To perform, my fundamental duties, as defined under article 51 A (g) of Indian Constitution, animal
being state subject, whereas law & order also vested in state but AWBI proposed another toothless
mechanism, without delegating power under section 37 of the Prevention of Cruelty to Animals Act,
1960 to the State Animal Welfare Board being State Government establishment:

Power to make Rule, to be removed from final draft:

48. The State Government may by notification in the official Gazette and subject to the condition of
previous publication to make rules to carry out the purposes of this Act and for proper function of the
State Board. Note: Power to make rules under this Act may result in each and every state making its
own rules regarding each issue and may cause conflict of interest. Also, an equal status, powerful and
independent SAWB will never listen to board or its direction as they do right now they should report
and coordinate with AWBI and drive their power through AWBI this may be changed to power to
make regulation and may act as advisory/ in animal welfare issues to AWBI. The AWBI should
delegate its some function and power to SAWB to create answerability and balance of power.

Functions of the State Board, Inclusion of New Section:

The State Board shall ensure that the provisions of the Act and the Rules framed hereunder are given
widespread publicity, and duly implemented in the State, and take all necessary steps to implement
the acts and rules framed there under and adequate awareness on animal welfare may be created. (2)
The State Board shall also oversee the functioning of the animal welfare organizations and SPCAs
within the State, to ensure that the provisions of the Act and the Rules framed there under are being
duly implemented. (3) The State Board shall also exercise such functions as may be delegated to it by
the Board, or by the State Government or Union Territories, and by any Rules made under the Act for
furthering the objectives of these Rules. Objections: SAWB be empowered to make rules as per their
