AMENDED COMPLAINT FOR UNLAWFUL DETAINER

COMES NOW the Plaintiff, NEIL J. GILLESPIE, age 64 and suffering the infirmaries of

aging, an indigent nonlawyer, unable to obtain adequate counsel, a consumer of legal and court

services affecting interstate commerce, a consumer of personal, family and household goods and

services, consumer transactions in interstate commerce, a person with disabilities, a vulnerable

adult (Fla. Stat. 415.102(28)), reluctantly appears pro se, here in the first person, and files

Amended Complaint For Unlawful Detainer, and states,

1. This complaint is brought under the Constitution and laws of Florida, and the

Constitution and laws of the United States, including Fla. Stat. § 34.011(2) for unlawful detainer.

2. The amount in controversy exceeds $100,000. I invoke jurisdiction of the Circuit Court.

3. I demand a jury trial. Sec. 22, Art. 1, Fla. Const., and Amend VII, U.S. Const.

4. Fla. Stat. 415.102(28) Adult Protective Services, defines the term vulnerable adult:

“Vulnerable adult” means a person 18 years of age or older whose ability to perform the
normal activities of daily living or to provide for his or her own care or protection is
impaired due to a mental, emotional, sensory, long-term physical, or developmental
disability or dysfunction, or brain damage, or the infirmities of aging.

5. Fla. Stat. 415.1034 Mandatory reporting of abuse, neglect, or exploitation of

vulnerable adults; mandatory reports of death, states in relevant part:

BACKGROUND

6. It is said the road to hell is paved with good intentions. My good-faith efforts over the

past year to help a fellow vulnerable adult, Sarah May Thompson, have been misused by state,

county, and/or municipal criminal justice employee(s) and law enforcement officers in their

long-standing vendetta to harm me and ruin my life, through deprivation of rights under color of

law in home foreclosure, false arrest on November 10, 2019, and a government-sanctioned home

invasion on June 7, 2020. White supremacy and evil motivate the confederates against me.

THE PLAINTIFF

7. I am the Plaintiff, Neil J. Gillespie, age 64, single, never married, no children. I am

educated with degrees in business and psychology. Prior to moving to Florida, I owned and

operated car dealerships in Pennsylvania. I moved to Ocala on February 9, 2005 and have lived

here continuously. I cared for my mother, Penelope Gillespie, an unremarried widow, who had

Alzheimer’s Disease. Mom died September 16, 2009. My father Cornelius Gillespie died

September 17, 2003. I am Caucasian and have several congenital birth defects, including cleft lip

and palate. Ms. Thompson ridiculed me, my deformities, and family by email on April 18, 2020

at 12:56 PM. Exhibit 1. The birth defects affect my appearance and ability to speak and hear. On

August 20, 1988 I survived traumatic brain injury during an attempted robbery in Philadelphia.

Social Security found I was totally disabled since 1992. I am a person with disabilities, including

Post Traumatic Stress Disorder, depression, anxiety, type 2 diabetes, sleep apnea, and other such.

THE DEFENDANTS

8. Defendant Sarah May Thompson (“Sarah”), age 35, an unremaried widow, is a

vulnerable adult as defined by Fla. Stat. 415.102(28). Sarah is known to a number of the other

Defendants as a habitual criminal, a drug addict, a thief, and a vagrant with no lawful means of

support, who voluntarily relinquished custody of her newborn daughter in 2015. The child was

born in prison. Sarah can be violent, and I believe she has a personality disorder and/or other

mental illness.

9. Defendant Marion County Board of County Commissioners, hereinafter “BOCC” is the

primary legislative and policy-making body for Marion County, and is governed by the Florida

Statutes, Chapter 125, County Government.

Part I, County Commissioners: Powers and Duties.


Section 125.01 Powers and duties.— Include,
(1) The legislative and governing body of a county shall have the power to carry on
county government. To the extent not inconsistent with general or special law, this power
includes, but is not restricted to, the power to:
(b) Provide for the prosecution and defense of legal causes in behalf of the county or state
and retain counsel and set their compensation.
(c) Provide and maintain county buildings.

Section 125.15 To sue and be sued in the name of county.—


The county commissioners shall sue and be sued in the name of the county of which they
are commissioners. A change in the persons composing the board of county
commissioners shall not abate the suit, but it shall proceed as if such change had not
taken place.

The BOCC is located at 601 SE 25th Ave., Ocala, FL 34471. Each commissioner represents one

of the five districts in which they reside. They are elected by all county voters to serve a four-

year term. The board elects a chairman and vice-chairman each year. The current BOCC consists

of the following members:

This board has the responsibility to provide for the safety and welfare of all Marion County

residents. The BOCC has oversight of Defendant Marion County Sheriff’s Office (MCSO) by

and through the agency’s annual budget prepared by the MCSO Budget & Finance Division,

Accounting Services Unit. The current budget is $71,616,971 and covers the Jail, Bailiffs at the

courthouse, the County’s Emergency Management Department, and the County’s Community

Policing. Budget revisions, either amendments to existing budgets or additions, are coordinated

with the County’s Budget Office and the BOCC. Budget execution is monitored and reported

monthly to the Sheriff’s senior staff.

10. Defendant Marion County Sheriff’s Office (“MCSO”) is located at 692 NW 30th Ave.

Ocala, FL 34475. The MCSO is governed by the Florida Statutes, Chapter 30, Sheriffs. The

Florida Statutes, section 30.15(1)(e) Powers, duties, and obligations, provides,

(1) Sheriffs, in their respective counties, in person or by deputy, shall:


(e) Be conservators of the peace in their counties.

The MCSO arrested Sarah, see Marion County Criminal Case 42-2014-CF-002361-AXXX-XX.

11. Defendant Timothy McCourt is General Counsel for the MCSO, and is a state, county, or

municipal criminal justice employee or law enforcement officer with knowledge of this matter,

and under Fla. Stat. 415.1034 Mandatory reporting of abuse, neglect, or exploitation of

vulnerable adults; mandatory reports of death, has a mandatory reporting duty.

Mr. McCourt knows Sarah was arrested and convicted in Marion County, see Marion County

Criminal Case 42-2014-CF-002361-AXXX-XX.

12. Defendant Lt. Charles Welch is the South Marion District Commander for the MCSO,

and is a state, county, or municipal criminal justice employee or law enforcement officer with

knowledge of this matter, and under Fla. Stat. 415.1034 Mandatory reporting of abuse, neglect,

or exploitation of vulnerable adults; mandatory reports of death, has a mandatory reporting duty.

13. Defendant William Woods, Sheriff, Marion County, is the Sheriff for the MCSO, and is a

state, county, or municipal criminal justice employee or law enforcement officer with knowledge

of this matter, and under Fla. Stat. 415.1034 Mandatory reporting of abuse, neglect, or

exploitation of vulnerable adults; mandatory reports of death, has a mandatory reporting duty.

14. Defendant Brad King, State Attorney for the Fifth Judicial Circuit, 110 NW 1st. Ave.,

Suite 5000, Ocala, FL 34475, is a state, county, or municipal criminal justice employee or law

enforcement officer with knowledge of this matter, and under Fla. Stat. 415.1034 Mandatory

reporting of abuse, neglect, or exploitation of vulnerable adults; mandatory reports of death, has

a mandatory reporting duty.

15. Defendant Office of The State Attorney Fifth Judicial Circuit Florida, located in the

Marion County Judicial Center, 110 NW 1st. Ave., Suite 5000, Ocala, FL 34475, knows Sarah

was arrested, prosecuted and convicted in Marion County, while Brad King was State Attorney,

see Marion Co. Criminal Case 42-2014-CF-002361-AXXX-XX.

16. Defendant Michael Graves Public Defender, Defendant Office of Mike Graves Public

Defender, and Defendant Susan D. Bailey Assistant Public Defender, 204 NW 3rd Ave. Ocala,

Fl 34474, is a state, county, or municipal criminal justice employee or law enforcement officer

with knowledge of this matter, and under Fla. Stat. 415.1034 Mandatory reporting of abuse,

neglect, or exploitation of vulnerable adults; mandatory reports of death, has a mandatory

reporting duty.

NOTIFICATION TO AUTHORITIES OF VULNERABLE ADULT IN NEED

17. Sarah gained entry to my property on or about June 15, 2019 through fraudulent use of

another person’s image. Then she stole prescription medication from me which I reported to

attorney Susan D. Bailey (Bar ID #193290), Assistant Public Defender by email on Wednesday,

June 19, 2019 at 4:29 AM. (Exhibit 2). I wrote Ms. Bailey in essence:

Dear Ms. Bailey,

Previously you represented Sarah May Thompson, DOB June 9, 1985, an unremarried
widow, in Marion County Criminal Case 42-2014-CF-002361-AXXX-XX.
Count I: Evidence Tampering; Alprazolam pill
Count II: Retail Petit Theft; Fishing reel, coffee, or a recorder
Count III: Resist Law Enforcement Officer Without Violence

Last week Ms. Thompson moved into my home as a live-in home health provider, see
attached. On June 16, 2019 Sarah admitted to taking prescription medication from my
room. Sarah apologized and promised not to take my pills again.

I don’t know what to do. I have no faith in the Marion County Sheriff’s Office, over
issues related to my home foreclosure (2013-CA-00115). I have no faith in the UDEST or
DCF. I do not want to report Sarah to L.E. (I support legalizing drugs). But I may not be
the best person to help Sarah. I am aware she placed a newborn for adoption in 2015. She
arrived at my door the result of mistaken identity through a website. Initially Sarah
seemed nice, and she needed a place to stay. I felt compassion for a homeless,
unremarried widow. And it is difficult for a single man age 63 with health issues and
limited income to find competent help. Previously two other providers did not work out,
one age 40 (drugs) and one age 43 (drinking/smoking).

Currently Sarah has a broken tooth that needs extraction, but she refuses medical
treatment I found, see https://www.truecaredentistocala.com/emergency-dentist.html

I don’t want to throw Sarah out into the street. I believe she needs stability, but the
people in her life may not be stable. I would appreciate any suggestions you may have.

for Sarah’s well-being. Sarah is a vulnerable adult who is unable to care for herself.” (Exhibit 3)

Dear Law Enforcement and Public Defender:

This concerns Sarah May Thompson, a white female, 5’5", DOB June 9, 1985 (age 34),
single, brown hair, slim, no driver’s license, but has a Florida ID #T512-793-85-709-0,
see attached. I am concerned for Sarah’s well-being. Sarah is a vulnerable adult who is
unable to care for herself.

Attached you will find photos of a box and contents that appears to be evidence of drug
usage, including several syringes and a plastic bag containing a brown substance. I found
this box under the mattress Sarah Thompson was using at my home in a spare room,
while clearing her stuff out of my home. I also found a combat knife, and what looks like
one round of live ammunition for an AK-47. Separately I also found a small glass bong,
and a syringe that looks like one I use to inject insulin for type 2 diabetes.

Since Jan-01-2020 at 12.30am Sarah has texted me from a different number: 352-257-
8641. Her old number was: 352-872-7666. On New Years eve Sarah texted me looking
for a place to stay claiming problems with her boyfriend "Matt" with whom she lived at
13155 SW 95th Street, Dunnellon, FL 34432. I picked up Sarah at Matt’s home on
January 1, 2020 at 12:58 AM with all her stuff. I gave Sarah temporary use of my spare
bedroom. I told Sarah that due to the foreclosure she/we may have to move soon if the
appeals are not successful. Sarah stayed here sporadically in June/July 2019.

Sarah has been coming and going from Oak Run without being stopped by the Envera
Security system. Sarah often walks because she does not have a vehicle or a driver’s
license. Sarah told me she walks unchallenged through the security gate or elsewhere in
Oak Run. (Walking on the main road is prohibited in Oak Run, and I have been stopped
when walking). Sarah also gained entry on January 2, 2020 in a large pick-up truck
driven by her brother Andrew. I allowed Andrew to sleep on the couch for the night. In
the past Sarah may have lived elsewhere in Oak Run with other people. Last night Sarah
said she stayed at her sister’s apartment on Ocala. I have not seen Sarah today.

This morning I texted Sarah about a missing car battery charger. I got a reply from
someone else who is using Sarah’s phone: 352-257-8641. Then a man called from 352-
257-8641, it may have been Matt. Whoever has Sarah’s phone 352-257-8641 does not
appear to know who I am. Then I got two texts that Andrew was in a bad car crash and in
the hospital in a coma. When I asked what hospital, the response was "Car accident".

Sarah may have a key to my home. I changed locks last time, but my spare key is missing
from its hiding place. I placed her belongings on the patio under cover of the patio roof. I
do not want Sarah in my home.

On January 2, 2020, Sarah produced a garage door opener that looks like the one I
accused Michelle Ogurek of taking on October 9, 2019. Sarah said she found the garage
door opener under a chair in the spare room, the same room where Michelle Ogurek
stayed. When I started to question Sarah in detail about how she found the garage door
opener, Sarah became very defensive and refused further discussion. For the record, I
searched the same chair looking for the garage door opener on October 9, 2019 and

thereafter and did not find it. The chair is a small recliner. Michelle Ogurek claimed she
left the door opener on a chair in my home.

Among other things, I am concerned that the real purpose of Sarah’s recent contact was
to "find" the garage door opener I accused Michelle Ogurek of taking on October 9,
2019. This in turn might benefit certain MCSO deputies, and may even benefit Sheriff
Billy Woods.
Sarah’s drug box and some legal papers are on a desk in the spare room. The rest of
Sarah’s stuff is on the patio under the covered portion. Please advise how you want to
proceed. Again, I am concerned for Sarah’s well-being. Sarah is a vulnerable adult who
is unable to care for herself.

19. My email at Exhibit 3 established just cause for the sake of mandatory reporting under

section 415.1034(1)(a)5 by a state, county, or municipal criminal justice employee or law

enforcement officer, that Sarah was a vulnerable adult leaving domestic violence of Matthew

Smith (Matt), 13155 SW 95th Street, Dunnellon, FL. I know from past experience (the case of

H.K.) that the Florida Department of Children (DCF) only takes phone calls of mandatory

reporting, and often ignores ordinary people like me who call. That is why I reported this to the

local state, county, or municipal criminal justice employee(s) or law enforcement officer(s).

20. The foregoing established negligence per se against the defendants other than Sarah. The

defendants under section 415.1034(1)(a)5 who were a state, county, or municipal criminal justice

employee or law enforcement officer, had a mandatory duty to report Sarah to DCF.

21. Negligence per se. Florida Freight Terminals, Inc. v. Cabanas, 354 So. 2d 1222 (Fla.

Dist. Ct. App., 3d Dist. 1978) held that proof of the defendant’s violation of a statute or

regulatory provision that either is designed to protect a particular class of persons from their

inability to protect themselves or establishes a duty to take precautions to guard a certain class of

persons from a specific type of injury, establishes negligence per se.

22. I lack the skills, experience and training to assist Sarah with her many issues as a

vulnerable adult: Unemployment, homelessness, drug addiction, violence and mental illness.

23. Eggshell skull rule. Doctrine that makes a defendant liable for the plaintiff's

unforeseeable and uncommon reactions to the defendant's negligent or intentional tort. If the

defendant commits a tort against the plaintiff without a complete defense, the defendant becomes

liable for any injury that is magnified by the plaintiff's peculiar characteristics.

UNLAWFUL DETAINER

24. I have resided in the property continuously and uninterruptedly since February 9, 2005,

located at 8092 SW 115th Loop, Ocala, Florida 34481, Marion County, legal description:

25. Sarah does not have a lease to live on the property. Sarah never completed a rental

application with me.

26. Sarah did not pay rent of any kind to live on the property. Sarah refused to compete an

employment application. Sarah refused to complete Form I-9, Employment Eligibility

Verification, Department of Homeland Security. Sarah refused to complete IRS Form W-9,

Request for Taxpayer Identification Number and Certification.

27. In my view Sarah is too disabled to work. I suggested she apply for Social Security

disability, and obtain a home through the Marion County down-payment assistance program.

28. Sarah is not related to me.

29. Sarah never had a romantic relationship with me.

30. Sarah did not reside on the property on April 1, 2020, a date critical to the U.S. Census

2020. Exhibit 4.

31. I reside in the Oak Run, a gated 55+ community with security by Envera Systems. On

June 7, 2020, the following names appeared on my Envera Systems visitor list of person

permanently denied entry.

32. On or about the third week of June 2019, Sarah met a man online and entered a romantic

relationship with him: Matthew Smith (Matt), 13155 SW 95th Street, Dunnellon, FL. Sarah left

my home and moved in with Matt Smith on or about July 14, 2019. Sarah did not return to my

home in 2019.

33. During the month Sarah lived in my home (Jun-15-19 through July 14-19) she spend

most days and nights away at another location. Sarah used my home as a storage unit.

34. Sarah contacted me on or about January 1, 2020 to get way from domestic violence by

Matt Smith. I let her stay in my home in a small covered patio room. About a week later Sarah

made amends with Matt Smith. By the middle of January 2020 Sarah was staying elsewhere, but

had left some belongings behind, which I eventually put in storage at Storage Depot of Ocala,

9085 Southwest Highway 200, Ocala, FL 34481.

35. I obtained a MCSO Trespass Authorization against Sarah on January 13, 2020 that

appears at Exhibit 5. The MCSO has refused to enforce the trespass.

36. Sarah was arrested by the Marion County Sheriff’s Office (MCSO) on February 6, 2020,

case no. The MCSO booking information appears at Exhibit 6 and shows Sarah’s city is

NEWPORT RICHEY FL 34652. Sarah was charged as follows:

37. A stolen tag was alleged to have been used in Sarah’s crime described above. Marion

County Incident Report MCSO19OFF028747 (Exhibit 7) shows Sarah is a subject in the crime.

38. Defendant Brad King, State Attorney for the Fifth Judicial Circuit, and Defendant Office

of The State Attorney Fifth Judicial Circuit Florida, filed “Announcement of No Information” on

March 3, 2020 in Sarah’s felony drug arrest February, Exhibit 8, 42-2020-CF-000516-CFAXXX.

39 The “Announcement of No Information” by Defendants Brad King and the SA Office is

evidence that Sarah is assisting the authorities in their long-standing vendetta against me.

40. As a courtesy to Patricia Thompson (mom) during the family medical crisis of Andrew’s

drug overdose, I gave Sarah a 30 day only written house guest agreement from January 14, 2020

through February 13, 2020. Exhibit 9. On January 21, 2020 I gave Sarah “NOTICE OF

VIOLATION House Guest Agreement”. Exhibit 10.

41. Sarah contacted me on or about March 10, 2020 stranded at the Pilot Truck Stop at I-75

and CR 484. When I picked her up, I found Sarah cold and hungry, with her belongings in a

shopping cart. Sarah stayed in my small covered patio room until March 13 or so, when she

exploded in anger, assaulted me, and left, a voluntary move-out.

42. On information and believe, Sarah got a house-sitting gig in Dunnellon from the end of

March 2020 through April 28, 2020. Sarah provided me with this address: 9653 SW 130th Ave.,

Dunnellon, FL 34432. However the address does not appear in a search of the Marion County

Property Appraiser online website, suggesting the address is confidential for use by Sarah as a

confidential person, and evidence that Sarah is assisting the authorities in their long-standing

vendetta against me. On April 10, 2020 I emailed the Marion County Property Appraiser, “Why

On April 1, 2020 Gov. DeSantis issued Executive Order #20-91, Essential Services and
Activities During COVID-19 Emergency that required, inter alia, Florida residents to
remain at home, and to wear a mask or respirator while in pubic places for essential

Sarah is skeptical about COVID-19 and has not complied with any of the orders or

What legal protections do I have while living under the same roof with Sarah, who is
skeptical about COVID-19 and has not complied with any of the orders or
recommendations?

On the night of May-07-2020 through May-08-2020 Sarah had two visitors but refused to
discuss this with me. One visitor, perhaps with ties to Oak Run, appeared in my driveway
for Sarah. The other visitor came to my attention when I was awakened at 2:29 AM by a
phone call from Envera Systems security announcing that Jeremiah Young was here to
visit Sarah. See attached a PDF of the email from Envera Systems.

I do not recall to what extent I discussed COVID-19 and these visitors with Deputy T.
Marton (5743) and MCSO Deputy Pope (6377) on May-08-2020 who arrived to assist
me. Perhaps the public records for Case No. 2005080039 will show my discussion, if
any.

Currently Sarah has a pile of clothing and belongings strewn in my garage, see the
attached photos. I believe this clothing may represent a COVID-19 risk by contamination

47. On or about May 8, 2020 Sarah dismantled my small covered patio room in the presence

of MCSO Deputy T. Marton. The Deputy said it was her right to knock down the partition wall,

etc. Soon Sarah was upset that she had dismantled her room.

50. On the evening of May 16, 2020 Sarah left my home, and did not return until June 7,

2020 on the premise of renting a storage unit and move her stuff.

Yesterday afternoon I recovered my HP laptop computer with the assistance of


Dunnellon Police Officer E.J. Raines while at the intersection of CR484 and Rt. 40 at the
Circle K store.

Just prior Sarah Thompson and me drove to where her sister Johanna was staying, 10242,
NE 107th St. Road, Dunnellon, the home of Clinton Hearon. I believe Sarah essentially
entered the home without permission and took stuff, including my computer, which was
hidden among other things she took. Now Sarah demanded a ride to a motel in Dunnellon
(to get drugs) or I would not get the computer back. During the entire drive to the motel
Sarah was getting more aggressive and violent. Finally I stopped my vehicle on the road
hoping a cop would drive by. Then I noticed two cops on a traffic stop at CR 484 and Rt.
40. I drove to them and said Sarah would not give me my computer that was reported
stolen to the MCSO. Sarah immediately gave me the computer, exited the vehicle, and
began walking down Rt. 40 toward the motel. I asked one cop about the pile of stuff she
left behind, and he said she abandoned it, so now her belongings were mine to dispose of
as I wanted. I tried to return the belongings to Sarah at the Dinner Bell Motel, 12094 S
Williams St, Dunnellon, FL 34432, but she refused, and entered a room on the first floor
of the motel.

I returned home with my computer around 3:30pm, and started looking for a storage
place to put her abandoned property. But as I was doing that, Sarah’s sister Johanna
appeared at my door looking for her stolen property. Because Officer Raines said I could
dispose of Sarah’s abandoned property, I let Johanna and her Clinton look for and take
their stuff back. By then it was too late to finish the rental process for the storage unit,
Neighborhood Storage 6785 SW Highway 200 in Ocala, where I have a 5x10 indoor
climate controlled unit on hold for a $15 deposit. Today I planned to move Sarah’s
belongings, as she agreed to yesterday, to the storage unit, which I agreed to pay the first
month as her birthday present.

Late this morning I am getting angry emails and phone calls from Sarah, who refused to
wait for my email response. Sarah said she is on her way to my home, where I told her
she is not welcome. I have a notarized trespass for Sarah Thompson, see attached. I want
Sarah arrested for the theft of my HP laptop computer, and trespassed from my home.

her belongings, she wanted to take her property shipped to a storage unit she found at U.S.

Storage Center, 2853 S. Pine Ave., Ocala FL 34481. (Exhibit 19). I agreed to this change by

email at Saturday, June 06, 2020 6:43 PM, because “the ultimate cost of shipping is likely $300-

$500” and recovery of the cost was unlikely. (Exhibit 20)

54. On June 6, 2020 at 9.40 PM I sent a text message to Sarah asking if she needed a ride. (to

move her stuff, she does not have a driver’s license)

55. Sarah telephone me June 7, 2020 at 1:27 AM from 352-320-9729 wanting a ride from

9653 SW 130th Ave., Dunnellon, FL 34432. As I approached the location, I got another call

from Sarah around 1:42 AM and 1:45 AM telling me to meet her at 95th, which is the street

where Matt Smith, her boyfriend lived.

56. I assumed Sarah wanted my help with the storage unit and moving her belongings. She

knows that as a matter of policy I will not live with a woman unless it is an intimate relationship

leading to marriage. And Sarah made it very clear she does not want such relationship with me.

Furthermore, I am not a landlord and I do not want a tenant.

57. Sarah and me arrived at my home around 2:00 AM. She spent some time in the garage

looking at her belongings, which have been there since May 16, 2020.

58. By 4:00 AM or so I found Sarah in the bathroom on her phone. She had called the

MCSO, and tried to establish residency by claiming I made some kind of pass at her.

59. When the MCSO arrived, including Deputy Austin, I overheard Sarah say she got in a

fight with her boyfriend (Matt Smith) and was kicked out of his home at 13155 SW 95th Street,

Dunnellon, FL. So it appears Sarah came to my home to establish tenantancy, not to get her

belongings as she claimed. Deputy Austin said she established tenantancy. I made it very clear to

Austin that “I never fucked her”. There is only one bed in the home, my bed.

60. Sarah also knows that as a matter of policy I do not want devices or smart phones used in

my home which are a security threat in my home office. When I noticed her smart phone on

charge in the garage, I secured the phone in my home. As I was doing this, Sarah began

screaming and assaulting me. I responded in self-defense.

61. Sarah smashed a large glass sliding door in my home, she smashed a window in the

garage, she took off the doorknob to my kitchen entry door, and trashed the inside of my

property looking for her smart phone. Then Sarah turned off my electricity at the circuit breaker

several times. Officers of the MCSO condoned all of this destruction and interruption of utilities.

62. Tellingly each MCSO officer cited the decision by Deputy Austin that Sarah is a tenant,

to allow her destruction of my property. On January 30, 2020 I made a federal civil rights

complaint against Deputy Nicholas Austin (5425P), see Exhibit 21. I believe Deputy Austin has

a vendetta against me in revenge, and working under the direction of Lt. Charles Welch of the

SW District, who I have called out for corruption. Lt. Welch has been in contact with Sarah.

Emails between Lt. Welch and Sarah show she planned to move her belongings to a storage unit,

or elsewhere off my property, and that Sarah wanted to get away from me. Exhibit 22.

63. For a man’s house is his castle. —Sir Edward Coke, Third Institute (1644).

The maxim that a "man's house is his castle" is one of the oldest and most
deeply rooted principles in Anglo-American jurisprudence. It reflects an egalitarian
spirit that embraces all levels of society down to the "poorest man" living "in his
cottage." The maxim also forms part of the fabric of the Fourth Amendment to the
Constitution, which protects people, their homes, and their property against
unreasonable searches and seizures by the government. (Exhibit 23).

The Defendants, other than Sarah, the state, county, or municipal criminal justice employees or

law enforcement officers, have been trying to steal my home on a corrupt foreclosure since 2013,

in violation of due process (Art. I, sec 9, Fla Const.; Amend. V, U.S. Const.; Amend. XIV, sec 1,

U.S. Const.), in violation of Amend. IV, U.S. Const., right of the people to be secure in their

homes, and their property against unreasonable searches and seizures by the government; and by

Fraud upon the Court.(Exhibit 24).

64. As I write this pleading, I hear pounding on my door and window. I am in fear of my life.

WHEREFORE, Plaintiff demands judgment for sole possession of the property and

actual damages against Defendant Sarah May Thompson. Plaintiff demands judgment for

damages, punitive damages and special damages against the remaining Defendants under the

Constitution and laws of Florida, and the Constitution and laws of the United States, for

home foreclosure (2013-CA-00115). I have no faith in the UDEST or DCF. I do not want to report Sarah
to L.E. (I support legalizing drugs). But I may not be the best person to help Sarah. I am aware she placed
a newborn for adoption in 2015. She arrived at my door the result of mistaken identity through a website.
Initially Sarah seemed nice, and she needed a place to stay. I felt compassion for a homeless, unremarried
widow. And it is difficult for a single man age 63 with health issues and limited income to find competent
help. Previously two other providers did not work out, one age 40 (drugs) and one age 43
(drinking/smoking).

Currently Sarah has a broken tooth that needs extraction, but she refuses medical treatment I found, see

This concerns Sarah May Thompson, a white female, 5’5", DOB June 9, 1985 (age 34), single, brown hair, slim, no driver’s license, but has a Florida ID #T512-793-85-709-
0, see attached. I am concerned for Sarah’s well-being. Sarah is a vulnerable adult who is unable to care for herself.

Attached you will find photos of a box and contents that appears to be evidence of drug usage, including several syringes and a plastic bag containing a brown substance. I
found this box under the mattress Sarah Thompson was using at my home in a spare room, while clearing her stuff out of my home. I also found a combat knife, and what
looks like one round of live ammunition for an AK-47. Separately I also found a small glass bong, and a syringe that looks like one I use to inject insulin for type 2 diabetes.

Since Jan-01-2020 at 12.30am Sarah has texted me from a different number: 352-257-8641. Her old number was: 352-872-7666. On New Years eve Sarah texted me looking
for a place to stay claiming problems with her boyfriend "Matt" with whom she lived at 13155 SW 95th Street, Dunnellon, FL 34432. I picked up Sarah at Matt’s home on
January 1, 2020 at 12:58 AM with all her stuff. I gave Sarah temporary use of my spare bedroom. I told Sarah that due to the foreclosure she/we may have to move soon if the
appeals are not successful. Sarah stayed here sporadically in June/July 2019.

Sarah has been coming and going from Oak Run without being stopped by the Envera Security system. Sarah often walks because she does not have a vehicle or a driver’s
license. Sarah told me she walks unchallenged through the security gate or elsewhere in Oak Run. (Walking on the main road is prohibited in Oak Run, and I have been
stopped when walking). Sarah also gained entry on January 2, 2020 in a large pick-up truck driven by her brother Andrew. I allowed Andrew to sleep on the couch for the
night. In the past Sarah may have lived elsewhere in Oak Run with other people. Last night Sarah said she stayed at her sister’s apartment on Ocala. I have not seen Sarah
today.

This morning I texted Sarah about a missing car battery charger. I got a reply from someone else who is using Sarah’s phone: 352-257-8641. Then a man called from 352-
257-8641, it may have been Matt. Whoever has Sarah’s phone 352-257-8641 does not appear to know who I am. Then I got two texts that Andrew was in a bad car crash and
in the hospital in a coma. When I asked what hospital, the response was "Car accident".

Sarah may have a key to my home. I changed locks last time, but my spare key is missing from its hiding place. I placed her belongings on the patio under cover of the patio
roof. I do not want Sarah in my home.

On January 2, 2020, Sarah produced a garage door opener that looks like the one I accused Michelle Ogurek of taking on October 9, 2019. Sarah said she found the garage
door opener under a chair in the spare room, the same room where Michelle Ogurek stayed. When I started to question Sarah in detail about how she found the garage door
opener, Sarah became very defensive and refused further discussion. For the record, I searched the same chair looking for the garage door opener on October 9, 2019 and
thereafter and did not find it. The chair is a small recliner. Michelle Ogurek claimed she left the door opener on a chair in my home.

Among other things, I am concerned that the real purpose of Sarah’s recent contact was to "find" the garage door opener I accused Michelle Ogurek of taking on October 9,
2019. This in turn might benefit certain MCSO deputies, and may even benefit Sheriff Billy Woods.

Sarah’s drug box and some legal papers are on a desk in the spare room. The rest of Sarah’s stuff is on the patio under the covered portion. Please advise how you want to
proceed. Again, I am concerned for Sarah’s well-being. Sarah is a vulnerable adult who is unable to care for herself.

GENERAL AT 13415 SE 47TH AVENUE IN REFERENCE TO A SUSPICIOUS INCIDENT.

UPON OUR ARRIVAL, WE SPOKE TO A COUPLE OF THE EMPLOYEES, WHO ADVISED


THAT AN UNKNOWN MALE WAS IN THE PARKING LOT “REVVING UP HIS ENGINE” AND
HONKING THE HORN IN THE PARKING LOT AFTER HOURS. THE EMPLOYEES ADVISED
HE STOOD AT THE FRONT DOOR FOR APPROXIMATELY FIVE MINUTES, JUST STARING
INTO THE BUSINESS. AFTER HE WALKED AWAY FROM THE DOORS, THE EMPLOYEES
HEARD A LOUD BANGING NOISE COMING FROM THE PARKING LOT, LATER FOUND TO
HAVE BEEN THE SOUND OF THE WINDOWS OF THE VICTIM'S VEHICLE BEING BROKEN.

I OBSERVED THE SILVER TOYOTA CAMRY IN THE END OF THE PARKING LOT WITH
BOTH DRIVER SIDE WINDOWS BUSTED OUT ALONG WITH THE BACK WINDSHIELD AND
REAR PASSENGER SIDE WINDOW. THE VEHICLE DID NOT HAVE A LICENSE PLATE
ATTACHED TO IT AND HAD HEAVY FRONT END DAMAGE.

91ST AVENUE, WHERE THE VEHICLE WAS REGISTERED TO.

UPON OUR ARRIVAL, WE MADE CONTACT WITH THE OWNER’S DAUGHTER, VICTIM
STEPHANIE REID, WHO ADVISED THE VEHICLE WAS INVOLVED IN AN ACCIDENT A
FEW WEEKS AGO AND WAS LEFT AT THE DOLLAR GENERAL WITH THE BUSINESSES
PERMISSION. THE VICTIM ADVISED THAT HER MOTHER, JUNELLE ANTHONY, PASSED
AWAY A RECENTLY AND THAT SHE COULD NOT GET THE VEHICLE TOWED DUE TO IT
BEING IN HER MOTHER’S NAME. THE VICTIM ADVISED THE WINDOWS IN THE VEHICLE
WERE ALL INTACT AND THE LICENSE PLATE WAS ATTACHED WHEN SHE LAST SAW
THE VEHICLE. THE VICTIM WISHED TO HAVE THE THEFT OF THE LICENSE PLATE AND
CRIMINAL MISCHIEF INVESTIGATED. THE DAMAGE CAUSED TO THE VEHICLE AFTER
THE ACCIDENT IS ESTIMATED AT $500.

THE VIDEO FROM THE DOLLAR GENERAL WAS NOT IMMEDIATELY AVAILABLE AS THE
BUSINESS HAD CLOSED FOR THE EVENING. WE WILL FOLLOW-UP WITH OBTAINING
VIDEO FOOTAGE DURING THE NEXT TOUR OF DUTY.

I CHECKED THE SECURITY VIDEO, WHICH ONLY CAPTURES FOOTAGE INSIDE THE BUSINESS.
I OBSERVED A MALE WEARING A GREY HOODIE WALK UP AND STAND AT THE FRONT DOOR
ATTEMPTING TO LOOK INSIDE THE BUSINESS DURING THE TIME OF THE INCIDENT.

I LATER NOTIFIED THE VICTIM, STEPHANIE REID, OF THE SECURITY FOOTAGE AND ADVISED
HER I WOULD ATTEMPT TO IDENTIFY THE SUSPECT AND MAKE CONTACT WITH HIM.

UPON FURTHER REVIEW OF THE VIDEO FOOTAGE, I FOUND THE VIDEO QUALITY IS SO
POOR, IT IS DIFFICULT TO DETERMINE EVEN THE RACE OF THE SUBJECT AT THE DOOR AND
FAR TOO POOR OF QUALITY TO ESTABLISH A POSSIBLE IDENTITY.

WHILE CONDUCTING ROUTINE PATROL IN THE 7600 BLOCK OF SW 129TH TERRACE ROAD, I
OBSERVED A WHITE 1999 FORD STATION WAGON WITH VIN 1FAFP58U5XA193007 AND
HAVING THE STOLEN FLORIDA LICENSE PLATE "Z25OJF" ATTACHED TRAVELING NORTH
BOUND. I CONDUCTED A COMPUTER SEARCH ON THE TAG WHICH REVEALED THE LICENSE
PLATE HAD BEEN REPORTED STOLEN OUT OF THIS AGENCY AT WHICH TIME I CONDUCTED
A TRAFFIC STOP ON THE VEHICLE. I MADE CONTACT WITH THE VEHICLE DRIVER, MARC
SMITH, AND FRONT SEAT PASSENGER, SARAH THOMPSON, AND ADVISED THEM OF THE
REASON FOR THE TRAFFIC STOP.

BOTH MR. SMITH AND MS. THOMPSON DENIED ANY KNOWLEDGE THE LICENSE PLATE HAD
BEEN STOLEN AND DENIED ATTACHING THE LICENSE PLATE TO THE VEHICLE. BOTH MR

House guest agreement

This house guest agreement is between Neil J. Gillespie (Gillespie), the homeowner in
fact, and Sarah Thompson (Sarah), a house guest. Henceforth in the first person by Gillespie:

1. Sarah is a house guest of Neil J. Gillespie, not a tenant. I am providing Sarah a free room from
January 14, 2020 through February 13, 2020, so long as I live here. My home is in foreclosure.

2. The room is located in my home in the Oak Run Country Club, a 55+ community, located at
8092 SW 115th Loop, Ocala, FL 34481. The room faces the courtyard, and has sliding doors.

3. Includes free heat and air conditioning, free WiFi, free water and sewer, free trash ren10val.

4. The room is furnished with a full size bed with box spring and frame, full length curtains,
Berber carpet, a large mirror, and a built-in closet with a 2 drawer night stand, and use of a
furnished outdoor courtyard. A new composting toilet is in the room for emergency use. Sarah
must provide her own bedding (sheets, blankets, pillows, etc.), and towels.

5. No smoking indoors. Smoking is only permitted outdoors in the outdoor courtyard.

6. No illegal drug use. No sex-worker activity. All criminal activity is prohibited, including theft.

7. No visitors other than family. Matthew Smith is banned; the woman "Frankie" is banned.

8. Sarah must provide her own food, hygiene products, and laundry soap. Sarah may have shared
kitchen privileges during the hours I an1 home, which is most of the time. Likewise with use of
my washer and dryer, and use of the shared n1aster bathroom shower and toilet.

9. Access to the room is through the open courtyard and sliding door. Access to my home is
limited to the hours I am home, which is most of the time. Otherwise my home and garage is
locked. I no longer provide keys to my home because of past theft by former house guests.

10. Access to Oak Run is governed by Envera Systems security. I meet visitors at the gate, and
escort them to my home. In the past I used a visitor list, but that did not work out.

11. Sarah is responsible for keeping her roon1 clean and orderly, washing her dishes after meals,
and cleaning the common areas she uses, such as the shower and outdoor courtyard.

12. If Sarah does not personally occupy the room, this agreement becomes void after her absence
of seven (7) days or more. Any personal property left will be put in storage at Sarah's expense.

NOTICE OF VIOLATION is provided to Sarah Thompson (Sarah), of her violation of a
house guest agreement with Neil J. Gillespie (Gillespie) in the following particulars. A signed
copy of the agreement appears at Exhibit 1. Henceforth in the first person by Gillespie:

1a. Sarah violated paragraph 7 of the agreement that states: “No visitors other than family.
Matthew Smith is banned; the woman “Frankie” is banned.”

1b. Sarah violated paragraph 10 of the agreement that states: “Access to Oak Run is governed by
Envera Systems security. I meet visitors at the gate, and escort them to my home. In the past I
used a visitor list, but that did not work out.

On January 18, 2020 Sarah violated paragraph 7. I confirmed with Envera Systems
Supervisor TJ Quinones that Sarah facilitated entry to Oak Run at 9:19 PM through the
west gate to Matthew Smith in his Buick Rainier, Florida tag: 425-OQR.

On January 18, 2020 Sarah violated paragraph 10 by failing to meet me at the gate to be
escorted to my home.

On January 21, 2020 Sarah violated paragraph 7 by facilitating entry to Oak Run by the
woman “Frankie” and her vehicle, a white Buick Encore.

On January 21, 2020 Sarah violated paragraph 10 by failing to meet me at the gate to be
escorted to my home.

2. Sarah violated paragraph 11 of the agreement that states: “Sarah is responsible for keeping her
room clean and orderly, washing her dishes after meals, and cleaning the common areas she
uses, such as the shower and outdoor courtyard.”

Since January 14, 2020 to the present, Sarah’s room is a complete mess, and is not clean
and orderly. See the photos made by me on or about January 19, 2020 at Exhibit 2.

On January 14, 2020 I cleaned human feces Sarah’s left on the side of my home after she
defecated in a pink plastic bucket on January 13, 2020. Sarah said she could not access a
toilet in my home because my door was locked. My home has two toilets. Oak Run has
toilets for use by guests in its various offices, pools, gyms and clubs. In consideration, I
bought a composting toilet for Sarah’s room for emergency use. Exhibit 3.

Shortly after January 1, 2020 Sarah prepared a reminder to “Deep Clean Kitchen” and
other such. Exhibit 4. Sarah used the kitchen often when she lived here. Apparently Sarah
planned to deep clean the kitchen, which included the following details, but was never done.
• Take out rugs
• Sweep
• Mop
• Wipe counters - underneath
• Clean microwave
During dinner with me January 12, 2020 Sarah picked up the reminder to “Deep Clean Kitchen”
from the dining room table and tore it up. Sarah was unaware I had scanned the reminder.

3. Sarah violated paragraph 4 of the agreement that states in relevant part: “Sarah must provide
her own bedding (sheets, blankets, pillows, etc.), and towels.” As of today, Sarah has not
provided her own bedding, or used the bed, other than to pile her belongings on top. Sarah has
continued to use my towels when showering.

4. Sarah violated paragraph 6 of the agreement that states in relevant part: “All criminal activity
is prohibited, including theft.” A small Schumacher car batter charger, bought at Walmart for
$40 or so, is missing from my home since January 3, 2020.

5. Sarah violated paragraph 12 of the agreement that states: “If Sarah does not personally occupy
the room, this agreement becomes void after her absence of seven (7) days or more. Any
personal property left will be put in storage at Sarah’s expense.”

Sarah has not personally occupied the room from at least January 14, 2020 through January 21,
2020, a absence of seven (7) days. Therefore the agreement is void. Unless an understanding is
reached, Sarah’s personal property will eventually go into safe and secure storage at her expense.

Enforcement of The House Guest Agreement

6. I provided the House Guest Agreement to Sarah by email on January 16, 2020 at 11:25 PM.
On January 17, 2020 Sarah picked up a paper House Guest Agreement I left in her room. I also
provided the agreement to Sarah and her sister Johanna Cimpher by Facebook messenger.

7. Sarah had at least 24 hours to read and consider the agreement before she signed it January 18,
2020 in the evening, in my presence, in my home.

8. Sarah did not ask for any modifications to the agreement. I am not a lawyer. I failed to add
language concerning any breach or default under the agreement. I expected Sarah to act in good
faith and did not expect any major issues.

9. Sarah may cure her breach of the agreement as follows. Sarah must reaffirm her compliance
with the House Guest Agreement. Sarah may request, in writing, modification to the agreement.

Sarah is skeptical about COVID-19 and has not complied with any of the orders or recommendations

What legal protections do I have while living under the same roof with Sarah, who is skeptical about
COVID-19 and has not complied with any of the orders or recommendations?

On the night of May-07-2020 through May-08-2020 Sarah had two visitors but refused to discuss this
with me. One visitor, perhaps with ties to Oak Run, appeared in my driveway for Sarah. The other
visitor came to my attention when I was awakened at 2:29 AM by a phone call from Envera Systems
security announcing that Jeremiah Young was here to visit Sarah. See attached a PDF of the email from
Envera Systems.

I do not recall to what extent I discussed COVID-19 and these visitors with Deputy T. Marton (5743)
and MCSO Deputy Pope (6377) on May-08-2020 who arrived to assist me. Perhaps the public records
for Case No. 2005080039 will show my discussion, if any.

Currently Sarah has a pile of clothing and belongings strewn in my garage, see the attached photos. I
believe this clothing may represent a COVID-19 risk by contamination from Sarah and/or one of her
many social and intimate contacts. FYI, Sarah’s "Dolly-style" escort page shows it is active again, see

On Friday, May 15, 2020, while in my home, Sarah Thompson
said she heard a woman’s voice, and asked me about the
woman. Sarah and me were alone in my home. Sarah sat in a
chair in another room, with a view into my bedroom, and stared
at me as I worked on my computer writing an appellate brief,
and continued to ask about the woman. Sarah called me a liar for
not admitting to the presence of the woman. It appeared Sarah
was hallucinating. In the past, in June 2019, Sarah had a similar
hallucination.

Sheriff Woods:

Yesterday afternoon I recovered my HP laptop computer with the assistance of Dunnellon Police Officer
E.J. Raines while at the intersection of CR484 and Rt. 40 at the Circle K store.

Just prior Sarah Thompson and me drove to where her sister Johanna was staying, 10242, NE 107th St.
Road, Dunnellon, the home of Clinton Hearon. I believe Sarah essentially entered the home without
permission and took stuff, including my computer, which was hidden among other things she took. Now
Sarah demanded a ride to a motel in Dunnellon (to get drugs) or I would not get the computer back.
During the entire drive to the motel Sarah was getting more aggressive and violent. Finally I stopped my
vehicle on the road hoping a cop would drive by. Then I noticed two cops on a traffic stop at CR 484
and Rt. 40. I drove to them and said Sarah would not give me my computer that was reported stolen to
the MCSO. Sarah immediately gave me the computer, exited the vehicle, and began walking down Rt.
40 toward the motel. I asked one cop about the pile of stuff she left behind, and he said she abandoned it,
so now her belongings were mine to dispose of as I wanted. I tried to return the belongings to Sarah at
the Dinner Bell Motel, 12094 S Williams St, Dunnellon, FL 34432, but she refused, and entered a room
on the first floor of the motel.

I returned home with my computer around 3:30pm, and started looking for a storage place to put her
abandoned property. But as I was doing that, Sarah’s sister Johanna appeared at my door looking for her
stolen property. Because Officer Raines said I could dispose of Sarah’s abandoned property, I let
Johanna and her Clinton look for and take their stuff back. By then it was too late to finish the rental
process for the storage unit, Neighborhood Storage 6785 SW Highway 200 in Ocala, where I have a
5x10 indoor climate controlled unit on hold for a $15 deposit. Today I planned to move Sarah’s
belongings, as she agreed to yesterday, to the storage unit, which I agreed to pay the first month as her
birthday present.

Late this morning I am getting angry emails and phone calls from Sarah, who refused to wait for my
email response. Sarah said she is on her way to my home, where I told her she is not welcome. I have a
notarized trespass for Sarah Thompson, see attached. I want Sarah arrested for the theft of my HP laptop
computer, and trespassed from my home.

First, I will hold off shipping your belongings by UPS. If you consider the facts, you will see I acted
reasonably given the circumstances. Your email message omits a major part of the story. When you
initially asked me to bring your stuff to Johanna’s house, you had stolen my HP Laptop and you refused
to relinquish the computer. I was under no obligation to take your stuff anywhere. For legal reasons, that
is my final comment.

Now that the computer has been recovered, with the help of Dunnellon Police Officer E.J. Raines, I
want to conclude this matter with the removal of all your property from my home.

Attached is a receipt for $32.90 for boxes I bought to ship your belongings by UPS. I do not want to ship
your stuff if I can avoid doing so, because the ultimate cost of shipping is likely $300-$500. Any unpaid
balance may result in a lien against the property at 14445 SW 34th Terrace Road, which I understand
belongs to Johanna’s former husband.

You found a storage unit on S. Pine for $25 a month? Fine. Once you pay the rent on the unit, I will
bring your belongs. FYI, attached is a business card for MARION OAKS STORAGE. You can rent a
5x9 unit for $59 + a $35 deposit and a $5 one-time administrative fee, $99 to move in, with a special
rate of $1 for the second month. Please contact the location directly and make payment and other
arrangements.

To Law Enforcement, and Dr. Rivkees, Florida Surgeon General:

My name is Neil J. Gillespie, age 63. I have type 2 adult onset diabetes. This is my Civil Rights
and ADA Disability complaint for Walmart and the Marion County Sheriff’s Office. Walmart’s
ReliOn Novolin Human Insulin is literally my lifeline. Without it, I will become sick and die.

Walmart’s insulin is sold over the counter without a prescription for $24.88 per vial. I inject
insulin with a ReliOn Insulin Syringe, 1ml, 31 gauge, 8mm length, 100 in a box for $12.58.
I am a cash customer for insulin. I have Medicare but not Part D for prescription coverage.

On December 31, 2019 I planned to buy 1 vial of Novolin N type insulin from the Walmart
Neighborhood Market, 7855 SW State Rd 200, Ocala, FL 34476. I asked what time the
pharmacy closed, since it was New Years Eve, and I had to go get money for the purchase.
“Nori” at the store’s service center said the pharmacy was open to 9:00 PM, regular hours.
When I returned at 7:00 PM or so with money to buy insulin, the pharmacy was closed.

However the pharmacist and pharmacy employees were still in the pharmacy after it closed, but I
was not able to buy insulin. I contacted store manager Josh Mcadams, who essentially said tough
luck. When I asked for the name of the pharmacist, Mr. Mcadams refused to provide the name as
required by Florida Administrative Code (FAC) RULE: 64B16-27.100 Proof of Licensure;
Display of License; Pharmacist, Registered Pharmacy Intern and Registered Pharmacy
Technician Identification. Mr. Mcadams then threatened to call the Marion County Sheriff’s
Office unless I left the store without the identity of the pharmacist. The pharmacist, an older
white woman still in the pharmacy, also refused to identify herself when I asked. I left the store
thinking the early pharmacy closure without a sign, and a rude pharmacist, was an aberration.

FAC RULE: 64B16-27.100 Proof of Licensure; Display of License; Pharmacist, Registered


Pharmacy Intern and Registered Pharmacy Technician Identification, states:

“(1) Proof of licensure. Every pharmacist, pharmacy intern, and registered pharmacy
technician must maintain proof of current licensure such that it is readily retrievable upon
request by any representative of the Department or the Board or any member of the
public. The pharmacy may display the license or registration of each pharmacy employee
or alternatively, may display a notice easily accessible to the public that the license or
registration of each employee is available for viewing upon request.”

“(2) Identification. Every Pharmacist, Pharmacy Intern, or Registered Pharmacy


Technician must be identified by means such as a clearly visible identification badge or
monogrammed smock showing their name and if they are a pharmacist, pharmacy intern,
or registered pharmacy technician. In addition, all registered pharmacy technicians shall
state their names and verbally identify themselves as registered pharmacy technicians in
the context of telephone or other forms of communication.”

By closing early, the pharmacy was in violation of Florida Administrative Code Rule 64B16-
28.1081, Regulation of Daily Operating Hours. The relevant portion of the Rules states:

FAC Rule 64B16-28.1081 Regulation of Daily Operating Hours.

“Any person who receives a community pharmacy permit pursuant to Section 465.018,
F.S., and commences to operate such an establishment shall keep the prescription
department of the establishment open for a minimum of forty (40) hours per week. The
Board hereby approves exceptions to the requirements noted above and permits closing
of the prescription department for the following holidays: New Year’s Day, Memorial
Day, Fourth of July (Independence Day), Labor Day, Veterans’ Day, Thanksgiving,
Christmas and any bona fide religious holiday provided that notice of such closing is
given in a sign as set forth herein. A sign in block letters not less than one inch in height
stating the hours the prescription department is open each day shall be displayed either at
the main entrance of the establishment or at or near the place where prescriptions are
dispensed in a prominent place that is in clear and unobstructed view...”

The pharmacy could lawfully close on New Year’s Day, but not early on New Year’s Eve, and
not without posting the required sign giving notice of the closure. “A sign in block letters not
less than one inch in height stating the hours the prescription department is open each day shall
be displayed either at the main entrance of the establishment or at or near the place where
prescriptions are dispensed in a prominent place that is in clear and unobstructed view...”

Later I was informed about a small sign was affixed flat to the pharmacy counter, but it was not
in a prominent place that had a clear and unobstructed view. The sign was blocked by anyone
standing at the counter.

The pharmacy at the Walmart Supercenter, 9570 SW State Rd 200, Ocala, FL 34481, also closed
early on New Years Eve, without a sign, in violation of FAC Rule 64B16-28.1081.

As noted, I have type 2 adult onset diabetes. Walmart’s ReliOn Novolin Human Insulin is
literally my lifeline. Currently I use eight (8) vials of Novolin N type (long lasting) insulin per
month, and one (1) vial of Novolin R type (fast acting). Nine (9) total vials of insulin a month
costs $233.92 (9 X $24.88), plus $12.58 for a box of 100 1ml syringes, $18.95 for a box of 100
30/100 cc syringes (Publix) for use with R type insulin, several boxes of prep pads @ 2.00 each,
and test strips for my glucose meter. The total cost is about $280 a month, thanks to Walmart’s
ReliOn Novolin Insulin at $24.88 per vial. Similar insulin bought elsewhere, such as Publix, is
typically $150 per vial. I save about $1,116.00 a month with Walmart insulin ($233.92) over
Publix ($1,350). For me, there is no viable alternative to buying insulin at Walmart.

On January 1, 2020, I bought one (1) vial of ReliOn Novolin N type for $24.88, which was all I
could afford, from the Supercenter Pharmacy. The receipt for $24.88 appears at Exhibit 1.

On January 3, 2020, after getting paid, I went back to the Supercenter Pharmacy to buy more
insulin. Unfortunately, Walmart limits sales to four (4) vials of insulin a day per customer. My
receipt for $99.52 (4 vials) appears at Exhibit 2. The four (4) vial limit means a minimum of
three trips a month to the Walmart Pharmacy to get a month’s supply of nine (9) vials.

Although Walmart’s ReliOn Novolin Insulin is sold without a prescription, over the counter
(OTC), Walmart keeps its insulin in a refrigerator in the pharmacy. In order to buy Walmart’s
OTC insulin, a customer must wait in the same line as prescription customers at the store. That is
true at the Walmart Supercenter, and at the Walmart Neighborhood Market.

I usually shop for insulin at the Supercenter Pharmacy because the Supercenter is closer to my
home than the Neighborhood Market Pharmacy. On January 3, 2020, I made two trips to the
Supercenter Pharmacy to by insulin. My first trip was unsuccessful. The prescription waiting line
is standing-only, and the line was too long, and the service too slow, for me to stand. Usually
there is only one employee waiting on customers in the pharmacy. The line often backs up when
there are more customers than can be served by a single employee. There is no place for a
pharmacy customer to sit without loosing their place in line. So I left the Supercenter Pharmacy
without buying insulin, but I planned to return later in the day, hoping for a shorter line.

My second trip to the Supercenter Pharmacy on January 3, 2020 was around 7:00 PM. Again, the
prescription waiting line was backed-up. When it was my turn, I asked to purchase four (4) vials
of Novolin N type insulin, and one (1) vial of Novolin R type insulin. The pharmacy employee
refused, citing Walmart’s four (4) vial limit per customer per day. So I bought four (4) vials of
Novolin N type insulin. (Exhibit 2). Then I tried to buy a box of 100 ReliOn Insulin Syringes,
1ml, 31 gauge, 5/16 syringe (8mm) length, for $12.58, UPC 6 81131 31174 8. The Supercenter
Pharmacy employee said the syringe I requested was no longer available, and offered an
unacceptable substitute, a ReliOn 1ml, 31 gauge, 15/64 syringe (6mm). I know this is false
because the Neighborhood Market Pharmacy stocks ReliOn Insulin Syringes, 1ml, 31 gauge,
5/16 syringe (8mm) length, a box of 100. (Exhibit 3). For some reason the Supercenter Pharmacy
does not stock the syringe I need, then falsely says it is not available. This is an ongoing issue for
the past two years or so. To get the syringe I need requires a longer drive to the Neighborhood
Market Pharmacy. I tried to raise this issue with the Supercenter pharmacist on duty, but was not
able to speak with her, or even know her name as required by FAC RULE: 64B16-27.100.

The Supercenter Pharmacy has 5 customer service windows in a row along its counter:

The Supercenter Pharmacist on duty January 3, 2020 was a middle-age, white female, with
brown hair. The Supercenter Pharmacy does not comply with FAC RULE: 64B16-27.100. As I
recall, none of the pharmacy employees were properly identified. The Supercenter Pharmacy
claims to display the license or registration of each pharmacy employee, but in a room not open
to the public. The licenses or registrations appear to be posted on a wall, but the wall is in a room
closed to the public, and is only viewable from a distance through the Drop Off customer service
window. The viewing distance is so great that I could not read what was written on the alleged
licenses or registrations, so I do not know for certain what was actually displayed.

As I was attempting to identify the Supercenter Pharmacist on duty January 3, 2020, I was
approached by Renee Row, Walmart’s asset protection manager, and an unnamed white male
with tattoos. Renee Row refused to identify the pharmacist on duty as required by FAC RULE:
64B16-27.100. Ms. Row told me Walmart’s insulin was a “controlled substance”; it is not a
controlled substance. It soon became clear Ms. Row was ignorant about pharmacy matters.

Ms. Row did not comply with FAC RULE: 64B16-27.100. Instead, Ms. Row called the Marion
County Sheriff’s Office (MCSO) to have me removed from the store. I also called the MCSO.

Two MCSO deputies responded as shown on the attached Incident Detail Report, Incident
number: 2001030711. (Exhibit 4). The report shows the MCSO personnel assigned:

Deputy Bloom and Deputy Austin sided with Renee Row and Walmart, and refused to follow the
law established by FAC RULE: 64B16-27.100. Deputy Austin told me Walmart is a big
company and won’t do anything illegal. Deputy Austin is wrong: The Walmart Pharmacy is
required to display the license or registration of each pharmacy employee or alternatively, may
display a notice easily accessible to the public that the license or registration of each employee is
available for viewing upon request. Austin also said lying to law enforcement is not a crime.

Later on January 3, 2020, at 9:15 PM or so, I called back the MCSO with information about FAC
RULE: 64B16-27.100. A lady dispatcher said to expect call from Sergeant Blackurn or Sergeant
Levy, but no one called.

On January 26, 2020, I returned to the Supercenter Pharmacy to buy two (2) vials of ReliOn
Novolin N type. My receipt for $49.76 appears at Exhibit 5.

While at the Supercenter Pharmacy I noticed the Drop Off customer service window was shut,
thereby completely blocking the display of license or registration of each pharmacy employee.
The same unidentified pharmacist was on duty, so I handed her a copy of FAC RULE: 64B16-
27.100 when she was at the counter. (Exhibit 6). She read the rule without comment, but she
immediately sent another employee to raise the Drop Off customer service window that was
shut. Still, the display of license or registration of each pharmacy employee was unreadable.

• Disability accommodation at Walmart’s pharmacies to include selling OTC insulin at a
separate customer service window from prescription medication.
• Disability accommodation at Walmart’s pharmacies for seating that preserves place in line.
• Disability accommodation at Walmart’s pharmacies to stock popular size syringes.

• Disability accommodation at Walmart’s pharmacies to eliminate the four (4) vial limit per
person per day, and sell enough insulin to one person at one time for one month’s use.

Licensure; Display of License; Pharmacist, Registered Pharmacy Intern and Registered
Pharmacy Technician Identification.
• Request the Florida Department of Health enforce FAC RULE: 64B16-28.1081, Regulation
of Daily Operating Hours.

• Request the MCSO improve training for its deputies, i.e. Might is not always right.

So far this month I purchased $174.16 worth of insulin from Walmart’s Pharmacy:

The maxim that a "man's house is his castle" is one of the oldest and most

deeply rooted principles in Anglo-American jurisprudence. It reflects an egalitarian

spirit that embraces all levels of society down to the "poorest man" living "in his

cottage." The maxim also forms part of the fabric of the Fourth Amendment to the

Constitution, which protects people, their homes, and their property against

unreasonable searches and seizures by the government.

effects, against unreasonable searches and seizures, shall not be violated, and
no Warrants shall issue, but upon probable cause, supported by Oath or
affirmation, and particularly describing the place to be searched, and the
persons or things to be seized.

Amend. V, U.S. Const., due process

No person shall be held to answer for a capital, or otherwise infamous crime,


unless on a presentment or indictment of a Grand Jury, except in cases
arising in the land or naval forces, or in the Militia, when in actual service in
time of War or public danger; nor shall any person be subject for the same
offence to be twice put in jeopardy of life or limb; nor shall be compelled in
any criminal case to be a witness against himself, nor be deprived of life,
liberty, or property, without due process of law; nor shall private property be
taken for public use, without just compensation.

Amend. XIV, sec 1, U.S. Const., due process

All persons born or naturalized in the United States and subject to the
jurisdiction thereof, are citizens of the United States and of the State wherein
they reside. No State shall make or enforce any law which shall abridge the
privileges or immunities of citizens of the United States; nor shall any State
deprive any person of life, liberty, or property, without due process of law;
nor deny to any person within its jurisdiction the equal protection of the
laws.
Fraud Upon The Court

“Fraud upon the court is an egregious offense against the integrity of the

judicial system and is more than a simple assertion of facts in a pleading which

might later fail for lack of proof.” Wells Fargo Bank, N.A. v. Reeves, 92 So. 3d

249, 252 (Fla. 1st DCA 2012).

“The integrity of the civil litigation process depends on truthful disclosure of

facts. A system that depends on an adversary's ability to uncover falsehoods is

doomed to failure, which is why this kind of conduct must be discouraged in the

strongest possible way. . . . This is an area where the trial court is and should be

vested with discretion to fashion the apt remedy.” Cox v. Burke, 706 So. 2d 43, 47

(Fla. 5th DCA 1998).

"In Florida what constitutes 'Fraud upon the Court'." This occurs when, "...a

party has sentiently set in motion some unconscionable scheme calculated to

interfere with the judicial system's ability impartially to adjudicate a matter by

improperly influencing the trier of fact or unfairly hampering the presentation of

the opposing party's claim or defense." Cox v. Burke, 706 So.2d 43, 46 (Fla. 5 th

DCA 1998) (quoting Aoude v. Mobil Oil Corp., 892 F.2d 1115, 1118 (1 st Cir.

1989).

Whenever any officer of the court commits fraud during a proceeding in the

court, he/she is engaged in "fraud upon the court". In Bulloch v. United States, 763
F.2d 1115, 1121 (10th Cir. 1985), the court stated "Fraud upon the court is fraud

which is directed to the judicial machinery itself and is not fraud between the

parties or fraudulent documents, false statements or perjury. ... It is where the court

or a member is corrupted or influenced or influence is attempted or where the

judge has not performed his judicial function --- thus where the impartial functions

of the court have been directly corrupted." "Fraud upon the court" has been defined

by the 7th Circuit Court of Appeals to "embrace that species of fraud which does,

or attempts to, defile the court itself, or is a fraud perpetrated by officers of the

court so that the judicial machinery can not perform in the usual manner its

impartial task of adjudging cases that are presented for adjudication." Kenner v.

C.I.R., 387 F.3d 689 (1968); 7 Moore's Federal Practice, 2d ed., p. 512, ¶ 60.23.

The 7th Circuit further stated "a decision produced by fraud upon the court is not

in essence a decision at all, and never becomes final."

It is beyond question that a federal court may investigate a question as to

whether there was fraud in the procurement of a judgment. Universal Oil Products

Co. v. Root Refining Co., 328 U.S. 575, 66 S.Ct. 1176, 90 L.Ed. 1447. This is to be

done in adversary proceedings as in the case before us. See Hazel-Atlas Glass Co.

v. Hartford-Empire Co., 322 U.S. 238, 64 S.Ct. 997, 88 L.Ed. 1250; Sprague v.

Ticonic National Bank, 307 U.S. 161, 59 S.Ct. 777, 83 L.Ed. 1184; and United

States v. Throckmorton, 98 U.S. (8 Otto) 61, 25 L.Ed. 93.
