AGREEMENT OF LEASE FOR A RESIDENTIAL HOUSE

MADE AND ENTERED INTO BY AND BETWEEN

JOYCE TAMOCHA

(HERE IN AFTER AND REFFERRED TO AS THE “LESSOR”

AND

TSHEPHO KHAMFORE

(HERE IN AND AFTER REFFERRED TO AS THE “LESSEE”

WHERE BY IT IS AGREED as follows:

LEASED AREA
The lessor hereby leases to the lessee, the lessee hereby hires from the lessor the house at
Area G Plot No. 4655 Francistown
PURPOSE
Only authorizes lessee and the family members shall use the leased house for dwelling
purposes only. The lessee is not permitted to use the house for any other purpose like
business, trade or another use whatsoever without the written permission of the lessor.
Sub-letting the house is not permitted.

COMMENCEMENT AND DURATION
Notwithstanding the date of signature hereof this lease shall commence or deemed to
have commenced on the 1st January, 2011 and shall continue for a period of two (2) years.
RENTAL
The rental payable by the lessee to the lessor shall be the sum of ONE THOUSAND
FIVE HUNDRED PULA (P1500.00) monthly payable in advance on or before the 30th
day of each month for six months and increase to ONE THOUSAND EIGHT
HUNDRED PULA (P1800.00) for twelve (12) months with effect from the 1st July
2011.

RENEWAL
The lessee, however, paying the rent and observing other terms and conditions of this
lease shall have the right to renew this lease for a further period from the date of expiry of
the lease.
DOWN PAYMENT/SECURITY FEE
The lessee will pay a down payment of THREE THOUSAND PULA (P1500.00) in
advance that will be refundable at the end of the lease period.
DUTIES OF THE LESSEE
The lessee shall/should/will be/is:
• Keep and maintain the leased house and developments especially the wall paper
in the sitting room and the passage thereon in a clean and tidy condition
• Maintain all hedges, fences, dividing walls and/other boundary structures in good
condition
• Under no circumstances remove any item in the house without the lessor’s
consent these include lamp shades, portraits and other valuables

• Liable and responsible for any damages, breakages/blockages happening during
the lease period.
• At all times comply with all the bye-laws and regulations in force in the area in
which the leased house is situated.
• See to it that the house is not abused
• Seek permission when he wishes to install air conditioner, or make other
improvements may do so with the written approval of the lessor as the case
maybe. Permission will not be unreasonably withheld provided that the
improvements are made in a workman- like manner
• Not permitted to make structural alterations to the house
• See to it that the gate is always closed to prevent domestic animals getting into the
yard to eat plants and flowers, failure to do so whatever happens the lessor will
take responsibility
RESPONSIBILITIES OF THE LESSEE
Lessor will be responsible for:
• Maintaining in good order the premises leased to him
• Routine maintenance for water and electricity
• Any damage caused to the premises other than by fair wear and tear
• The cost of re-decoration, the repair or replacement of equipments if it is
necessitated by willful misuse
• Eradication of pests such as cockroaches, ants and mice during the lease period
• Required to pay for any necessary repairs, service or replacements including but
not limited to the following;
 Broken window panes
 Broken doors, locks and lost keys
 Damaged entrance gates and garage doors
 Rubbish on the premises
 Unacceptable damage to paintwork

SERVICE CHARGES

The lessee will pay charges for electricity, water and other necessary services
NB: the lessee is not allowed to put a gas cylinder inside the house because of the
potential hazards that could be encountered like explosion of the cylinder and
subsequent burning o the house. In case this happens it is the responsibility of the
lessee to replace the house.
RIGHTS OF THE LESSOR
The lessor shall/will/has the right to/is;
• Give the lessee three months notice except in the case of emergency
• To inspect the house without prior notice to the lessee
• Recover from the lessee the cost of any item found to be missing
• Evict the lessor when she feels the house is abused by the lessee
• Required to enter into agreement with the lessee
RIGHTS OF THE LESSEE
The lessee shall/will/has the right to/is;
• Give the lessee three months notice except in the case of emergency
• Sign the lease before entering into a lease
• Make suggestions to the lessor to improve the residence
• Required to enter into contract with the lessor
NOTICE
• When the lessee breaches the condition of the lease the lessee shall be required to
vacate the premises within thirty (30) days upon due notice.
• When the lessor breaches the conditions of the lease agreement the lessee shall
vacate the premises within thirty (30) days upon due notice
• Any communication or written notice shall be duly given or made and delivered
in writing and addressed to the lessor at the specified address

DECLARATION
The lessor hereby agrees with the lessee that the lessee will duly pay rent, observe and
perform several stipulations on his part herein contained in the memorandum and shall
peacefully hold the said residence during the said period of the lease without any
interruption by the lessor or any person rightfully claiming under or in trust for it
SERVICES
It is hereby recorded that the lessor shall not be obliged to provide services of any nature
whatsoever to the lessee
AMENDMENTS
Any amendments, modifications or waivers of any of the provisions of this agreement
shall not be effective unless they are signed by the lessee and the lessor
