VALIDITY AND LICITNESS OF HOLY ORDERS
"A validly consecrated bishop can validly confer all orders from the minor orders to the
episcopate inclusively ... For this reason the ordinations performed by the bishops of the Carlos
Duarte Costa episcopal lineage are consider valid." A Practical Commentary on the Code of

Canon 845 §1. Since the sacraments of baptism, confirmation, and orders imprint a
character, they cannot be repeated.
Canon 845.1 tells us that the sacrament of orders, like the sacraments of baptism and
confirmation, imprints a character on a person’s soul. It can never be erased (which is
incidentally why these sacraments can be validly administered only once). And since it can
never be erased, a bishop who falls away from the Church is still a bishop. And since he is still
a bishop, he can still validly administer Catholic sacraments, even if he has left the Catholic
Church! …

xxx Despite canon law can be implied of the 1917, the 1983 canon law has no effect,
but in regards validity of the transmission of Holy Orders of the spirit.
The Augustinian Theory effectively holds that valid episcopal ordination confers an indelible
character that is not affected by any schismatic or heretical act or excommunication taken in
response thereto or for any other reason. Accordingly, a validly ordained priest, once validly
ordained to the episcopate, retains his capacity to exercise that order, though he may have been
deprived juridically of the office or jurisdiction by which he performed episcopal acts. The
latter considerations affect only the licitness of his acts.

Scipione Rebiba was an Italian cardinal of the Catholic Church. He is of particular
ecclesiastical significance since more than 95% of all living Catholic bishops trace
their episcopal lineage back to him – such as BISHOP JORGE MARIO BERGOGLIO (Pope
Francis), BISHOP JOSEPH ALOISIUS RATZINGER (Pope Benedict VI), and the rest of
95% living bishops around the world today.

25. POPE Paul IV (CARAFA Pietro Gian) (1476- 1559). Created Cardinal, Bishop of Chieti,
consecrated in Rome by Oliviero Cardinal Carafa. September 18 1506. Archbishop emeritus
of Napoli, who was Elected and crowned Pope as Paul IV. When he was 80 years old. He is
buried in the Church of Santa Maria sopra Minerva. in Rome.
26. CARAFA Oliviero (1458- ??). Created Cardinal .Archbishop of Napoli, consecrated
December 29th, 1458 at Torre del Greco by Leone de Simone. Bishop of Nola, assisted by
Leone Cortese, Bishop of Acerra and Benedetto, Bishop of Dragonara. During the last years
of his life, which coincided with the pontificate of Pope Julius II, Carafa was regarded as a
wise counsellor of the Church. He died on 20 January 1511. His tomb is in the Carafa
Chapel of Santa Maria sopra Minerva.
27. SIMONE de Leone (?? - 1492). Bishop of Torina, Italy named December 1469. Bishop of
Genève {Geneva}, Switzerland, July 1482, named Archbishop Archbishop of Tarentaise
(Moûtiers-en-Tarentaise), France June 1484. Died in June 1492.

He took up Canon Law at the Pontifical University Santo Tomas from 1983 up to 1985.
He was a member of the CLSP (Canon Law Society of the Philippines). He was made a
Monsignor by the full authority of the Pontiff of Rome. (The Roman Catholic Church is
organized into districts known as dioceses. Each diocese is led by a type of priest called a
bishop, and all of the parish priests within a diocese are under the authority of its bishop. When
the bishop of a diocese believes that one of the priests under his authority should be honored
for his exceptional service to the church, he can nominate that priest for the title of monsignor.
The Pope reviews the nomination and makes the final decision. If he decides to grant the title
of monsignor to the nominee, the Secretariat of State of the Vatican honors the new monsignor
with a formal diploma).
He was a Roman Catholic Vatican II priest who lived in full harmony with the Roman
Catholic Vatican II Church and the Popes of Rome. He was very close and was going to become
one with the priests and bishops of BCR before he suddenly passed away.
