APPLICATION FOR PROBATION

The Convicted Felon, ERONICO ALIAS y DULACA, through Counsel of the Public Attorney’s
Office and unto this Honorable Court, hereby submits this Application for Probation and further alleges
that:

1. The accused is of legal age, single, and a resident of Zamboanga City;

2. The accused entered a plea of Guilty to two counts of Section 12 of Article II of RA 9165 pursuant
to the Plea Bargaining Agreement entered into and was sentenced to suffer the following penalty,
to wit:

“WHEREFORE, judgment is hereby rendered finding the accused guilty beyond

reasonable doubt of the crime of two counts of Illegal Possession of Paraphernalia of
Dangerous Drugs, is hereby sentenced to suffer an IMPRISONMENT OF SIX MONTHS
AND 1 DAY as MINIMUM to TWO YEARS as MAXIMUM and a FINE of ten thousand
pesos (P10,000.00) and a STRAIGHT PENALTY OF ONE YEAR IMPRISONMENT and
a FINE of ten thousand pesos(P10,000.00)”
3. The accused has not been previously convicted of any crime and the present crime of which he
was convicted is not against the security of the state;
4. The accused has not previously availed of the benefits of Probation Law (PD 968, as amended);
5. The accused is willing to comply with all the requirement, conditions and terms of the said law;

WHEREFORE, it is most respectfully prayed that the foregoing application for Probation be
granted and the present case be referred to the City Probation Office for the Post-Sentence Investigation
and Recommendation.
