LEAVE AND LICENCE AGREEMENT

THIS LEAVE AND LICENSE AGREEMENT MADE AND EXECUTED AT


WAGHOLI ON THIS 30th day of October 2010

BETWEEN

HEREINAFTER referred to as “THE LICENSOR” (which expression shall unless


repugnant to the context or meaning thereof shall mean and includes the Licensor’s
his heirs, executors, administrators, representatives and assign etc.) of the one part

Mr. Kumar Ramanand Niraj
Age: 29, Occupation: Service

HEREINAFTER referred to as “THE LICENSEE” (which expression shall unless it be


repugnant to the context or meaning thereof shall mean and includes the said
Company, its executors, administrators, successors in title etc.) of the Second Part.
WHEREAS the Licensor is the owner of Flat no. 304, Bldg: D, Savannah, Opp.
Wagheswar Temple, Behind Moze Engg. College, BAIF Road, Wagholi, Pune
421207. admeasuring about 1048 Sq ft.

AND WHEREAS the Licensor is desirous of giving the said flat premises for
residential purpose on leave and license basis and the Licensee who is also in need
of premises for residential accommodation has approached the Licensor with a
request to grant them permission and after mutual agreement between the parties,
the Licensor has agreed-to-grant license of the said flat to the Licensee and the
Licensee has agreed to take the same on leave and License basis for residence
purpose for a period of 11 months commencing from 01st November 2010 and
ending 30th September 2011 on the following terms and conditions.

NOW THIS DEED WITNESSETH AND IT IS HEREBY AGREED BETWEEN


THE PARTIES HERETO AS FOLLOWS:

1. If the licensee wants to vacate premises before 11 months from the date of
commencement of the aforesaid agreement Licensee should pay the License
fees for the remaining month of the period from the date of commencement of
this agreement to licensor .

2. The Licensee shall pay to the Licensor an amount of Rs.7,500/- (Rupees Seven
Thousand Five Hundred Only) per month as compensation/ license service fee for
the use of the said flat premises including society charges and the said amount shall
be paid in advance so as to reach the Bank Account of the Licensor on or before the
7th day of each English calendar month.

3. The Licencee agrees to pay Rs. 30,000/-(Rupees Thirty Thousand Only) towards
security deposit for the use of the said flat. The Licensee has so far paid the
Licensor an amount of Rs. 20,000/- (Rupees Twenty Thousand Only) by Third
Party transfer (Through Net Banking) towards security deposit for the use of the said
flat described in the Schedule hereunder and due compliance of the terms and
conditions of the License agreement. The Licencee agrees to pay remaining amount
of Rs.10,000/- (Rupees Ten Thousand Only) before the 5th of November 2010 by
Third Party transfer (Through Net Banking). The security deposit shall be refunded to
the Licensee by the Licensor without interest on the termination of this agreement, or
earlier determination thereof subject to the right of the Licensor to deduct the amount
of unpaid license fee and also to deduct such amounts for the loss or damage
caused to the said flat if any.
5. The Licensee shall keep the said FLAT in GOOD condition and if any
damages, breakages are caused to the said FLAT, the licensee shall make good the
loss caused to the Licensor on account of such damages and breakages.

6. It is hereby agreed between the parties that immediately on expiry of the


License or on the earlier determination thereof the Licensee shall at its costs remove
itself and shall deliver peaceful possession of the said flat without any delay to the
Licensor.

7. It is expressly agreed and declared that the Licensee shall use the said flat as
a Licensee only and shall not claim any right, interest in the said flat as a tenant or
otherwise.

8. It is hereby agreed between the parties that the licensee shall not keep, permit
or allow anyone else to use the said FLAT or grant licence to use and occupy or
sublet nor shall transfer or assign the benefits of this agreement to any other person

9. It is specifically agreed between the parties that at all times the judicial
possession of the said flat shall be of the Licensor only. The Licensor or his
representative shall be entitled to enter upon the said flat with prior notice to the
Licensee and inspect the same.

10. a) The Licensee shall in addition to the amount of licensee fee shall also pay
actual charges for consumption of electricity and other utilities if any without default.

b) Licensor agrees and undertakes to pay outgoings, charges, rates and taxes
including property tax, society maintenance charges and other taxes in respect of the
said flat regularly and in time so as not jeopardize the rights and interests of the
Licensee conferred upon him under this agreement.

11. The Licensee shall not cause nuisance to any other occupants in the said
building nor shall the Licensee erect any permanent structure/fittings or demolish any
permanent structure in the said flat without the written permission of the Licensor nor
shall the Licensee cause any modification to be made in the said flat without the
written consent of the Licensor. The Licensee shall abide by the by-laws of the
Society and shall not store hazardous/banned goods in the said flat.

12. The Licensee shall not do any act or thing so as to jeopardize or prejudice the
right of the Licensor in the said flat.
13. This agreement is terminable at the option of either of the parties with one
month’s notice after Six months. The Licensee commits breach of any of the terms
and conditions of this agreement, the Licensor shall be entitled to terminate this
agreement forthwith and in that event the Licensee shall vacate the said flat
immediately.

14. Nothing herein contained shall be construed as creating any right, interest,
easement, tenancy or sub tenancy in favour of the Licensee in or over or upon the
said flat or transferring any interest whatsoever therein in favour of the licensee or
the occupant for the time being in the said premises other than the permissive use
hereby granted or as entitling the Licensee to possession of the said premises.

15. Stamp charges, if any shall be borne and paid equally by the Licensor &
Licensee in respect of this Leave and License and duplicate thereof and the Licensor
shall retain the original copy of this Leave & License agreement and the Licensee
duplicate thereof.

16. This agreement shall be subject to the exclusive jurisdiction of Courts of Pune.

SCHEDULE OF THE FLAT

ALL THAT PIECE AND PARCEL OF Flat no# 304, Bldg: D, Savannah, Opp.
Wagheswar Temple, Behind Moze Engg. College, BAIF Road, Wagholi, Pune
421207. admeasuring about 1048 Sq ft., covering One Hall, One Kitchen, Two
Bedrooms, One Balcony, Two Toilet/Bathroom & one reserved/covered Parking and
all common amenities provided by the Society.

IN WITNESS where of the Lessor and the Lessee have hereto set their hands in the
day and year first written above.
