RECKLESS UNACCEPTABLE DAMAGES, IMPLIED IN VIEW OF PERSONAL INTEREST/

SABOTAGE

From date ----------- to ............ in total two weeks in SPAIN.

1. That the party Mr. Ali Orke was informed two months before the trip for his
responsibility and he confirmed to engage in his responsibility two days before the
trip and he was to arrive before my arrival in Spain for all arrangements
2. That two professionals were to travel with me and their ticket and hotel
accommodations were also to be arranged for 2 weeks, unfortunately only one was
available due to Mr. Ali’s internal arrangements to take a legal assistance in place of
my arranged O&M/EPC consultant with 30 years experiences.
3. The agenda in the case of Ali Oke and Dieter Suhrkampwas to be in Spain to witness
the signing of the commission Contract with the value of approx. 3 Million Euros, and
to witness an agreement with the new O&M contractor and the review of the EPC
engagement in the project , settle with the supplier not only for the commission area
but also for the required scope of works and interfaces needed in Indonesia for the
local contractor to issue the agreed Bank guarantee to our bank for engagement as
civil contractor EPCC.

Whereforestep one was the commission contract.

This was reviewed and signed, from the amount of this commission as to previous contract
with the Mr.Ali and Mr.Dieter their commitments will be honoured from the commission fee
payment will be due after the execution of the supply,the commission fees will be paid as to
agreement to the parties

The party Mr.Ali Orke came to Spain with a different agenda, to sabotage the entire business
his new wish is outside previously agreed contract agreement, he began with complications in
front of the supplier and the atmosphere was ruined with his agenda.
The disturbing agenda prevailed with further escalations that disturb me from concentrating
on the duties in Spain in the limited time frame.

1) There were several disturbing actions and personal embarrassment and harassment's in
front of the Companies we visited and other disturbing actions initiated by Mr. Ali.

Part of the disturbing actions were Conspiracy,Sabotage, By pass dealing like (given a
different business card to the president of the O&M company we were to sign an agreement
with (step 2 contract agenda) , He gave a business card different from the cooperate identity
we all represent in the project without me knowing , creating a serious confusing situation
drawn to my attention by the president of that O&M company for my clarification, few mines
before departure the office ( the president explain he said he is the investor and all
correspondent should go to him.
He did that without considering the offence of the statement without taken into consideration
of his company status in an EEC country and without taken into consideration he has no
US$150 Million in his account for the project.

2) The company call the supplier who signed the commission Contract witness a very
disturbing unity between our group after signing of the commission contract during Dinner
invitation this imposed further sabotage attempt, and disunited team after the commission
was signed and he commented even before the business can start you guys are fighting, our
management distaste this view .

3) Forth going, a meeting was arranged by the supplier to meet with the O&M contractor of
the project for the first time,
The duties of Mr.AliOrkewas to arrange for all our hotel and cost in Spain which includes in
that city were the meeting will take place
This was not done by Mr Ali, we then asked the sales manager of the supply company to
please contact theO&M contractor to assist to make hotel reservation for us in his town,
which they did honoured.

4) We occupied the Hotel for three days and attended the first meeting with the supplier sales
manager and attended the second meeting our self to negotiate the contract and the company
invited us for our dinner We returned to finish the draft agreement between the intend O&M
contractor at this stage Mr.AliOrkewas busy with YouTube videos in the meeting I then
asked him to please go with the other team to review other aspect of the business during this
period he performed the unspeakable actions of Sabotage& By pass dealing

6) At the 3rd day we check out of the hotel and Ali refuse to Honour the payment of the hotel
which is his responsibility before going to Spain or confirm with the O&M company who to
honour the bills he simple said it is the duty of the O&M company to pay the bills, and refuse
to ask for approval,
I confronted him with this mistakes he disregarded my worries and the possible consequences
to his action.

I then wrote a mail to the President Director of the O&M Companyinforming him we have
checked out and the hotel bill is suggested to be on his company name, we will appreciate a
confirmation from him
if it is a problem we will re-emboss the hotel cost back to his company in our next meeting.

7) The following disturbing misconduct from, Mr, Ali continued in the hotel, in the car even
after he has been given what we wanted this continued till his date of departure back to
Germany, rendering all aspect of the intentions to Spain disorganised and on a stand still.

8) Mr.AliOrke left Spain without clearing the situation of the hotel bill, and did not proceed
to receiving a confirmation from the O&M contractor, confirming that the bill is acceptable
and will be paid by the company of theO&M contractor.

9) This disturbing situation of the hotel came to the knowledge of the sales Manager who
made the arrangement to the O&M Contractor
and from that date further meetings were stooped and every further steps previously agreed
were on stand still.

Ali Further actions - contempt:

Ali request was to make up his commission from Euro 300,000 to One Million Euro
(1,000,000.00 EUR) plus his company cost and other cost, i granted it under Durex to avoid
further stress or problems
Then he further requested for a payment order /standing instruction and wanted to present the
document to our supplier to sign the document.. I further told him the consequence of his
action if he chose to do sohe will completely put our achievements on a risk line

Itold him this request is a serious mistake and not acceptable.

He then said I should sign it and keep it, but after signing it he quickly took it to his custody,
and proceeded to do what I had advise him not to do therefore the consequences.

In accordance to our agreement all assistance, needed from me for the business venture will
be provided to me including finance,

I asked him if he is running from his obligations, and what the agenda behind his actions

He answered nothing his responsibility are clear and will continue if his request is granted.
Unfortunately none of this came to reality before I left Spain and after returning back to
Indonesia

The request was granted under Durexand his duties were still not in any form performed
thereafter

The responsibility after 300,000 EUR to 1 million EUR instead of 300,000 due previously to
him

Since returned back to Indonesia he has further more engaged in aggressive manner to avoid
his responsibilities.

With this summary

We Celekom herewith remind Mr.AliOrke to the following defaults and consequences below
1. Default in his responsibilities.
2. Obstruction of business.
3. Sabotage of business with personal agenda. 
4. Sabotage of commission. 
5. Sabotage of business relationship with our various suppliers and our O&M contractor.
6. Durex actions to receive commissions extremely above his entitlement, by
disregarding our signed contract agreement

Should the responsibility of the needed cost to put the damages in other and other cost are not
paid to us within 7 working days from today

The entire contracts previously and the ones signed under durex will be immediately
terminated due to the above misconducts

We reserve the rights to clams amount equal to the commission agreement and the clams
equal to the expected benefits expected to be derive from the declined contract with O&M
contractor or the cost to find a new contractor.

The amount of 5000 EURO due foro consulting aggangment cost has still not been paid by
Mr Alí even after several remindal to him was sent ,we are now sending him an oficial
remindal
