Study these:

Distinguish between proof and evidence.

When is evidence admissible? Read section 3, rule 128.. it says, evidence is admissible when it is
relevant and not excluded by law or competent.

Now, go to relevancy and competency.

Example. If the evidence presented is relevant or MAY KAUGNAYAN, the evidence is admissible... just
look if it is RELEVANT... drug cases, dapt evidence is may relasyon or kaugnayan sa drug cases. Kasi if
wala, irrelevant.. see?????

Now, tell me what is COMPETENT? kasi sabumi ng rules, not excluded by law, meaning kapag may law
na nagsasabi na di dapat ipresent, wag niyo ipresent because it is excluded by law... just see if may law
na nag pi prevent, kapag meron, ibig sabihin exlcuded sya

2. What is the general rule for arrest..

Example, we only have to arrest if there exists warrant of arrest.. if there is no warrant of arrest, we
cannot do the arrest.

However, there are exceptions.

The exceptions are those mentioned in rule 113 section 5... kindly read it..

3. Can you summon or ask assistance in making arrest?

4. What will you do if the person to be arrested is inside the building.

5. What is RA 7438?

6. What are the rights mentioned in RA 7438?

Study and read the following..

1. What is BAIL?

2. Who can post bail?

3. What are the forms of bail?

4. Can a person arrested but not yet charge with the court, post bail?

5. Where application or petition for bail may be filed?

In addition, kindly read

1. Best evidence rule;

Example, when is evidence best? Are you familiar with photocopy? If i will present it as evidence, can
the court consider it?

Why best evidence, named best?

2. Parol evidence rule;

If for example, there are agreement which is reduced into writing, can you consider those agreement
that is not written? Or part of it?

3. Multiple admissibility;

If the evidence is admissible for two or more purpose, it is multiple admissiblity.

Can you give me example? Try to think of object and documentary.. read carefully
