Defendant NEIL JOSEPH GILLESPIE, a nonlawyer appearing pro se, in the first person,

served on the Portal in case 2019-CF-4193 on June 22, 2020 at 3:32 PM, see,

2. As of today Judge Tatti has not responded. Disqualification and Disclosure, Florida

Judicial College, pages 6-7. "If the Judge fails to rule on the motion to disqualify within 30 days

after service of the motion, the motion is deemed granted..."

3. Thirty (30) days have passed without a ruling; the motion is deemed granted, see Fla. R.

Jud. Admin. 2.330(j), time for determination:

(j) Time for Determination. The judge shall rule on a motion to

disqualify immediately, but no later than 30 days after the service of the motion as
set forth in subdivision (c). If not ruled on within 30 days of service, the motion
shall be deemed granted and the moving party may seek an order from the court

directing the clerk to reassign the case.

4. I hereby move for an order directing the clerk to reassign the case.

6. Today I received a response from The Florida Bar showing Judge Tatti lied on his

application to the Florida Supreme Court, Judicial Nominating Commission (JNC) in 2018.

I requested the following public records from Joshua E. Doyle, Executive Director and Records

Custodian, for The Florida Bar:

Provide records showing the ethic origin of Anthony Michael Tatti, Bar Number:
473626.

The potential problem I see with Judge Tatti, he shows "Hispanic" as ethic origin on his
Judicial Application Data Record submitted with his application to the FSC JNC. I saw
and heard Judge Tatti during a Zoom hearing, and together with his name, Anthony
Michael Tatti, assumed he was white, non Hispanic and of Italian heritage. If Judge Tatti
is not Hispanic, I believe the falsehood on his judicial application, perhaps calculated to
increase his chance of nomination, calls into question his fitness to serve as a circuit court
judge.

7. Judge Tatti provided a false response on his application to the JNC for the Florida

Supreme Court on September 12, 2018 when he stated on his Judicial Application Data Record

that his ethnic origin was "Hispanic." Exhibit 1. Public records provided today July 27, 2020 by

The Florida Bar show the race of Judge Tatti is "White (Non-Hispanic)". Exhibit 2. Judge Tatti

lied about his ethnic origin/race on his application to the Florida Supreme Court JNC. Judge

Tatti lied to the People of Florida. Further grounds for disqualification.

8. Judge Tatti’s ORDER TO REVOKE BOND of July 9, 2020 states in relevant part,

THIS CAUSE coming to be heard before me this day upon the foregoing Motion to
Revoke Bond, filed herein by the State of Florida and dated June 15, 2020, and the Court
being fully advised in the premises, it is therefore,

ORDERED AND ADJUDGED that the Defendant's bond be revoked and that the Sheriff
of Marion County shall take said Defendant (NEIL JOSEPH GILLESPIE(A), W/M,
DOB:3/19/1956, SSN:160525117, LAST KNOWN ADDRESS:8092 SW 115TH LOOP,
OCALA, FL 34481-3567) into custody and detain said Defendant at the County Jail,
pending further order of this Court as this Court finds probable cause to believe
Defendant committed a new crime while on pretrial release in the above styled cause.

IT IS FURTHER ORDER AND ADJUDGED that the Defendant be held on a NO

BOND status until further Order of this Court.

DONE AND ORDERED at Ocala, Marion County, Florida, this 9 day of July, 2020.

9. APPENDIX A: COVID-19 COMPLAINT TO DEPT OF HEALTH RE MARION

COUNTY FLORIDA, is directed against persons and entities in Marion County, Florida,

1. Timothy McCourt and the Marion County Sheriff’s Office (MCSO)

2. Zachary Phipps, Office of Criminal Conflict and Civil Regional Counsel, 5th DCA
3. The Marion County Jail, Sheriff William Woods
4. Anthony M. Tatti, Circuit Court Judge, Marion County, Florida Fifth Judicial Circuit

and shows incarceration for a senior citizen with disabilities is likely a death sentence in the

Marion County Jail, given the failure of the Jail and Sheriff Woods to enforce COVID-19 rules,

and the belief held by too many people in the MCSO that COVID-19 is a “fake virus”.

10. APPENDIX B: FLORIDA BAR COMPLAINT AGAINST TIMOTHY THOMAS

MCCOURT #44604, alleges Mr. McCourt, in his official capacity as general counsel to the

Marion County Sheriff’s Office, engaged in Misconduct prohibited by RULE 4-8.4, in order to

prejudice me in the reports and the incident, which resulted in my wrongful arrest on June 13,

2020, a deprivation of rights under color of law, in violation of 18 USC 242.

11. I contest the finding and the ruling of Judge Tatti in ORDER TO REVOKE BOND.

12. The Court Minutes for ORDER TO REVOKE BOND are not signed by the Defendant

because this hearing was conducted by Zoom, remotely due to COVID-19 and FSC No.

AOSC20-23 Amendment 5.

13. During the hearing on July 9, 2020 I was denied my FIRST AMENDMENT right to

speak in my defense on the state’s motion to revoke bond.

14. I was wrongly represented by appointed counsel Zachary Phillps of the OCCCRC 5th

DCA who provided ineffective assistance of counsel. (Strickland v. Washington, 466 U.S. 668

(1984), in violation of my constitutional rights under the SIXTH AMENDMENT.

15. I am the only person legally authorized to represent myself, Neil Joseph Gillespie, in this

case. This Court’s prior appointment of substitute counsel was based on an unsigned and

incomplete Application For Criminal Indigent Status. On July 22, 2020 the Clerk found I was

NOT INDIGENT on my application submitted per F.S. § 27.52. I am not entitled to appointed

counsel. Therefore the appointment of counsel must be immediately revoked.

16. It is clear that Judge Tatti is ambitious, and covets a seat on the Florida Supreme Court.

He claimed “Hispanic” ethnic origin calculated to increase his chance of nomination. In fact,

Judge Tatti is a "White (Non-Hispanic)" male. Judge Tatti’s deception failed to get him a seat on

the Florida Supreme Court. Now Judge Tatti has another plan to get a seat on the Florida

Supreme Court: Get NEIL JOSEPH GILLESPIE, a court critic, and a person age 64 who was

never convicted of a crime. Judge Tatti wants to silence me by any means possible, including

incarceration on a bogus charge in a COVID-19 hot jail. Judge Tatti is assisted in his efforts by

the MCSO, the State Attorney, and the Marion County Bar Association:

• Judge Anthony Tatti is a former Assistant State Attorney, and a member of the Marion
County Bar Association, Inc., and benefits from unopposed judicial elections.

• Mr. McCourt is a former Assistant State Attorney in the Office of State Attorney of Brad
King. McCourt is also a member of the Marion County Bar Association, Inc.

WHEREFORE, I move the Court for an Order for the clerk to reassign the case; I move

for rehearing the Order To Revoke Bond.
