governed by the Successor of Peter and by the Bishops in communion with him. 58The Churches which, while not
existing in perfect communion with the Catholic Church, remain united to her by means of the closest bonds, that
is, by apostolic succession and a valid Eucharist, are true particular Churches. 59 Therefore, the Church of Christ
is present and operative also in these Churches, even though they lack full communion with the Catholic Church,
since they do not accept the Catholic doctrine of the Primacy, which, according to the will of God, the Bishop of

VALIDITY AND LICITNESS OF HOLY ORDERS

“Every validly consecrated bishop, including heretical, schismatic, simonistic or


excommunicated bishops, can validly dispense the Sacrament of Order, provided that he has
the requisite intention, and follows the essential external rite (set. Certa). Cf. D 855, 860; CIC
2372.” Fundamentals of Catholic Dogma by Dr. Ludwig Ott, 1952, p. 456.

Canon 1012. The minister of sacred ordination is a consecrated bishop.


"The ordinary minister is every consecrated bishop and no one else [Council of Trent, sess.
23, c.7.]. Therefore even a schismatic bishop or one who has been degraded or one who has
been declared irregular, etc. may ordain validly, provided that his own consecration was
valid and that he uses the essential matter and form." Handbook of Moral Theology, by

"A validly consecrated bishop can validly confer all orders from the minor orders to the
episcopate inclusively ... For this reason the ordinations performed by the bishops of the Carlos

Canon 845 §1. Since the sacraments of baptism, confirmation, and orders imprint a
character, they cannot be repeated.

Canon 845.1 tells us that the sacrament of orders, like the sacraments of baptism and
confirmation, imprints a character on a person’s soul. It can never be erased (which is
incidentally why these sacraments can be validly administered only once). And since it can
never be erased, a bishop who falls away from the Church is still a bishop. And since he is still
a bishop, he can still validly administer Catholic sacraments, even if he has left the Catholic
Church! …

xxx Despite canon law can be implied of the 1917, the 1983 canon law has no effect,
but in regards validity of the transmission of Holy Orders of the spirit.

The Augustinian Theory effectively holds that valid episcopal ordination confers an indelible
character that is not affected by any schismatic or heretical act or excommunication taken in
response thereto or for any other reason. Accordingly, a validly ordained priest, once validly
ordained to the episcopate, retains his capacity to exercise that order, though he may have been
deprived juridically of the office or jurisdiction by which he performed episcopal acts. The
latter considerations affect only the licitness of his acts.

Validity and Illicitness Defined:

Illicitness is fully within the power of Canon Law to determine....but in(validity) is in


the power of God the Holy Spirit, and so validity occurs purely in the Order of Grace, and
Canon Law can not touch, change, affect, or determine that in any way.

Bishop Dom Carlos Duarte Costa on the November 30, 1956, as bishop of Santiago de Chile.
Years later was also received by H.H. Pope John XXIII and appointed Auxiliary Bishop to the
Archbishop of Madrid, Spain. Years later he was transferred in the position of auxiliary bishop
in the Archdiocese of Ceará, Brazil Republic.

25. POPE Paul IV (CARAFA Pietro Gian) (1476- 1559). Created Cardinal, Bishop of Chieti,
consecrated in Rome by Oliviero Cardinal Carafa. September 18 1506. Archbishop emeritus
of Napoli, who was Elected and crowned Pope as Paul IV. When he was 80 years old. He is
buried in the Church of Santa Maria sopra Minerva. in Rome.

26. CARAFA Oliviero (1458- ??). Created Cardinal .Archbishop of Napoli, consecrated
December 29th, 1458 at Torre del Greco by Leone de Simone. Bishop of Nola, assisted by
Leone Cortese, Bishop of Acerra and Benedetto, Bishop of Dragonara. During the last years
of his life, which coincided with the pontificate of Pope Julius II, Carafa was regarded as a
wise counsellor of the Church. He died on 20 January 1511. His tomb is in the Carafa
Chapel of Santa Maria sopra Minerva.

Rev'd Monsignor. Anselmo Pamintuan studied Philosophy and Theology at Saint


Vincent Ferrer Seminary in Iloilo City in 1970. He was ordained a priest at the age of 23 years
on March 30th 1974 by Most Rev'd. Gregorio Espiga. OAR. Vicar Apostolic of Palawan.

He took up Canon Law at the Pontifical University Santo Tomas from 1983 up to 1985.
He was a member of the CLSP (Canon Law Society of the Philippines). He was made a
Monsignor by the full authority of the Pontiff of Rome. (The Roman Catholic Church is
organized into districts known as dioceses. Each diocese is led by a type of priest called a
bishop, and all of the parish priests within a diocese are under the authority of its bishop. When
the bishop of a diocese believes that one of the priests under his authority should be honored
for his exceptional service to the church, he can nominate that priest for the title of monsignor.
The Pope reviews the nomination and makes the final decision. If he decides to grant the title
of monsignor to the nominee, the Secretariat of State of the Vatican honors the new monsignor
with a formal diploma).

He was a Roman Catholic Vatican II priest who lived in full harmony with the Roman
Catholic Vatican II Church and the Popes of Rome. He was very close and was going to become
one with the priests and bishops of BCR before he suddenly passed away.
