AGREEMENT TO SELL

This Agreement to Sell is made and executed at New Delhi, on this __ Day of January, 2020, by
Mohd. Kausar Ali, S/o Mr. Mohd. Naimuddin Ansari & Mrs. Wajdah Tabassum, W/o Mr.
Mohd. Kausar Ali, both R/o R-293, Third Floor, Lane No. 2, Near Qadri Masjid , Joga Bai Extn,..,
Jamia Nagar, Okhla, New Delhi-110025 hereafter called the “FIRST PARTY / VENDOR OF THE
ONE PART and which expression shall mean and include his legal heirs, assigns, agents,
successors, survivors administrators, attorneys etc

IN FAVOUR OF

Mr. Irshad Ahmad, S/o Mr. Wasi Ahmad R/o 786/A, Ground Floor, Gali No. 7, Zakir Nagar ,
Okhla, New Delhi-110025& Naseem Ara D/o Ali Mirza Beg R/o 1293, Gali Pahari Imli, Choori
Walan, Delhi-110006, hereinafter called “THE VENDEE” of the other part) which expression shall
mean and include his legal heirs, assigns, agents successors, survivors administrators, attorneys
etc.

AND WHEREAS the vendor is the lawful owner and in possession of THIRD FLOOR FLAT , FRONT
SIDE, MEASURING AREA 65 SQ. YDS., CONSISTING OF THREE BED ROOMS, ONE LOBBY, ONE
KITCHEN, ONE TOILET & BATHROOM, ONE BALCONY WITH ONE TWO-WHEELER PARKING AT

GROUND FLOOR, PART OF KHASRA NO. 225,226, OF PROPERTY BEARING NO. R-293, SITUATED
AT GALI NO. 2, NEAR QADRI MASJID , JOGA BAI EXTENTION., JAMIA NAGAR, OKHLA, NEW DELHI-
110025.

AND WHEREAS the Vendor due to his bonafide needs and requirement, has agreed to sell
transfer and convey his rights, interests and titles etc. in respect of THIRD FLOOR FLAT , FRONT
SIDE, MEASURING AREA 65 SQ. YDS., CONSISTING OF THREE BED ROOMS, ONE LOBBY, ONE
KITCHEN, ONE TOILET & BATHROOM, ONE BALCONY WITH ONE TWO-WHEELER PARKING AT
GROUND FLOOR, PART OF KHASRA NO. 225,226, OF PROPERTY BEARING NO. R-293, SITUATED
AT GALI NO. 2, NEAR QADRI MASJID , JOGA BAI EXTENTION., JAMIA NAGAR, OKHLA, NEW DELHI-
110025 unto the second party and the second party has also agreed to purchase the same for a
sum of Rs. 19,00,551/-(Rupees Nineteen Lacs Five Hundred Fifty One Only) which is bounded as
under:

(Herein after shall be referred to as Said property).

AND WHEREAS the Vendor has assured that the said property is free from all

encumbrances, liens, charges etc. and agreed to sell the said property to the second party on
following terms and conditions: NOW THIS AGREEMENT WITNESSETH AS UNDER:

1. That in pursuance of this agreement to sell in consideration of a total sum of Rs. 19,00,551/-
(Rupees Nineteen Lacs Five Hundred Fifty One Only) the vendor has agreed to sell, transfer,
dispose off and alienated the said property (Fully described herein above) to the vendee and the
consideration amount has been received by the vendor from the vendee and the receipt of
which the vendor has admitted and acknowledge under a separate legal receipt.

2. That the vendor has given the vacant physical possession of the said property and the rights
and privileges, easements and appurtenance attached thereto unto the vendee on the spot.

3. That the vendor has assured the vendee that the said property is free from all sort of
encumbrances i.e., prior sale, mortgage, court injunction, attachment, disputes, gifts, will,
exchanges, etc. and the vendor shall be liable and responsible for the same and hereby
indemnifies the vendee or the losses which may be suffered, incurred, undergone, and / or
sustained by the vendee as result thereof.

4. That the vendor shall not have any right, interest or lien in the said property,

henceforth. The Vendee shall be its sole owner for all intents and purpose and the Vendee only
shall be liable and responsible for all dues and demands in respect thereof from the date of the
execution of the present agreement. However if any dues respect of the said property are found
outstanding prior to the execution of the present agreement the same shall be born and paid by
the vendor.

5. It is hereby specifically agreed that the vendor shall execute, sign and deliver all document in
all times to come which might be required by the vendee for getting the water/ sewer
connections in installed in the said property in his/her own name or in the name of his nominee
and shall not claim any further consideration thereof.

6. That the vendor shall apply for and get the permission for the sale/ transfer of the said
property in favour of the vendee or his/her nominee and execute proper deed(s) for conveying
the same in favour of the vendee or his/her nominee within one month from the date of grant
of the sale permission and get the same registered in the office of the Sub-Registrar, New Delhi.

7. That all the expenses on transfer of the said property including cost of stamp duty, court fee,
transfer duty etc. shall be borne and paid by the Vendee. That it is specially agree between the
parties hereto, that all the expenses on the transfer of the said property i.e. Municipal
Corporation Taxes, Stamp Duty, Court Fee, Registration Fee etc. shall be borne and paid by
Vendee.

8. That if the Vendor infringes any of the terms and conditions of this Agreement, the vendee
shall be entitled to get the implementation thereof effected through court of law by specific
performance of this Agreement or any other laws for the time being in force, at the cost and risk
of the vendor or may rescind this Agreement, and in that eventuality, the vendor shall be liable
and responsible for making good or the losses which may be suffered incurred, undergone
and/or sustained by the vendee as result thereof.
9. That this agreement will remain irrevocable and binding on both the parties and their
respective legal heirs and successors.

10. The contents of present Agreement to Sell have been read over and explained to both the
parties in the language understood by them. Both the parties consents to abide with the terms
and conditions of present agreement and therefore, they have put their respective signatures
herein below in presence of the witnesses

the date, month and year herein above first mentioned in the presence of the following
