PART I

1.0 Introduction

1.1 The Electoral Boundaries Commission, “the Commission”, is a constitutional body


established under Section 38(1) of the Constitution of the Republic of Mauritius, “the
Constitution”. Its Chairman and Members are appointed by the President, acting
after consultation with the Prime Minister, the Leader of the Opposition and such
other persons as appear to the President acting in his own deliberate judgment, to
be leaders of parties in the National Assembly, “the Assembly”.

1.2 The Commission is presently composed of:

1.3 The Commission, in the discharge of its duties, is assisted by its Secretary
Mr. Satydanand Aujeet.

1.4 The Commission has the statutory mandate, under Section 39(2) of the Constitution,
to review the boundaries of the constituencies of the Republic of Mauritius and to
present a report to the Assembly ten years as near as may be after the presentation
of its last report. There are historical reasons for the Commission to report to the
Assembly. It may be recalled, as pointed out by Professor S A de Smith in his book
Constitutional and Administrative Law (1971), that in Mauritius “The system of
election and the method of legislative representation were highly contentious issues
before independence. They are written into the constitution and specially
entrenched. Provision is also made for commissions to delimit constituencies and
supervise the registration of electors and the conduct of elections; the members of
the commissions have security of tenure.” Parliamentary sovereignty, however,
prevails when it comes to boundaries of constituencies as we shall explain later in
this introduction.

1.5 The proviso under Section 39(2) also enables the Commission which may at any
time carry out a review and present a report if it considers it desirable to do so by
reason of the holding of an official census of the population of Mauritius and it shall

do so if a resolution is passed by the Assembly. Since independence in 1968, the
Commission has not been called upon to undertake any review under the proviso.

1.6 The Commission has reviewed the boundaries of the constituencies in Mauritius and
presented four (4) reports to the Assembly, namely, in 1976, 1986, 1999 and 2009.

1.7 It is worthy of note that the Assembly may by resolution approve or reject the
recommendations of the Commission but may not vary them; if approved by the
Assembly, the recommendations shall have effect as from the next dissolution of
Parliament vide Section 39(4) of the Constitution.

1.8 The recommendations of the 1986 and 1999 reports were approved by the
Assembly, whilst those of the 1976 report were rejected.

1.9 The last report on the review of boundaries of constituencies was handed over to
the Speaker of the Assembly on 30 October 2009. It was tabled before the
Assembly on 10 November 2009. No resolution was, however, introduced in the
Assembly to approve or reject the recommendations of the Commission.

1.10 As a result, the present boundaries remain those as delineated in the 1999
recommendations and described in GN 552 of 2000 - Appendix A.

1.11 The description of the present Registration Areas is set out in Appendix A1.

2.0 The Constituencies of the Island of Mauritius

2.1 Section 39(1) of the Constitution, which came into force in 1968, provides as follows:

There shall be 21 constituencies and accordingly –

(a) the Island of Mauritius shall be divided into 20 constituencies


(b) Rodrigues shall form one constituency.

2.2 The number of constituencies has thus been fixed to 20 for the island of
Mauritius and Rodrigues is the 21st constituency.
Rodrigues being one constituency of its own, is not concerned by the present
exercise.

2.3 The appellation of the 20 constituencies (electoral districts) was established by


the Schedule to the Regulations (Government Notice No. 82 of 1966). They are
as follows:-

2.4 It is worth recalling that the existing 20 constituencies result from the pairing of
the 40 electoral districts which had been established by Proclamation No.10 of
1958, being grouped into pairs following the recommendations of the Banwell
Report of 1966.

2.5 The names of the 20 paired electoral districts (now constituencies), are set out in
GN No. 82 of 1966 and the Mauritius Independence Order GN 54 of 1968, which
also provided that these 20 constituencies referred to in Section 39(1) of the
Constitution, shall be the same as specified in the Schedule to the Mauritius
(Electoral Provisions) Regulations 1966.

2.6 The Commission would like to refer to the comments made in its 1976 Report at
Page 13 paragraph 43 concerning changes to the pairing of constituencies which
still remain pertinent to this day:

“We have, otherwise, carefully refrained from any wholesale interference with the
“pairing” of the electoral districts by the Banwell Commission in 1966 as we did
not think it would have been proper, within our terms of reference under Section
39 of the Constitution to do so.”

2.7 The Commission still considers that it is not empowered by the Constitution to
either increase or decrease the number of constituencies with regard to the
island of Mauritius. Only Parliament is entitled to do so with the required majority,
by virtue of Section 47 of the Constitution.

3.0 Historical background

3.1 The following extract from the 1962 Report of the then Central Statistics Office
shows the population of Mauritius by electoral districts.

3.2 As can be seen from the above table, the disparity in the number of inhabitants
between constituencies can be traced back to 1962.
According to the 1962 population census, electoral district No. 5 - Port Louis
Maritime (now part of Constituency No. 3 – Port Louis Maritime and Port Louis

East) had a population of 10,396 whereas electoral district No. 36 Stanley (now
part of Constituency No. 19 - Stanley and Rose Hill) had a population of 23,210.

3.3 The ratio between these two electoral districts in terms of population was already
1:2 in the 1962 census. The disparity has not been reduced if we look at the
number of inhabitants according to subsequent census from 1978 to 2011, the
latest census.

4.0 POPULATION CENSUS

4.1 The table hereunder shows the number of inhabitants in respect of each
constituency as per the population census for the years 1972, 1983, 1990, 2000
and 2011.

4.2 The population of Mauritius was 1,196,383 according to the latest population
census carried out in 2011. The „population quota‟ which is obtained by dividing
the figure 1,196,657 by 20, is 59,832 rounded to the nearest whole number. A
correspondence from the Director of Statistics Mauritius in respect of the Census
2011 resident population by Constituency is included at Appendix B.

4.3 Appendix C is a map showing the population density according to the data
submitted by the Director of Statistics Mauritius.

5.0 METHODOLOGY

5.1 Section 39(3) of the Constitution provides:

“The Report of the Electoral Boundaries Commission shall make


recommendations for any alterations to the boundaries of the constituencies as
appear to the Commission to be required so that the number of inhabitants of
each constituency is as nearly equal as is reasonably practicable to the
population quota:

Provided that the number of inhabitants of a constituency may be greater or less


than the population quota in order to take account of means of communication,
geographical features, density of population and the boundaries of administrative
areas.”
(Emphasis added)

5.2 The “population quota” is defined in Section 39(5) of the Constitution as follows:

“ ………. „population quota‟ means the number obtained by dividing the number
of inhabitants of the Island of Mauritius (including any island included in any
constituency in the Island of Mauritius by virtue of any resolution under
subsection (1)) according to the latest official census of the population of
Mauritius by 20.”

5.3 The guiding principle for any alterations to the boundaries is that the number of
inhabitants of each constituency is as nearly equal as is reasonably
practicable to the population quota: provided that the number of
inhabitants of a constituency may be greater or less than the population
quota in order to take account of means of communication, geographical
features, density of population and boundaries of administrative areas.

5.4 The Commission has remained guided by the above principle in carrying out the
present exercise.

5.5 The Commission considers that it would not be appropriate to review the
boundaries of any constituency in isolation. In fact, the Commission adopted the
approach of looking at all constituencies in a holistic manner, given their inter-
connection with each other, and the ripple effect of any change to the boundaries
of one constituency in relation to neighbouring constituencies.

5.6 In the context of the present exercise which involved site visits, the Commission
noted that climate change has impacted on a number of geographical features,
such as feeder canals and rivers which used to provide certainty to the limits of
some constituencies.
The Commission also noted the expansion of residential and industrial
developments, as well as other infrastructural developments, which have brought
about further alterations to some existing geographical features requiring the
boundaries to be better defined.
Finally, the Commission further examined the observations made by the officers
of the Office of the Electoral Commissioner. These were in relation to some
regions where boundaries comprising of old railway tracks, feeder canals and
estate roads no longer exist, and instances where boundaries were cutting
across existing housing estates as well as future residential developments.

6.0 Representations made by stakeholders

6.1 The Commission, by way of a press communiqué, dated 16 November 2016, and
subsequent communiqués, invited political parties and interested persons to
submit their views and suggestions in relation to the review of the boundaries of
the constituencies of the Republic of Mauritius - Appendices D to D3.

6.2 The Commission received 52 written representations. The Commission also


conducted public hearings during which 35 persons deponed on their own behalf
and/or on behalf of the organisations they represented. Appendix E shows a list
of those persons.

6.3 The representations received, covered a wide range of issues including:

 an increase in the number of constituencies of Mauritius;

 the merging of some constituencies to form new ones;

 the renaming of constituencies;

 the disparity in terms of the number of electors in some constituencies;

 the inclusion or distraction of some localities from one constituency to another;

 the desirability of an increase of the representatives of Rodrigues at the


National Assembly from two to three;

 the need for proportional representation (PR);

 an electoral system that would be more responsive to the aspirations of our


society;

 the creation of 13 Regional Assembly constituencies for Mauritius and


Rodrigues, instead of the actual 21 constituencies;

6.4 The submissions reflected the great interest that the deponents have shown in
the exercise. All the submissions have been examined carefully and have
provided a valuable contribution to our deliberations. However, a good number of
the representations, although interesting, were in relation to the broader issues
of electoral reforms which clearly do not fall within the purview of the present
exercise or within the remit of the Commission‟s mandate.

6.5 During the course of the public hearings, the Commission took note of the fact
that many of the deponents did not make any distinction between the number of
inhabitants and the number of registered electors in the constituencies. It is worth
recalling that Section 39(3) of the Constitution refers to the number of inhabitants
in each constituency and not to the number of registered electors. However, for
purposes of this exercise, the Commission has addressed how the
recommendations made will affect the movement of electors from one
constituency to another.

7.0 Site Visits

7.1 The Commission effected visits to several regions to explore and assess the
practicalities of the recommendations that it proposes to make.

7.2 During the site visits, members of the Commission had the opportunity of
interacting with inhabitants of the localities.

8.0 INCLUSION OF CHAGOS ARCHIPELAGO IN A CONSTITUENCY

8.1 Whilst the present exercise was on-going, a motion was passed in the Assembly
on 12 July 2019 to the effect that the Chagos Archipelago, including Diego
Garcia, should be included in such one of the constituencies as the Commission
may determine. The Commission has addressed this issue separately whilst
reviewing the boundaries of Constituency No. 1 - Grand River North West and
Port Louis West.

9.0 – Recommendations

9.1 - Constituency No. 1 – Grand River North West and Port Louis West

9.1.1 Constituency No.1 is bordered by Constituencies Nos. 2, 8 and 20 on three


sides and by the sea on its western side.

9.1.3 Line Barracks to Soreze Regions

9.1.3.1 The Commission is of the view that that part of Constituency No.1 - Grand
River North West and Port Louis West, lying generally East of the Port Louis -
Plaisance Dual Carriageway (M1), comprising of the regions between Line
Barracks and the southern limit of the administrative area of the Municipal
City Council of Port Louis may be considered as a natural extension of
Constituency No. 2 – Port Louis South and Port Louis Central.
Furthermore, the Port Louis - Plaisance Dual Carriageway (M1), is a clearly
defined physical feature which forms the boundary between the two
constituencies.

RECOMMENDATION

9.1.3.2 The Commission is of the view that that part of Constituency No. 1, as
outlined above, can conveniently be annexed to Constituency No. 2 and
recommends accordingly.
This recommendation would result in a decrease of 9,985 electors in this
constituency.

9.1.4 Coromandel Industrial Zone


9.1.4.1 Part of the common boundary of Constituencies Nos. 1 and 20 at Coromandel
cuts across the Coromandel Industrial Zone and, therefore, needs to be
redefined.

RECOMMENDATION
9.1.4.2 The Commission accordingly recommends that that part of the common
boundary of Constituencies Nos. 1 and 20 at the Coromandel Industrial Zone
should in future run westerly along part of the Metro Express Line to meet
Richelieu Branch Road.

9.1.5 Morcellement Ghurburrun (Pointe aux Sables)


9.1.5.1 Part of the common boundary of Constituencies Nos. 1 and 20 at Pointe aux
Sables, being an imaginary line, splits Morcellement Ghurburrun into two
segments at the level of Challenger Street. Consequently, the morcellement
falls partly within Registration Area AC, i.e. Pointe aux Sables in Constituency
No. 1, and partly within Registration Area YK, i.e. the village of Gros Cailloux
in Constituency No. 20. The electors residing in the western segment of the
morcellement forming part of Registration Area YK vote at Pierre Desvaux de
Marigny Government School, in the village of Gros Cailloux which is 3km
away from the morcellement, however Pointe aux Sables Government School
is more accessible to the electors.
Moreover, part of the western boundary of the constituency starting from the
intersection of the „tracé‟ of the Old Railway line and Pointe aux Sables Road
(B31) which runs along an imaginary line up to the sea at Pointe aux Caves
lighthouse needs to be redefined.

RECOMMENDATION
9.1.5.2 In the light of the observations outlined above, the Commission recommends
that Morcellement Ghurburrun, in its entirety, be annexed to Constituency
No.1.
The Commission recommends that the new boundary runs along the southern
boundary of Pointe aux Sables bus terminal and several tracks bordering
Morcellement Ghurburrun up to the boundary of Pas Géometriques Belle Vue
La Mecque to meet the lighthouse at Albion.
This recommendation would result in an additional 137 electors in
Constituency No. 1.

9.1.6 Inclusion of the Chagos Archipelago

9.1.6.1 The Commission has taken note of the motion passed in the Assembly on 12
July 2019 for the inclusion of the Chagos Archipelago in such one of the
constituencies of Mauritius.
The Commission has carefully examined the issue as well as the affinity the
Chagossian community has with the constituencies of Mauritius.
The Commission finds that such affinity rests mainly with Constituencies Nos.
1 and 5 inasmuch as most of Chagossians and their descendants currently
living on the mainland of Mauritius reside in these two constituencies.

Constituency No. 5, however, is one of the constituencies with the highest
number of electors. The office of the Chagos Refugees Group is located in
Pointe aux Sables, which is found in Constituency No. 1.
The Commission determines that the Chagos Archipelago be included in
Constituency No. 1 - Grand River North West and Port Louis West.

RECOMMENDATION

9.1.6.2 The Commission accordingly recommends that the Chagos Archipelago be


included in Constituency No. 1 - Grand River North West and Port Louis West.

9.1.7 Resulting movement of electors

9.2.1 This Constituency is bordered by Constituencies Nos. 1, 3 and 4.

9.2.3 Line Barracks to Soreze Regions


9.2.3.1 As referred to in paragraph 9.1.3 above, that part of Constituency
No. 1 situated East of Port Louis – Plaisance Dual Carriageway (M1)
can be conveniently annexed to Constituency No. 2.

RECOMMENDATION
9.2.3.2 The Commission reiterates its recommendation made at paragraph
9.1.3.2 above.
This recommendation would result in an additional 9,985 electors in
Constituency No. 2.

9.2.4 La Paix, Inkerman, Boulevard Victoria, Sir Edgard Laurent and


Sir Seewoosagur Ramgoolam Streets
9.2.4.1 The localities lying South East of Sir Seewoosagur Ramgoolam
Street, North East of Fort Adelaide, commonly known as Citadel, and
North West of Boulevard Victoria Street can be said to be a natural
extension of the region of Plaine Verte.
This includes the regions in the vicinity of City Clinic, Islamic Cultural
Centre and Notre Dame de La Paix R.C.A. School.
The inhabitants of these localities also share common facilities with
the region of Plaine Verte.

RECOMMENDATION
9.2.4.2 The Commission recommends that that part of Constituency No. 2,
lying North East of Fort Adelaide (Citadel) and North West of
Boulevard Victoria be added to Constituency No. 3.
This recommendation would result in a decrease of 4,457 electors in
Constituency No. 2.

9.2.5 Corderie and Poudrière Streets Region
9.2.5.1 The area lying between Corderie Street and Poudrière Street
(Registration Area CA) falls within Constituency No. 3. This
registration area, which comprises the Supreme Court, the City Hall
and major banks, actually forms part of the central business district
of the City of Port Louis and should be included in Constituency No.
2.
RECOMMENDATION
9.2.5.2 The Commission accordingly recommends that Registration Area CA
be annexed to Constituency No. 2.
This recommendation would result in an additional 196 electors in
Constituency No. 2, who would continue to vote at Sir Abdool
Razack Mohamed State Secondary School.

9.2.6 Resulting movement of electors

9.3 - Constituency No. 3 – Port Louis Maritime and Port Louis East

9.3.1 This constituency is bordered by Constituencies Nos. 2, 4 and 5 and on


its western side by the sea, and includes the island of Agalega.

9.3.3 Corderie and Poudrière Streets Region


9.3.3.1 As referred to in paragraph 9.2.5 above, the „Registration Area CA‟ lying
between Corderie Street and Poudrière Street forms part of the central
business district of the City of Port Louis, and should be included in
Constituency No. 2.

RECOMMENDATION
9.3.3.2 The Commission reiterates its recommendation made at paragraph
9.2.5.2 namely, that „Registration Area CA‟ be distracted from
Constituency No. 3 and annexed to Constituency No. 2.
This recommendation would result in a decrease of 196 electors in
Constituency No. 3.

9.3.4 La Paix, Inkerman, Boulevard Victoria, Sir Edgard Laurent and Sir
Seewoosagur Ramgoolam Streets
9.3.4.1 As referred to in paragraph 9.2.4 above, the regions lying South East of
Sir Seewoosagur Ramgoolam Street, North East of Fort Adelaide and
North West of Boulevard Victoria Street can be said to be a natural
extension of the region of Plaine Verte.

RECOMMENDATION
9.3.4.2 The Commission reiterates its recommendation made at paragraph
9.2.4.2 above, so that that part of Constituency No. 2, lying South East
of Sir Seewoosagur Ramgoolam Street, North East of Fort Adelaide,
commonly known as Citadel, and North West of Boulevard Victoria
Street be annexed to Constituency No.3.
This recommendation would result in an additional 4,457 electors in

9.3.5 NHDC and Paul Toureau Regions

imaginary line starting from Dumas Batterie to „Pont Gareeboo‟ on
Bernardin de St Pierre Street and generally South of Lataniers river,
including Paul Toureau, have strong links and share common facilities
with the regions lying in the vicinity of Sir Abdool Razack Mohamed
Road, previously known as Route des Pamplemousses; and Ibrahim
Abdoolah Market Fair, commonly known as „La foire Cité Martial‟,
comprised in Constituency No. 3.

RECOMMENDATION
9.3.5.2 The Commission recommends that that part of Constituency No. 4 be
annexed to Constituency No. 3.
This recommendation would result in an additional 1,364 electors in
Constituency No. 3.

9.3.6 Goodwill Distillery, NHDC Complex and Cocoterie

Presently, the common boundaries of Constituencies Nos. 3, 4 & 5 split


9.3.6.1 the locality of Roche Bois in three parts, namely the eastern part found in
Constituency No. 4, the north western part found in Constituency No. 5
and the south western part found in Constituency No.3.
The Commission is of the view that the north western part of the locality
of Roche Bois, bordered by the sea and comprising of the locality of
Cocoterie, Goodwill Distillery and NHDC Complex should be annexed to
Constituency No. 3.

RECOMMENDATION
9.3.6.2 In the light of the observations made above, the Commission
recommends that that part of Roche Bois currently comprised in
Constituency No.5 be annexed to Constituency No. 3.

The Terre Rouge-Verdun-Trianon Link Road and Montagne Longue -

Rouge. The morcellement, part of which is situated in the village of
Mapou, in Constituency No. 7, is in fact an extension of the locality of
Bois Rouge comprised in the village of Pamplemousses. The
inhabitants of the morcellement vote at Mapou Government School at a
distance of almost 4.5 km away.

RECOMMENDATION
9.5.5.2 The Commission recommends that part of Morcellement VRS Bois
Rouge, lying generally West of the Port Louis – Sottise Dual
Carriageway (M2), and comprised in Constituency No. 7, be annexed to
Constituency No. 5.
These inhabitants would in future vote at Pamplemousses SSS situated
at around 1 km away.
This recommendation would result in an additional 158 electors in
Constituency No. 5.

9.5.6 Mont Piton


9.5.6.1 Following the Mont Piton housing development, part of the common
boundary between Constituencies Nos. 5 and 7, which formerly ran
along La Nicolière Distributory Channel, at Mont Piton, has been
obliterated and needs to be redefined.

RECOMMENDATION
9.5.6.2 The Commission recommends that that part of the boundary between
Constituencies Nos. 5 and 7 at the level of Mont Piton should in future
run along estate roads and River des Pamplemousses to meet the
bridge at Grande Rosalie, so that Mont Piton housing development, in
its entirety, will now fall within Constituency No. 7.

9.5.7 Morcellement Azor and Triolet Bus Service Garage


9.5.7.1 There have been recent developments at the northern fringe of the
village of Triolet, more precisely at the junction of Fond du Sac Road
and Grand Baie Road. Moreover, part of Fond du Sac Road and part of
Grand Baie Road form the common boundary between Constituencies

Morcellement Azor and the land development behind Triolet Bus


Service Garage, in the vicinity of the Triolet Fire Brigade Station,
presently falling in Constituency No. 6, can be considered as an
extension of the village of Triolet.

which is at a distance of about 3.5 km away.

RECOMMENDATION
9.5.7.2 The Commission recommends that Morcellement Azor and the land
development behind Triolet Bus Service Garage, be distracted from

9.8.4.1 Part of the existing common boundary of Constituencies Nos. 8 and


10, at Providence, cuts across Morcellement Providencia, with the
result that the major part of the morcellement falls within
Constituency No. 8.
The morcellement can be considered to be an extension of the
village of Providence.

Moreover, the attention of the Commission has been drawn to the

fact that another plot of land, contiguous to Morcellement
Providencia, and situated between Quartier Militaire Bypass Road
(B24) and Moka – Camp de Masque – Flacq Road (A7) has already
been earmarked by ALTEO Property for future development.

RECOMMENDATION
9.8.4.2 In the light of the observations made above, the Commission
recommends that the common boundary of Constituencies Nos. 8
and 10, at Providence, be redefined so that Morcellement
Providencia, in its entirety, and the plot of land earmarked by Alteo
Property be included in Constituency No.8.
This recommendation would result in an additional 43 electors in
Constituency No. 8, who would vote at Lady Lydie Ringadoo
Government School which is situated at less than 1 km.

9.8.5 Valetta Reservoir


9.8.5.1 The common boundary of Constituencies Nos. 8 and 17 at Valetta
reservoir, being an imaginary line, cuts across the reservoir.

RECOMMENDATION
9.8.5.2 The Commission recommends that the reservoir be included in
Constituency No. 8, inasmuch as the reservoir is named after the
village of Valetta, found in Constituency No. 8. That part of the
boundary would in future run along the southern and western bank of
Valetta reservoir to meet with Rivulet Cascades.

9.8.6 Bagatelle Dam

9.8.6.1 Part of the common boundary of Constituencies Nos. 8, 15 and 18


runs along Rivulet François and River Terre-Rouge. With the
construction of the Bagatelle dam, that part of the boundary cuts
across the dam; with the result that the dam falls within the 3
abovementioned constituencies.

RECOMMENDATION
9.8.6.2 The dam being in the vicinity of Cote D‟Or, a well-known locality in
Constituency No. 8, the Commission recommends that the boundary
of Constituency No. 8 be redefined so as to include the dam, in its
entirety, in this constituency.
That part of the boundary would in future run along the southern and
western outer limits of the dam.

9.8.7.1 Ebène Cyber Village and Le Bout du Monde, part of the Village of
Moka (Registration Area HAD), is bordered by Rivière Cascades on
the East, and on the West by the eastern limits of Constituencies
Nos.19 and 20.
Several representations have been made to the Commission to the
effect that both Ebène Cyber Village and Le Bout du Monde should
be included within the administrative area of the Municipal Town
Council of Beau Bassin-Rose Hill in Constituency No.19.
The Commission is of the view that having regard to the proximity of
the above two localities with the Municipal Town Council Area of
Beau Bassin - Rose Hill, they be included in Constituency No.19
(Stanley and Rose Hill).

RECOMMENDATION
9.8.7.2 The Commission recommends accordingly.
This recommendation would result in a decrease of 258 electors in
Constituency No. 8.

9.8.8 St Julien Bypass

recommends that that part of boundary be redefined to run along the
Phoenix-Mahebourg Road (A10), and the Parc aux Cerfs trail.

9.11.7 Beau Champ and Deux Frères

They have to comply with all regulations in force regarding
administrative authorisations, including building and land use permits
from the Municipal Town Council of Quatre Bornes.
Furthermore, they increasingly share common facilities (including
refuse collection) with the inhabitants of the town of Quatre-Bornes.

RECOMMENDATION
9.14.3.2 The Commission recommends that the regions of Palma, Bassin and
Residence Kennedy (Registration Areas PX, PY and PZ) be
distracted from Constituency No.14 and annexed to Constituency No.

PART III

10.0 CONCLUSION

10.1 The Commission has conducted the present review within the ambit of its
constitutional mandate.

10.2 Representations were made, inter alia, to the effect that:-


 some constituencies should be merged;
 there should be an increase or decrease in the number of constituencies in a
strict and mechanical application of the population quota principle;
 there is a need for Proportional Representation (PR);
 the number of electors should be more or less equal in each constituency;
 there should be an increase of elected representatives for Rodrigues from 2 to 3.

10.3 As already observed, the Commission is not empowered to increase or to


decrease the number of constituencies, having regard to the express and
mandatory provision of Section 39(1)(a) of the Constitution.

10.4 The Commission, despite the representations received, has made no


recommendation that would result in the renaming of constituencies, as defined
in General Notice 82 of 1966 and the Mauritius Independence Order General
Notice 54 of 1968 for reasons already explained.

10.5 The Commission as well, did not address broader issues relating to the electoral
reform, such as Proportional Representation (PR), increasing the number of MPs
for the island of Rodrigues and other issues which are beyond its remit. These
are for Parliament to address.

10.6 The Commission observes that some of the factors provided for in Section 39(3)
of the Constitution for example, means of communication and density of
population, admittedly, carried great weight at the time our Constitution was
drafted. Subsequent economic and infrastructural developments, however, have
resulted in the importance of some of those factors being significantly reduced.

10.7 The Commission has also taken into consideration the significant growth of
residential developments that have resulted in population movement. Some of
these residential developments have straddled more than one constituency, with
the result that electors living in the same area find themselves in different
constituencies when it comes to electing their representatives. The Commission
has, consequently, revisited some boundaries to correct this anomalous situation
whilst taking into account the improvements in means of communication, the
sharing of common amenities by the inhabitants and the boundaries of
administrative areas which enable the inhabitants to benefit from common
services.

10.8 The Commission has, wherever possible, endeavoured to review and describe
boundaries, so that they become clearly identifiable. In so doing, it has also taken
into account existing geographical features and present physical features, such

as highways and new road networks instead of relying on former railway lines,
feeder canals, rivulets and unused estate roads as a result of reduction of land
under sugarcane cultivation.

10.9 According to the register of electors currently in force, the two largest
constituencies in terms of electors namely Constituencies Nos. 5 and 14 have
65,115 and 63,500 electors respectively. The smallest constituency is
Constituency No.3 with 21,943 electors. The ratio in respect of the
constituencies with the highest number of electors and constituencies with the
lowest number of electors is nearly 3:1.

10.10 As a result of the recommendations made in this report, the constituency with the
highest number of electors now will be Constituency No.18 with 58,267 electors
and the lowest number of electors will be in Constituency No. 2, with 29,962
electors. The ratio between the highest and lowest number of electors will stand
at nearly 2:1.

10.11 The table, at Appendix F, sets out how the recommendations made in this report
will affect the movement of electors in each constituency.

10.12 It is generally known and accepted, even in more populated and sophisticated
democracies, that it is impossible to achieve parity in terms of the population
quota for all constituencies. Mauritius is no exception. The number of
inhabitants is constantly changing geographically following infrastructural and
residential developments. The Commission is of the view that the population
quota cannot be applied in a mechanical way so as to be equal for each and
every constituency as adverted to above. No doubt for this reason, the framers
of our Constitution in their wisdom expressly stated that the number of
inhabitants of a constituency may be greater or less than the population quota
having regard to means of communication, geographical features, density of
population and the boundaries of administrative areas. We should also not reach
the other extreme of absurd disparity.

10.13 The Commission takes note of the historical context in which the boundaries of
the constituencies were established. Despite its best endeavours, the
Commission acting within its constitutional remit, cannot redefine radically the
boundaries of the constituencies of Mauritius, as set out in GN No. 82 of 1966
and the Mauritius Independence Order GN 54 of 1968.

It is the exclusive prerogative of Parliament to do so.


10.14 The Commission received representations that our electoral system should be
more responsive to the aspirations of the people of the Republic of Mauritius.

It is for the elected representatives of the people to do so.
