(each carrying 10 marks). Section C is Compulsory (carrying 16 marks).

SECTION A (Attempt any Four Questions)

3. Comment upon the electoral process of India for the appointment of President? [06]
4. Discussion the provision of emergency for failure of constitutional machinery? [06]

5. Briefly discuss the procedure of appointment of Judges of Supreme Court? [06]

7. “Legalism and rigidity, it is said, are the inevitable consequences of federalism, and the [10]
success of a federal constitution depends considerably upon the extent to which thses two
evils are minimized.” Discuss the above in-light of constitutional provisions?
8. One of the former chief Justice of India, Justice Sabysachi Mukherji , categorized [10]
impeachment process as being practically impossible. The process is just too cumbersome.
Do you agree with the statement? Justify your opinion in light of various impeachment
process initiated against the judges of higher judiciary.

Raghu & Mr. Murli , members of Gujarat Legislative assembly elected in the general election
held in 2015 , both of them were candidate of Gujarat Samaj Party. Both of them were
expelled from GSP party on January 8, 2014. On March 16 th, 2014, the speaker of Gujarat
Legislative assembly declared them as “Unattached member of the assembly “. In April 20 th,
2014, both the member joined another party called Gujarat Party. In April 25 th, 2014, a
member of legislative assembly Shankar filled a petition before the speaker for their
disqualification.
