uo}OUTLINE OF AMENDMENTS TO THE ACT
‘Amendments to the Professional Engineers Act
2002 (the Act) were assented 24 April 2008
Message from the Chair Continuing Registration Requirements (CRR)
From 1 July 2008 registrants can meet CRR of the
‘Act by complying withthe requirements of an ap-
proved assessment entity or the Board's CRR
A full copy of the Act can be found on the following {which should be in ine with those of approved as-
link: http://www.legislation.qid.gov.au/legislin/ sessment entities). Thus, the Board would expect
currentpiprofenginA02.paf that a RPEQ would undertake a minimum of 50
hours of structured CPD per year in each area of
tengineering for which they are registered
Recent amendments to The Professional Engineers
Act 2002 received assent on 24 April 2008 and com-
menced operation on 1 July 2008.
In order to meet the objects of the Act, the Act has
been structured to ensure the community is provided
with current best practice in determining the appropri-
ate level of professional competence required to pro- "
vide safe and effective professional engineering ser- Registration Scheme
vices. In line with the co-regulatory approach taken
between professional engineering bodies and the
Asummary of amendments is outlined in this leaflet:
‘The Board recognizes that a number of engineers
work in a part-time capacity and the Board would
take this into consideration for individual cases.
“The Professional Engineers Act 2002 (the Act) is
based on a preferred approach for the regulation of
professional engineers by means of co-regulation ie
joint administration by the engineering profession and
a statutory governing body.
‘Through co-regulation, the Act can be kept current
with community and professional norms regarding
what constitutes an appropriate level of professional
competence to provide safe and effective profes-
sional services.
‘The main intent behind the recent amendments was
to more effectively harness the analysis continuously
occurring within the profession to determine and
document current expectations regarding profes-
sional competence and the process by which profes-
sional recognition should be certified.
Please take the time to read the leaflet carefully . If
you have any concems, queries or suggestions let
Us know as effective co-regulation relies on the ac-
tive engagement of professional engineers and the
community. The Board will continue to provide fo-
‘ums for discussion to ensure the effectiveness of
the Act.
Professor Elizabeth Taylor AO
Board, a new registration scheme in which one or
more professional engineering bodies can apply to
the Board for approval of their assessment scheme
was introduced on 1 July 2008.
Under the new scheme, professional engineering
bodies apply to the Board for approval of a scheme
to assess requirements for registration in any of the
approved areas of engineering. Approved bodies
will be known as Assessment Entities.
Registration
The Board will consider an assessment entity's
assessment of an engineer's qualifications and
experience along with the provisions of the Act as to
whether the applicant is fit to practice. Once
satisfied, the Board can then proceed to register a
suitably qualified engineer.
Areas of Engineering
‘Areas of practice for engineers have been removed
from the Professional Engineers Regulation 2003
and are now set out in the assessment
approved schemes. This amendment wi
flexibility in adding new areas of engineering
Audits
Il commence from 1 July 2010.
Fitness to Practice
Fitnoss to Practice provisions have been broadened
to enable the Board to request:
A.written report from the Police Commissioner
about the criminal history of an applicant.
That a registered engineer undergo a health
assessment if the Board reasonably believes
that the engineer is currently unable to prac-
tice due to the engineer's mental and physical
health
Amendments also allow for the Board to cancel a
RPEQ's registration such as:
Ifa health assessment has been requested
by the Board and the health assessment re-
port given to the Board is that the engineer is,
unable to competently or safely practice.
Ifa RPEQ has been removed from a register
from a non-government registration scheme
or in another jurisdiction in Australia or else-
where,
