of SHIELA MAE A. BOQUIRON
(Pursuant to A.M. 12-8-8-SC)

I, SHIELA MAE A. BOQUIRON, of legal age, Filipino, single

and with postal address at No. 007 Area 1 Republic Avenue Brgy.
Holy Spirit, Quezon City, after having been duly sworn to in
accordance with law, hereby attest that:

PRELIMINARY STATEMENT

The person examining me is ATTY. PAULO CAMANIAN

Joshua Maquiling with office address at Unit 436 Building U, Don
Enrique Heights, Brgy. Kaunlaran, Quezon City. The examination is
being held in the same address on August 29, 2006 at 1:00 p.m. I am
answering his questions fully conscious that I do so under oath and I
may face criminal liability for false testimony and perjury.

OFFER OF TESTIMONY

Q1: Please state your name and personal circumstances?

A: I am Shiela Mae A. Boquiron, of legal age, Filipino, single and a
resident of No. 007 Area 1 Republic Avenue Brgy. Holy Spirit,
Quezon City.

Q2: What is the purpose of your testimony today?

A: My testimony will serve the following purposes: (1) disprove all
of the allegations of addiction to gambling and the alleged
marital infidelity of respondent; (2) to prove that petitioner had
an illicit affair with another woman; and (3) to prove that
respondent never failed to fulfill her marital obligations;

Q3: Do you know the parties of this case?

A: Yes sir, herein parties of this case are my parents. Respondent,
GRACE ESTRALLA is my mother and Petitioner, JOSEPH
ESTRALLA is my father.

Q4: You said that herein parties are your parents, what document
do you have, if any, to prove this?
A: Yes sir, I have here with me a copy of my Certificate of Live
Birth indicating that I am one of the children of herein petitioner
and respondent.

Q5: I am showing you Certificate of Live Birth with Registry No. 87-
1234 issued by Philippines Statistics Authority. What is the
relation of this document with the one you mentioned?
A: This pertain to the same document I mentioned earlier sir.
Atty. Maquiling: Presenting to this Honorable Court, Certificate of Live
Birth with Registry No. 94-1234 and be marked as Annex “11”.

Q6: As stated in the executed Judicial Affidavit of respondent, latter

worked as a teacher in Salawagan National High School. What does
respondent do once she arrived from school?
A: I remember that when I was a child, my mother just stayed at
home and immediately prepared our dinner after her work from
school. She ensures that she had an enough time to help me
and my siblings with our school works after she was done with
the house chores.

Q7: During the times when you’re still living with respondent, do you
observe if she has any hobby then?
A: Yes. After doing all of the house chores and finishing all of her
lesson plans, sometimes she play cards with her friends to
ease her boredom.

Q8: Was there a time when respondent left you at home just to play
cards with her friends?
A: None. I cannot recall any incident that respondent left us alone
in our home just to play cards with her friends. I remember that
she used to call her friends to come in our house and play
cards with her.

Q9: Does respondent play cards with her friends’ every day?
A: No sir. She will only play with her friends during weekends or
holidays.

Q10: When she is playing cards with her friends, do you recall if any,
if she will gamble with money while playing cards with her
friends?
A: Yes, I do recall that there were certain instances that she will
bet with money while playing with her friends for fun but she will

only do that if she had extra money from her salary as a

teacher.

Q11: Do you recall if your mother incurred any debt from your
neighbors?
A: Yes sir.

Q12: It is true that she incurred these debts due to her unreasonable
spending of money and addiction to gambling?
A: No sir. I recall that my mother contracted these debts to help
members of our family needing money and to settle household
related expenses.

Q13: As stated in the Judicial Affidavit executed by petitioner, he

decided to leave respondent sometime on 2005 due to the illicit
affair of latter with another man, can you confirm this matter?
A: There is no truth in such allegation. My parents’ separation was
not due to the illicit affair of my mother but it was due to the
marital infidelity of my father when he was assigned in Calinan
Davao.

Q14: You said earlier that your father was assigned to Calinan
Davao. Were you able to visit him during his assignment in
Davao?
A: Yes sir. I remember that sometime on 2005, I visited my father
and asked him to go home with me after his duty in Calinan
Davao but he refused to do so.

Q15: Do you recall what was the reason petitioner refused to go back
to Bukidnon with you?
A: Yes. He personally told me that he already found a “bright
future”. I had no idea what he meant then, but later on I

discover that his “bright future” refers to a new wife and family
in Cabadbaran, Agusan Del Norte.

Q16: How did you know that petitioner had a new wife and family in
Cabadbaran, Agusan Del Norte?
A: An unknown number texted me then saying that my father
already had a new family in Cabadbaran.

Q17: Did respondent have an idea of the alleged wife and family of
herein petitioner in Cabadbaran?
A: Yes sir. I recall that I confronted my mother regarding such
matter and she confirmed to me that my father found another
wife in Cabadbaran.

Q18: What did respondent do after such?

A: Respondent exerted all efforts to save their marriage but
petitioner stays indifferent with her and adamant to fix our
family.

Q19: What actions a respondent does, if any, thereafter?

A: My mother unwillingly accepted and chose to respect the
decision of my father. However, my mother despite their
separation did not change. She was still a rearing and caring
mother. She never failed in providing us true and sincere care,
thus, we were able to grow up happy despite the broken
marriage.

Q20: Do you have anything more to say?

A: Nothing more, at the moment.

Q21: Do you affirm and confirm the contents of this affidavit?

A: Yes, ma’am.
