In this case what to do and not to do. What if you refuse to open the glove compartment or trunk. I think it's more
dangerous if you refuse to open the trunk. It's case to case basis I think.

According to a friend who used to be in bank money transport in armored vehicles, you DON'T have to stop at a check
point if there is NO marked police car within 25 meters of the check point even if the police is uniformed.

 

@krzcuevas under the law it is really taboo for any authorities even if they are in uniform to fitce anyone to open the trunk
and glove compartment , and this includes your personal
bags. even a strong suspicion precludes them from doing so. many drug cases have been dismissed due to the unlawful act
of collecting evidence ( this is in legL parlance called " fruit of the poisonous tree") in cases where there is an existing
legitimate operation, the officers should bring with them
two pertinent documents 1. mission order 2. search warrant; the absence of the second mentioned documents preclude
them from doing any particular search, it is a violation of your constitutional right.

 

To lessen probability of check point. I took out all my tint and replace them with a clear type of sunshade. So when they
check point me. I just go on the side, turn the lights on. and they will just flash the lights and let you pass without opening
the window. if they want to talk to you. just open about 1 to 2 inch of our window for talking. if he ask you for check point.
just say "yes, viewing lang po". and put your windows up. always work for me.also by doing this they know you already
know your rights. taking the tint out is a mind set that you are not hiding anything. be sure to lock all your doors when
driving.also be cautious when you are driving in a dark area and your driving alone. use main road as possible where there
are a lot of cars passing by.

 

I have a question, why would you need to keep your license and OR/CR in reach? I mean, if only a visual search is allowed,
then you won't need to present these right, especially not surrender them? So why was this part mentioned? I'm a bit
confused.

Frankly, on my trips to Bicol, I have passed numerous checkpoints, but they are never well lit to be honest, but I know they
really are checkpoints as they are always in the same freaking place. I just slow down but never stop or am stopped. I think
that is okay because they are usually monitoring contraband shipments from trucks anyway.

Unless there mission order specifies looking for carnappers or drug dealers and the like, I don't see the need to really stop
at the check point., unless called of course for specific reasons.

 
