Narration: (PREVIEW) Good Morning Everyone, we are here to witness the

moot court of the Bachelor of Science in Criminology 4-1. This case was based
on the Ted Bundy’s serial killing case which was happened in the United States
of America. His court trial was held in the Supreme Court of Florida, where his
case was first in the History of the United States of America that had been
nationally televised. Facts about Ted Bundy, he was a graduate of Psychology in
University of Washington and later on enrolled at Utah Law School. At the age of
28 his killing act was started, from year 1974 up to 1978. During those years 36
women was reportedly missing including a 12 year old girl named Kimberly
Leach her body was found mummified in the pig shed 6 weeks after she
reportedly missing. There are documentaries stated that Ted Bundy has a
psychological abnormalities, that he was necrophilia. What he was doing to his
victim was, he will killed them first before he sexually assaulted them.

In our presentation we adopted the case of Liza Levy one of Ted Bundy’s
victims where he live strong evidence resulting to sentence him of death by
electrocution.

Philippines vs. Bundy for the Violation of Article 248 of the Revised Penal Code

Prosecutor: For the Prosecution, your honor, I am Chester Cuarentas


appearing as the prosecutor under the direct and control supervision of the
Public Prosecutor

Judge: Please be seated. Is the accused present today?

Clerk: Yes your honor. Please approach the bench.

(accused stand)

Judge: Accused, do you have a lawyer? Or do you want the court to provide a
lawyer for you?

(defense will stand)

Defense: Your honor I am Atty. Mark Joseph Albuera, appearing as the defense
counsel of this case.

Judge: Please be seated.

Arraign the accused.

Clerk: Please move forward Theodoro Robert Bundy.

Clerk of court: You are the accused of Criminal case no. 68-135 entitled People
of the Philippines vs. Bundy and the information charged you of murder, modified
and penalized under Article 248 of the Revised Penal Code, committed as
follows:
The early hours of January 15, 1968—one week after his arrival in
Tagaytay—Bundy entered OC’s Chi Omega sorority house through a rear door
with a faulty locking mechanism. Beginning at about 2:45 a.m. He entered the
bedroom of 20-year-old Lisa Dela Torre and beat her unconscious, strangled
her, tore one of her nipples, bit deeply into her left buttock, and sexually
assaulted her with a hair mist bottle.

Judge: Do you understand the filing charge against you?

Ted: Yes, your honor.

Clerk: What is your plea?

Ted Bundy: Not guilty, your honor.

Clerk: The accused pleaded not guilty, your honor.

Judge: Let it be on the record that the accused pleaded not guilty for the crime
of Murder.

PRE-TRIAL

Clerk: For the Pre-Trial, All rise!

Regional Trial Court Branch 18 is now in session. Honorable Judge Mark


Anthony Panganiban presiding.

Judge: please be seated.

Call the case.

Clerk: The court is now in session. We call on case no. 68-135 People of the
Philippines vs. Bundy, Murder. This is a preliminary conference for the
identification of documents and exhibits to be presented by the parties,
verification of the photocopies thereof and for consideration of other matters
which may aid the disposition of the case. We are reminding both parties that no
evidence shall be presented and offered during trial other than those which has
been identified during the pretrial unless the court allows for good cause shown.

Atty. Chester Cuarentas do you intend to present any documentary evidence or


object evidence?

Narrator: Prosecutor Cuarentas presented the arrest report prepared by the


Tagaytay police station dated January 17, 1968 for comparison for the
photocopies and the original. The same where admitted by the accused and the
arrest report is mark as exhibit A, autopsy report of the victim mark as exhibit B,
dental examination of Ted Bundy marked as exhibit C, and the hair mist bottle as
exhibit D.

Clerk: So we have object evidence already marked as exhibit A, B, C, and D a


stipulation of fact. Is there any other matter which the party would like to present
in order to properly dispose of this case?

Prosecutor: None at this point, your honor

Counsel: No one, your honor

Clerk: How about the identity of the accused?

Counsel: We OATH that the person charged in the information under the name
of Mr. Theodore Robert Bundy is the same person charged before the court.

Clerk: As part of the proceedings let's discuss the civil aspect of this case. Is the
Private complainant asking for the reward of actual damages?

Prosecutor: No, my client does not wish to continue with the civil aspect.

Clerk: So the civil aspect of this case is now settled?

Prosecutor: Yes.

Counsel: Yes.
Clerk: If there is anything that both parties will like to present now for the
markings of evidence and stipulation of facts you may present it now to expedite
the proceeding.

The preliminary conference is now adjourned kindly sign both the minutes of
today's preliminary conference.

Philippines vs. Bundy, Murder.

Judge: is the prosecution ready?

Prosecution: Yes, your honor.

Judge: Is the defense ready?

Defense: Yes, Your honor.

Judge: May we now hear the statement of the prosecution.

Prosecutor: Thank you, your honor.

Accused, Theodoro Bundy, entered OC’s Chi Omega sorority house


through a rear door with a faulty locking mechanism, entered the bedroom of 20-
year-old Lisa Dela Torre and beat her unconscious, strangled her, tore one of
her nipples, bit deeply into her left buttock, and sexually assaulted her with a hair
mist bottle.

We will move that the accused is guilty beyond reasonable doubt. The
reason we ask here your honor, is the verdict of guilty. Thank you.

Judge: The defense would like to give an opening statement, I would like to
inform that the prosecution rests peace.

Defense: I would like to stay your honor on the case of People of the Philippines
vs. Ted Bundy. They were being accused of Murder. Wherein the only fact they
have is the bite marks. The reason we ask here your honor, is the verdict of
acquit.

Judge: Proceed with the prosecution, we were going with our first witness.

Prosecutor: Yes, Your honor. The prosecution would like to call on Mr. Alojado
on the witness stand.

(Alojado came in front)

(Interpreter assist Mr.Alojado)

Interpreter: Please raise your right hand and put your left hand on the top of the
bible. Then, repeat after me. I, (state your name). Swear to tell the truth, all the

Judge: Prosecutor, proceed.

Prosecutor: Thank you, your honor.


Direct Examination (POLICE: ALOJADO and PROSECUTOR)

Prosecutor: Please state your name.

PO3 Carlos Alojado: I’am PO3 Carlos Alojado police officer of Tagaytay, City.

Prosecutor: How long are you in the service?

PO3 Carlos Alojado: 12 years in the service Sir.

Prosecutor: Where were you on January 15, 1968?

Police: I’m in Tagaytay City Police station.

Prosecutor: What are you doing that time?

Police: I’m on my duty in our police station

Prosecutor: Is there anyone who called on January 15, 1968 at your police
station?

Police: Yes.

Prosecutor: Who is that person?

Police: Ms. Nita Alonte, your honor.

Prosecutor: What is the reason of Ms. Alonte calling to your police station?

Police: He called to our police station to report that she found her roommate
bathing in her own blood and saw a man unfamiliar that entering the basement
of their dormitory.

Prosecutor: Who is that person that Ms. Alonte saw?

Police: She described a man who has a resemblance with Ronnie Eng and
wearing a blue bonnet and with a baseball bat.

Prosecutor: What did you do after the arrival on the scene?

Police: We invited Ms. Alonte to the police station to get her statement and we
get all the necessary information and record it to our blotter book and to file a
proper complaint. We also mark the evidences we recovered.

Prosecutor: After the case has been filed what did you do next?
Police: We requested for warrant of arrest that will served to the accused upon
the approval of the warrant we immediately apprehend and chased the person of
interest and that is Mr. Ted bundy.

Prosecutor: What did Ted Bundy do when you arrested him?

Police: He tried to escape riding his car.

Prosecutor: Are you sure? That Ted tried to avoid you?

Police: Yes Sir.

Defense: Objection your honor the police is not telling the truth.

Judge: Sustained

Prosecutor: He asked not to have a counsel?

Police: That's right. Then he asked we turn off the recorder and no notes to be
taken.

Prosecutor: So this was off the record?

Police: He thoughts so surreptitious recording devices, but it malfunctioned.


That’s why that part of the tape cuts out.

Prosecutor: What part was that, detective?

Police: His confession

Prosecutor: What did he say in his confession?

Police: He said he was a vampire.

TED BUNDY: Objection! That’s a lie!

Judge: Ted

TED BUNDY: It’s narration in behalf of witness, Your Honor.

Prosecutor: Is he allowed to keep on talking your honor?

Prosecutor: That’s all your honor.


Judge: Okay, is the defense counsel ready for cross-examination?

Defense: Yes your honor.

Judge: Proceed

Cross Examination

Defense: After the accused turned over to your station did you even inform him
of his constitutional right?

Police: Yes Sir

Defense: Are you sure that the accused understand it?

Police: Yes Sir

Defense: I have no further question your honor.

Judge: Thank you Counsel. Is the prosecution would like to re-direct?

Prosecutor: No, your honor.

Judge: Mr. Witness you can go back to your seat.

Police: Thank you, your honor.

the witness stand.

DIRECT EXAMINATION OF THE SECOND WITNESS

Interpreter: Please raise your right hand and put your left hand on the top of the
bible. Then, repeat after me. I, (state your name). Swear to tell the truth, all the

Judge: Fiscal, proceed.


Prosecutor: Ms. Witness, can you please state your name, age and address?

Nita Alonte: I’m Nita Aonte, 21 years old; I currently living at the OC’s Chi
Omega dormitory.

Prosecutor: Can you tell to this honorable court, where were you on about 3
o'clock in the morning?

Nita Alonte: I was heading to our dormitory that time I was came from the party
just a few blocks away from our dormitory

Prosecutor: Can you tell us what did you saw when you reach your dormitory?
Can you narrate it?

Nita Alonte: It was about 3 am when I head back to our dormitory, when I saw a
man entering our basement he was holding a baseball bath and I assumed the
he was came from our room.

Prosecutor: Did you recognize the man you saw?

Nita Alonte: Yes

Prosecutor: Do you know her personally?

Nita Alonte: No Sir

Prosecutor: After you saw him what did you do?

Nita Alonte: I enter our room and I saw my friend Lisa bathing in her own blood.
I can’t even look at her in that situation, I can’t imagine how much she suffer
during those time. (Crying)

Prosecutor: What did you do next?

Nita Alonte: I called the police immediately and try to control my emotion.

Prosecutor: What else?

Nita Alonte: I phone call Liza’s mother to inform them about what happen to her
daughter.

Prosecutor: After you call the victim’s mother did the police arrived?

Nita Alonte: Yes

Prosecutor: What happen next?


Nita Alonte: I was invited by the police officers to get my statements on what I
saw.

Prosecutor: Did they ask you to describe the man you saw?

Nita Alonte: Yes Sir.

Prosecutor: Is the man you saw is here in the court room right now?

Nita Alonte: Yes Sir.

Prosecutor: Can you point that person?

Nita Alonte: (Pointing Ted Bundy) .

Prosecutor: Thank you Ms. Alonte, I have no further question Your Honor.

CROSS EXAMINATION

Judge: Is the defense would like to cross-examine?.

Defense: Yes your honor

Judge: Proceed

Defense: Thank you your honor.

Ms. Witness, did you say that you came from the party the day when the
victim found dead?

Nita Alonte: Yes, Sir.

Defense: Therefore you are drunk during that time?

Nita Alonte: We drink but I’m not drunk.

Defense: Just answer it by yes or no.

Prosecutor: Objection your honor the question is irrelevant!

Judge: Sustained

Defense: No further question your honor.

Judge: Is the prosecution would like to re-direct?

Prosecution: No, your honor


Judge: Ms. Witness you can now go back to your seat.

Prosecution: May we call on Ms. Dominguez she is survivor from Ted Bundy’s
murderous act. Your honor our witness is suffering from permanent deafness of
her left ear.

Direct Examination

Prosecutor: Ms. Dominguez please state your full name, age and address.

Ms. Dominguez: I am Ms. Dominguez 21 yrs old, single, I’m OC law school
student I live at Blk. 10 Olivarez, Tagaytay City. Two blocks away from OC’s Chi
Omega sorority house. (Interpreter)

Prosecutor: Where were you on January 15, 1968?

Ms. Dominguez: I was staying in our house. (Interpreter)

Prosecutor: Can you narrate to us what happened to you at around 2:45


midnight?

Ms. Dominguez: I was in my room I suddenly hear footsteps and in just a second
someone hit me with a blunt instrument in my head that cause of my permanent
deafness. I manage myself to still be conscious even though I felt that my body
is so weak and felt the blood streaming all over my head. He was about to
strangled me with my own panty hose, until an illuminating light pass through the
window of my room and show the face of the criminal. He

Prosecutor: Do you know him ?


Ms. Dominguez: Yes. He was our neighbor his renting an apartment just beside
our house.

Prosecutor: Is the man you are referring present inside the court room right now?

Ms. Dominguez: Yes Sir.

Prosecutor: Can you point that person?

Ms. Dominguez: (Pointing Ted Bundy)

Prosecutor: Thank you Ms. Dominguez. I have no further question your honor.

Judge: Thank you.

Cross Examination

Judge: Is the defense would like to cross-examine?.

Defense : Yes your honor

Judge: Proceed

Defense: thank you, your honor.

Defense : Ms. Witness, are you really sure that the person you are referring is
my client?

Ms. Dominguez: Yes Sir.

Defense: Do you really saw him doing the act?

Ms. Dominguez: Yes Sir.

Defense: How come that at the complete darkness of midnight you saw the face
of the criminal?

Prosecutor: Objection your honor, the question is not answerable by yes or no.

Judge: Rephrase your question.

Defense: No further question your honor.

Judge: Is the prosecution would like to re-direct?


Prosecution: No, your honor.

Judge: Ms. Witness you can now go back to your seat.

SCENE 3

Judge: Prosecution do you still have any more witnesses to present?

Prosecutor: Yes your honor.

Judge: Proceed

Prosecutor: May we call on Mr. Biran Montes an expert wtiness specialist in


forensic dentistry.

Nararation: Mr. Montes will present the relationship between the bite marks
found in the left buttocks of the victim and the dental structure of Ted
Bundy.

(ALBUERA SAYING SOMETHING TO TED)

Judge: I understand there is a matter you would like to present to the court?

TED: (TED STAND) Your Honor… never have I encountered a man so


dedicated and brazen… in coercing his own client into admitting guilt. It makes
me wonder if he has the stamina or basic mental acuity to roll up his sleeves and
do the hard work. I will not accept my so-called attorney’s advice that I plead
guilty to save my own life. I am, in fact, not guilty. And I demand the discharge of
my roundly inept counsel, as is my right.

Defense: Your Honor, I would to resign as counsel.

TED BUNDY: Counselor’s first words I can agree to.

Defense: Fuck You!

Judge: Counselors, muzzle you.

TED BUNDY: I’ll consider the motion granted.


Defense: How’s this for motion? (walkout)

Judge: (Hits the gavel 3times)

NARRATOR: Dr. Biran Montes, a Trece Martires City, forensic Odontologist,


showed the pictures of the teeth of the defendant Ted Bundy and the bite mark
found in the body of one the slain coeds. He showed the court the peculiarities of
Bundy’s slightly crooked upper front teeth.

BIRAN: (Pointing the bite mark in the victim’s body) You can see the bite…
which exhibits the same unique pattern as the defendant’s chipped upper right
central incisor. This is the position ted Bundy teeth and this teeth is mark of left
buttocks of Lisa Dela Torre, I did a dental examination where I imitated ted
Bundy’s teeth position using plaster of Paris and after I compared it to the bite
mark of Lisa Dela Torre.

Prosecutor: Doctor, can you offer an opinion, within a reasonable degree of


scientific certainty, whether or not those teeth represented in that photograph
made the bite marks on the buttocks of Lisa dela Torre?

BIRAN: Yes, sir, I can. (Pointing the upper Teeth) The defendants teeth made
those marks.

Prosecutor: No further questions. I, uh, pass the witness. Doctor, you may return
to the witness box.

TED BUNDY: Doctor Montes, is there any way to test whether those teeth will
make the marks over and over?

BIRAN: Yes. I took models of the defendant’s teeth and I went to the morgue.
And I pressed those models into the buttocks area of different individuals… and
yes, they do match.

TED BUNDY: I’m sorry, Doctor Montes you did this experiment on cadavers?

BIRAN: Well, I couldn’t find any live volunteers.


TED BUNDY: I have to question the competency of this expert witness.

BIRAN: Your Honor, I question the competency of this entire trial. This is the
farce.

TED BUNDY: Dr. Montes, on that we could not agree more. (crowd applause)

Judge: ( Hits the gavel 4 times)

Judge: I feel duty-bound to remind you in the gallery that you are not on spring
break. It is a capital murder case. The court has already ruled on this witness’
expertise, counselor.

TED BUNDY: Yes, your Honor. (Ted sit)

SCENE 4

Direct Examination of Ted Bundy

Judge: Clerk of court let’s have a 20 minutes break and after we will proceed to
judgment.

Clerk of Court: All rise!

Court Marshall: Silence in the court! If you want to talk you may go outside the
court. You may take a recess.

Scene 4 (JUDGEMENT)

Clerk of Court: All rise! The Judge is approaching.

Judge: (Hit the Gavel) Let us proceed with the judgment.

Clerk of court: Please be sited, the defendant please remain standing.

Judge: It is this court‘s reasoned judgment you be adjudicated guilty of murder


that the killings are indeed atrocious and cruel in that they were extremely
wicked, shockingly evil, vile and with utter indifference to human life and that you
shall be put on death by current of electricity that shall pass through your body
until you are dead, I understand you have statement you’ like to make, and you
may do so now.
TED BUNDY: I will not ask for mercy. In fact I find it absurd to ask for mercy for
something that I did not do I’m not the one responsible for this horrific acts.
Although the verdict found in part that these crimes had been committed it erred
in finding who committed them as a consequence I do not accept the sentence
because it is not a sentence of me I is a sentence of someone else who is not
standing here today.

Judge: The court is going to sentence the person found guilty of the offense.
Your name Sir, was on that verdict. Take care of yourself young man I say that
to you sincerely. Take care of yourself. You’re a bright young man. You’d have
made a good lawyer. I would’ve loved to have you practice in front of me, but
you went to a different way, partner. It is been a tragedy for this court to see the
total waste of humanity that we have experienced here. I don’t have any
animosity towards you. I want you to know that. Take care of yourself.
