JUDICIAL AFFIDAVIT of ARVIN BEDRIO OBESO

Preliminaries

1. This Judicial Affidavit is in Bisaya (with English translation), a

language known to and understood by the complainant.
2. The complainant is ARVIN BEDRIO OBESO , Filipino, of legal
age, and a resident of Purok 5, Pundasyon, Nueva Grasya Loreto,
Agusan del Sur.
3. The Judicial Affidavit of ARVIN BEDRIO OBESO is given on
the 16th day of December 2019 before Atty. Marceliano Monato
III, at Patin-ay, Prosperidad, Agusan del Sur.

PURPOSE: This affidavit/testimony of witness ARVIN BEDRIO

OBESO is being offered to prove that he acted on the defense
of relatve, and that he will testify on related matters regarding
this case.

Frustrated Homicide nga gipasaka ni Roy Dequito Dagaang taga
Pundasyon, Nueva Grasya, Loreto , Agusan del Sur.
(I am executing this Affidavit to answer accusation in the case of Frustrated
Homicide filed by Roy Dequito Dagaang a resident of Pundasyon, Nueva
Grasya, Loreto , Agusan del Sur..)

A: Kay nag puyo mana siya og iyang asawa sa maong barangay mga
sobra tuig na nag kadugayon.
(because he and her wife live in our barangay for more than a year already)

4. Q: Ikaw gi akusahan ni Roy Dagaang nga niadtong petsa Hulyo 20,

2019 didto sa inyong videokehan sa Pundasyon, Nueva Grasya,
Loreto, Agusan del Sur, nga adunay intensyon nga patyon siya nga
walay igong rason, pinaagi sa pagdunggab sa kilid sa iyang lawas.
Unsa may masulti ani?
(You are being accused by Roy Dagaang that on July 20, 2019 in your
videoke house in Pundasyon, Nueva Grasya, Loreto, Agusan del Sur, you
intended to kill him without justifiable cause, by stabbing his left posterior
chest. What can you say about it?)
A: Wala akoy intensyon nga patyon sya. Adtong tungora ako lang
gusto depensahan akong magulang nga gitabangan og kulata ni Roy
Dagaang og Renato Tolosa Hayao.
(I do not have the intention to kill him. At that time all I wanted is to
defend my brother who was mauled by Roy Dagaang and Renato Hayao.)

5. Q: Ka hinumdum ba ka sa mga panghitabo niadtong petsa Hulyo 20,

2019 didto sa inyong videokehan sa Pundasyon, Nueva Grasya,
Loreto, Agusan del Sur?
(Can you still recall the incident occur last July 20, 2019 in your videoke
house in Pundasyon, Nueva Grasya, Loreto, Agusan del Sur?)

6. Q: Palihug isulti ang mga panghitabo.

(Please narrate the incident)
A: That around 10:45 am on that day, Reynald Tosoy, Renato Hayao alyas
Olpot, Pakloy, Kibol, Roy Dagaang and were having a drinking session in
our videoke house. While me and my brother were present nearby
watching over the videoke house, ocassionally they serve us some liquor
shots. In the course of singing, Roy Dagaang suddenly “paused” the
videoke machine, and wanted to have a refund of P5 he dropped from the
machine. Arvin and Roy had an altercation but the Kevin later on refunded
the P5. However, After receiving the P5, Roy Dagaang throw it away and
started shouting horrible thing to me. Kevin tried to stop him and plead
Roy to leave. Roy Dagaang became unstoppable and started amok in the
videoke house. Kevin get a bolo and tried to scare Roy to leave the place
but the same remain persistent and stubborn. This made Kevin mad and
hacked Roy with the bolo in and opposite position. Roy in seizing the bolo
from Kevin, the former clipped the bolo with his left arm and this cause

 wounds in the left side of his body. Roy being large in size, Kevin was no
match t him. When the bolo was taken by Roy, his companion Renato
Hayao picked up a chair and struck Kevin on his head causing him to fell
down. I took a knife inside our house and tried to help my brother Kevin
fending from his aggressors. I stabbed Roy in his waist and right arm, and
retreated afterwards. I could not get near them because im afraid already.
Roy’s continued kicking of Kevin who was then unconscious, leads to his
death thereafter.

A: Natingala nalang ko nga gi kasohan ko nga ning depensa raman
ko sa akong igsoon nga si Kevin.
(I was surprised when they file a case against me, when what I did was just
to defend my brother Kevin

A: Yes, I have here the Joint Affidavit of Renald Tosoy and Violeta
Bedrio, The pictures of Kevin after he was mauled, the death certificate of
Kevin.

A: Gusto ko ma dismiss ni nga kaso nga gi file nila sa akoa..
( I prayed to honorable court to dismiss this case against me)

A: Wala na sa pagka karon, kung naa man koy idugang, ako ra isulti
panahon sa hearing
