DISCLOSURE ACKNOWLEDGMENT AND AGREEMENT

LANDLORD/AGENT AND RESIDENTS ACKNOWLEDGE AND AGREE THAT BROKERS: (A) DO NOT
GUARANTEE THE CONDITION OF THE PREMISES; (B) CANNOT VERIFY REPRESENTATIONS MADE BY
OTHERS; (C) CANNOT PROVIDE LEGAL OR TAX ADVICE; (D) WILL NOT PROVIDE OTHER ADVICE OR
INFORMATION THAT EXCEEDS THE KNOWLEDGE, EDUCATION OR EXPERIENCE REQUIRED TO OBTAIN
A REAL ESTATE LICENSE.

1. NEIGHBORHOOD CONDITIONS Residents are advised to satisfy themselves as to neighborhood or


area conditions, including schools, proximity and adequacy of law enforcement, crime statistics,
registered felons or offenders, fire protection, other government services, proximity to commercial,
industrial or agricultural activities, existing and proposed transportation, construction and
development that may affect noise, view, or traffic, airport noise, noise or odor from any source
wild and domestic animals, other nuisances, hazards, or circumstances, facilities and condition of
common areas, conditions and influences of significance to certain cultures, and/or religions, and
personal needs, requirements sand preferences of Residents.

2. AIRPORTS/LAGUNA SECA RACEWAY The Monterey Peninsula Airport is located off of Highway
68 near Highway 1. The Salinas Municipal Airport is located off of Airport Boulevard in southeast
Salinas. The Marina Municipal Airport is located near Reservation Road and Imjin Road in Marina.
Residents should be aware of potential air traffic noise in these areas. Laguna Seca Raceway on
Monterey/Salinas Highway is the site of periodic major events which may produce increased noise
and/or traffic.

3. DATA BASE DISCLOSURE Notice: Pursuant to Section 290.46 of the Penal Code, information
about specified registered sex offenders is made available to the public via an internet website
maintained by the Department of Justice at www.meganslaw.ca.gov. Depending on the offender’s
criminal history, this information will either include the address at which the offender resides or the
community of residence and the zip code in which he or she resides. Landlord/Agent is not required to
consult this database. If Residents desire additional information, Residents should refer to website listed
herein.

4. RACOONS AND OTHER WILDLIFE Because much of the residential area in Monterey County is
heavily forested, wildlife is abundant, even in the cities. Certain areas of Monterey County have
experienced occasional intrusions of non-domesticated animals. Raccoons and other wildlife in the
area have been known to destroy property and to cause serious disease and even death of
residents and their pets. Never feed or try to capture a raccoon or other wild animal. If you have
domestic pets at your home, do not leave food outside, to avoid attracting wild animals to your
property. Keep the lids on your trash bins tightly closed. If you need help dealing with any wildlife,
please call the SPCA of Monterey County at 831 373 2631 or an animal control professional.

5. BED BUG DISCLOSURE (INFORMATION ABOUT BED BUGS)


Bed Bug Appearance: Bed bugs have six legs. Adult bed bugs have flat bodies about ¼ of an inch in length.
Their color can vary from red and brown to copper colored. Young bed bugs are very small. Their bodies
are about 1/16th of an inch in length. They have almost no color. When a bed bug feeds, its body swells,
may lengthen, and becomes bright red, sometimes making it appear to be a different insect. Bed bugs do
not fly. They can either crawl or be carried from place to place on objects, people, or animals. Bed bugs can
be hard to find and identify because they are tiny and try to stay hidden.

Life Cycle and Reproduction: An average bed bug lives for about 10 months. Female bed bugs lay one to
five eggs per da. Bed bugs grow to full adulthood in about 21 days.
Bed bugs can survive for months without feeding.
Bed Bug Bites: Because bed bugs usually feed at night, most people are bitten in their sleep and do not
realize they were bitten. A person’s reaction to insect bites is an immune response and so varies from
person to person. Sometimes the red welts caused by the bites will not be noticed until many days after a
person was bitten, if at all.
Common signs and symptoms of a possible bed bug infestation:
- Small red to reddish brown fecal spots on mattresses, box springs, bed frames, mattresses, linens,
upholstery, or walls.
- Molted bed bug skins, white, sticky eggs, or empty eggshells.
- Very heavily infested areas may have a characteristically sweet odor.
- Red, itchy bite marks, especially on the legs, arms, and other body parts exposed while sleeping.
However, some people do not show bed bug lesions on their bodies even though bed bugs may have fed on
them.

Tenant shall report suspected infestations by bed bugs to the Landlord or property Manager at the mailing
or email address, or phone number provided in the Agreement and cooperate with any inspection for and
treatment of bed bugs.
Landlord will notify tenants of any units inspected by a pest control operator of the findings by such an
operator within 2 business days of the receipt of the findings. All Tenants will be notified of confirmed
infestations within common areas.

6. MOLD Residents are hereby notified that mold can grow if the Premises are not properly
maintained or ventilated and that if moisture is allowed to accumulate, it can cause mildew and
mold to grow. Residents agree to maintain the Premises in a manner that prevents the occurrence
of an infestation of mold or mildew in the premises by doing the following: regularly allowing air to
circulate in the Premises; keeping the interior of the Premises free of dirt and debris that can
harbor mold; repairing or causing to be repaired any water intrusion, such as plumbing leaks, drips,
or sweating pipes; engaging the appropriate disaster clean-up agency for any overflow from
bathroom, kitchen, or laundry facilities and insuring that in cases where the overflow may have
permeated walls or cabinets, all areas are completely dried out prior to being placed back into
service; removing any significant mold growth on surfaces inside the Premises; using bathroom fans
while showering and keeping fans in good repair; using exhaust fans when cooking, dishwashing, or
cleaning; cleaning and drying all visible moisture on windows, walls, and other surfaces as soon as
reasonably possible; and making necessary repairs to heating and air conditioning systems.

7. LEAD PAINT Disclosure of Information on Lead-Based Paint and/or Lead-Based Paint Hazards
Lead Warning Statement

Housing built before 1978 may contain lead-based paint. Lead from paint, paint chips, and dust can
pose health hazards if not managed properly. Lead exposure is especially harmful to young children
and pregnant women. Before renting pre-1978 housing, lessors must disclose the presence of
known lead-based paint and/or lead-based paint hazards in the dwelling. Lessees must also receive
a federally approved pamphlet on lead poisoning prevention.

8. FIRE SPRINKLERS There is a history of recalled fire sprinklers in Monterey County. Residents
should satisfy themselves that any fire sprinklers installed on the property are in proper operating
condition.

9. INFORMATION ABOUT FLOOD HAZARDS: Tenant is informed of the following:


The Property is located in a special flood hazard area or an area of potential flooding.
Property is deemed to be in a special flood hazard area or area of potentially flooding if any of the
following scenarios apply:
A. The owner has actual knowledge of that fact.
B. The owner has received written notice from any public agency stating that the Property is
located in a special flood hazard area or an area of potential flooding.
C. The Property is located in an area in which the owner's mortgage holder requires the owner to
carry flood insurance.
D. The owner currently carries flood insurance.
The tenant may obtain information about hazards, including flood hazards, that may affect the
Property from the Internet Web site of the Office of Emergency Services, My Hazards Tool
(http://myhazards.caloes.ca.gov).
The owner's insurance does not cover the loss of the tenant's personal possessions and it is
recommended that the tenant consider purchasing renter's insurance and flood insurance to insure
his or her possessions from loss due to fire, flood, or other risk of loss.
The owner is not required to provide additional information concerning the flood hazards to the
Property and that the information provided pursuant to this section (California Government Code
section 8589.45) is deemed to inform the tenant.

10. MILITARY ORDNANCE DISCLOSURE (If applicable and known to Landlord/Agent) The Premises is
located within one mile of an area once used for military training, and may contain potentially
explosive munitions.

11. TRAFFIC Monterey County is host to a large number of special events that can and may increase
traffic congestion in certain areas at certain times.

12. PERIODIC PEST CONTROL TREATMENT : If Landlord/Agent has entered into a contract for periodic
pest control treatment of the Premises or does so at any time in the future, the Landlord/Agent
hereby notices the Residents as follows: CAUTION--PESTICIDES ARE TOXIC CHEMICALS. Structural
Pest Control Companies are registered and regulated by the Structural Pest Control Board, and
apply pesticides which are registered and approved for use by the California Department of
Pesticide Regulation and the United States Environmental Protection Agency. Registration is
granted when the state finds that based on existing scientific evidence there are no appreciable
risks if proper use conditions are followed or that the risks are outweighed by the benefits. The
degree of risk depends upon the degree of exposure, so exposure should be minimized. If within
24 hours following application you experience symptoms similar to common seasonal illness
comparable to the flu, contact your physician or poison control center (800) 876-4766 and your
pest control company immediately." "For further information, contact any of the following: your

13. AGENCY: Central Coast Property Management is the agent of the Landlord exclusively.
 (If checked) The term of this Agreement exceeds one year. A disclosure regarding real estate
agency relationships has been provided to Landlord and Residents, who each acknowledge its
receipt.

14. WATER CONSERVATION: Monterey County has a long term water supply problem. In the Salinas
Valley, more water is being pumped out of the ground water than nature and the County’s
reservoirs can replace; and on the Monterey Peninsula, water storage is limited and there are
restrictions and the amount of water available. Water conservation is a way of life for those who
live and work in the Monterey County. Water utilities and mutual water companies may
periodically impose mandatory or voluntary cutbacks and/or increased fees, restrictions or
moratoriums on water use. Residents are advised to contact the water company serving the subject
property, any appropriate governing water or planning agency, and/or the Environmental Health
Department for more information concerning the nature and extent of any current or anticipated
water policies which may have an effect on the Residents’ general use and enjoyment of the

Water Conservation Regulations are as follows:
 No water may be used wastefully or without reasonable purpose
 Plumbing leaks must be repaired within 72 hours of their discovery (24 hours in city of Salinas)
 Any hose used for washing vehicles must have an automatic shutoff nozzle
 Any hose used for washing the outside of a building must have an automatic shutoff nozzle
 Use of a hose to clean the sidewalk, driveway, etc. is prohibited, except in matter of public health or safty.
Use of a bucket for such tasks is not prohibited.
 Allowing water to spill into streets, curbs or gutters in excess of beneficial use is prohibited.
 Emptying and refilling pools and spas is prohibited, except when necessary to prevent or repair structural
damage or to comply with public health regulations
 Decorative fountains may only use water recycled within the system
 Monterey Peninsula residents may not water landscaping between 9:00 am and 5:00 pm, unless using
drip irrigation or hand watering with automatic shutoff nozzle.
 Repeated violations may result in fines
Some of these regulations may be more stringent in your area; *Effective August 22, 1997*
Water Conservations Tips:
 Ultra-low flow showerheads (2.5 gallons per minute) can save about 3 gallons per minute
 Ultra-low flush toilets (1.6 gallons per flush) can save up to 5 gallons per flush
 Don’t use a trashcan as a wastebasket or ashtray: only flush when necessary
 Don’t let the water run while your brush your teeth or shave; you can save 3 gallons or more
 Low flow faucets or low flow aerators can save about 2.5 gallons per minute
 When hand washing dished use a basin or water rather then letting the tap run
 When using a dishwasher run only when full and choose the short cycle
 Keep a pitcher of water in the refrigerator rather than running the water until it cools
 Thaw frozen foods in the refrigerator and microwave rather than under running water
 Wash only full loads of laundry on the short cycle in your washing machine
 Insulated hot water pipes or hot water recirculation system get hot water on tap faster
 Use a swimming pool/spa cover to reduce evaporation
 Plant low water-use plants and use water conserving materials in landscaping

 Water landscaping in the early morning or evening to avoid rapid evaporation during the heat of the
day
 Don’t water on windy days to avoid water and evaporation
 Use a low volume/high pressure system to wash structures surfaces or vehicles

In compliance with the Monterey Peninsula Water Management District Rule 154, the following notification is
made to tenant(s):
WATER WASTE ‐ ”Water Waste” shall mean the indiscriminate, unreasonable, or excessive running or dissipation
of water. Water Waste shall include, but not be limited, to the following:
1. Waste caused by correctable leaks, breaks or malfunctions. This loss of Potable water may be cited as Water
Waste after a reasonable period of time has passed in which the leak or malfunction could have been corrected.
Exceptions may be granted by the General Manager for corrections, which are not feasible or practical.
2. Indiscriminate or excessive water use which allows excess to run to waste.
3. Use of Potable water for washing driveways, patios, parking lots, tennis courts, or other hard surfaced areas,
except in cases where health or safety are at risk and the surface is cleaned with a Water Broom or other water
efficient device or method. Water should be used only when traditional brooms are not able to clean the surface in
a satisfactory manner.
4. Use of Potable water for pressure/power washing buildings and structures, except when preparing surfaces for

5. Hand watering without quick acting Positive Action Shut‐Off Nozzles.
6. Irrigation between 9 am and 5 pm on any day, and irrigation on any day other than Saturdays and Wednesdays,
except for irrigation overseen by a professional gardener or landscaper who is available on Site and that is not
exceeding a maximum two watering days per week, or that is water efficient non‐sprinkler irrigation managed by
an operational Smart Controller.
7. Failure to arrange for a Landscape Water Audit within 60 days of notification of a requirement to obtain an
audit.
8. Failure to complete a Landscape Water Audit within 60 days of a significant modification to an audited
Landscape.
9. Failure to maintain water use within a mandatory Landscape Water Budget.
10. Use of water for more than minimal Landscaping, as defined in the Landscaping regulations of the Jurisdiction
or as described in Article 10.8 of the California Government Code.
11. Operation of fountains, ponds, lakes or other ornamental use of Potable water without recycling.
12. Draining and refilling of swimming pools or spas except (a) to prevent or correct structural damage or to
comply with public health regulations, or (b) upon prior approval of the General Manager.
13. Individual private washing of cars with a hose except with the use of a Positive Action Shut‐Off Nozzle.
14. Use of water for washing commercial aircraft, cars, buses, boats, trailers or other commercial vehicles at any
time, except at commercial or fleet vehicle or boat washing facilities operated at a fixed location where
equipment‐using water is properly maintained to avoid wasteful use.
15. Operation of a commercial full service car wash without recycling at least 50 percent of the Potable water used
per cycle.
16. Charity car washes.
17. Use of Potable water for street cleaning.
18. Failure to meet MPWMD Regulation XIV retrofit requirements for an existing business after having been given
a reasonable amount of time to comply
19. Serving drinking water to any customer unless expressly requested, by a restaurant, hotel, café, cafeteria or
other pubic place where food is sold, served or offered for sale.
20. Washing of livestock with a hose except with the use of a Positive Action Shut‐Off Nozzle.
21. Transportation of water from the Monterey Peninsula Water Resource System without prior written
authorization from the MPWMD.

22. Unreasonable or excessive use of Potable water for dust control or earth compaction without prior written
approval of the General Manager where non‐Potable water or other alternatives are available or satisfactory.
23. Use of unmetered fire hydrant water by individuals other than for fire suppression or utility system
maintenance purposes, except upon prior approval of the General Manager.
24. Misrepresentation of the number of Persons permanently residing on a property where water is supplied by a
Water Distribution System or by a private Well.
25. Water use in excess of a Water Ration.
The following activities shall not be cited as Water Waste:
1. Flow resulting from firefighting or essential inspection of fire hydrants;
2. Water applied to abate spills of flammable or otherwise hazardous materials, where water application is the
appropriate methodology;
3. Water applied to prevent or abate health, safety, or accident hazards when alternate methods are not available;
4. Storm run‐off;
5. Flow from fire training activities during Stage 1 Water Conservation through Stage 3 Water Conservation;
6. Reasonable quantities of water applied as dust control as required by the Monterey Bay Unified Air Pollution
Control District, except when prohibited by Regulation XV.
