SUBJECT: “TRANSMITTAL OF DOCUMENTS RELATING TO THE HEIRS OF

TUNGAN VS. MUN. OF PANTUKAN CASE”

Respectfully transmitting herewith the attached documents relative to the civil case no. 814 of
Heirs of Tungan vs. Municipality of Pantukan for Recovery of Possession, to wit:

1. Annex 1- Letter dated August 14, 1996 addressed to then Mayor Jovito Derla, MD
from the Heirs of Tungan Mansaca represented by Eduardo Tunggal;
2. Annex 2- Proclamation No. 146 revoking Proclamation No. 11 and reserving the same
for market purposes
3. Annex 3- Subdivision Plan as surveyed for Tungan (Mansaca) dated December 2,
1955
4. Annex 4- Sketch Plan as prepared for Municipality of Pantukan dated July 23, 2020
5. Annex 5- Certified True Copy of OCT 341

Upon close perusal thereof, the undersigned notes the following:

1. On October 19, 1922, a parcel of land covered by OCT No. 341 was surveyed by
Casiano Salas, a Bureau of Lands surveyor;
2. On December 22, 1922 the said survey was approved;
3. On February 21, 1924, Proclamation No. 11 reserved the contested area of the
aforesaid case for military purposes;
4. On June 28, 1926, the OCT No. 341 was issued to the Mansaca Spouses which
delineates the property and excluded thereto the contested area in accordance with
the provisions of Proclamation No. 11;
5. The contested land has no title or no registration to any person other than
Proclamation No. 146 reserving the area for market purposes;
6. The contested area is outside but adjacent to the land covered by OCT No. 341
registered in the name of Tungan (Mansaca);
7. The heirs of Tungan already raised the issue before the Commission on the
Settlement of Land Problems (COSLAP) but was subsequently denied by the
latter.

The undersigned respectfully prays that these attached documents be referred to the
Sangguniang Bayan of Pantukan for purposes of deliberation and formulation of formal offer
for amicable settlement of the aforesaid civil case and that the same be certified as urgent.
