cebu, after having been duly sworn to, in accordance with law, do
hereby depose and state – THAT:

1. I am the plaintiff in a civil case, docketed as Civil Case No. AV-

1971, entitled “Danilo Llanos Deiparine versus Alberto Turado
Deiparine, et al., for Judicial Partition, Accounting and Damages”, filed
with and raffled at the Regional Trial Court, 7th Judicial Region, Branch
93, Argao, Cebu.

2. I seek leave of this Honorable Court that Summons be issued

and served upon non-resident defendant MARIBETH DEIPARINE
MELGAR, in the above-entitled case, through extraterritorial service,
pursuant to Section 15, Rule 14, in relation to Section 17, Rule 14 of the
1997 Rules of Civil Procedure, and for this purpose, I had filed
before the above-named Court the corresponding “MOTION FOR
EXTRATERRITORIAL SERVICE OF SUMMONS UPON DEFENDANT
MARIBETH DEIPARINE MELGAR WITH LEAVE OF COURT dated
September 19, 2019, for reasons stated therein.

3. Afte due notice and hearing of the aforementioned motion, I

undertake to provide the required fees or payments to cover the
costs for such extra-territorial service of summons upon non-resident
defendant MARIBETH DEIPARINE MELGAR who is said to have been
residing at present in Canada.
