SUBJECT : REQUEST FOR ISSUANCE OF PRESIDENTIAL


PROCLAMATION ESTABLISHING THE MACTAN NORTH
RECLAMATION AND DEVELOPMENT PROJECT (MNRDP)
OVER A TRACT OF FORESHORE AND SUBMERGE LAND
OF THE PUBLIC DOMAIN SITUATED IN BARANGAYS OF
IBO, BUAYA, MACTAN AND PUNTA ENGAÑO AND
RESERVING THE SAME UNDER THE ADMINISTRATION
AND RESERVING THE SAME UNDER THE
ADMINISTRATION OF THE CITY GOVERNMENT OF
LAPU-LAPU.

This refers to the request of the office of the City Mayor of Lapu-lapu thru
the project manager of Mactan North Reclamation and Development Project
(MNRDP) for issuance of Presidential Proclamation.

I. BACKGROUND :

The office of the City Mayor of Lapu-lapu thru the Project Manager of
Mactan North Reclamation and Development Project (MNRDP) requested for the
issuance of Presidential Proclamation of the Regional Executive Director, DENR
7, Banilad, Mandaue City. The subject public land applied for is covered by
Sketch Plan No._____ and approved in ___________________, by Regional
Technical Director, LMS, DENR 7, Banilad, Mandaue City with an area of 4, 052,
329 square meters as 408.2329 hectares more or less as reflected on the plan
the public land applied for is bounded the north by Mactan channel; on the east
by Magallanes Bay; on the south and southwest by Magellan Bay; and on the
west by Magellan Bay.

II. JUSTIFICATION:

The Mactan North Reclamation and Development Project (MNRDP) is


primarily envisioned as industrial estate with international port and port related
activities expected to alleviate the present socio-economic problems besetting
Metro Cebu. Once completed and locators will move in its intended to become an
economic zone for light industries expected to generate 80, 000 to 100, 000 jobs
for Cebuanos and neighboring island provinces. The MNRDP will also have a
mixed land use to include commercial/business area and tourism area. It will
serve as a catalyst of development for Lapu-lapu City and Metro Cebu.

III. Legal Basis:

Section 83, Chapter XII, Title V of the Public land Act, as amended,
quoted in part as follows:

“Upon the recommendation of the Secretary of Agriculture and Natural


Resources, the President may designate by proclamation any tract or tracts of
land of the public domain as reservation for use of the Republic of the Philippines
is of any of its branches with the regulations prescribed for the purposes, or for
quasi-public use or purposes when the public interest requires it including
interest requires it including reservation for highways, right of way for raid roads,
hydraulic power sites, irrigation systems, communal pastures or leguas
commonals, public parks, and other improvements for public benefits.”

Section 14 of the Revised Administrative Code of 1987, Chapter 4, Book


III.

Power to Reserve Lands of the Public and Private Domain of the


Government.

1 The President should have the power to reserve for settlement by public
use and for specific public purposes, any of the lands of the public domain, the
use of which is not otherwise, directed by law. The reserved land shall there after
remain subject to the specific public purposes indicated until otherwise provided
by law or proclamation.

2. he shall also have the power to reserve from sale or other disposition and
for specific public use or purposes, any land belonging to the private domain of
the Government, or any of the Friar Lands, the use of which is not otherwise
directed by law, and thereafter such land shall be used for the purposes
specialized by such proclamation until otherwise provided by law.”

V. COORDINATION WITH AGENCIEs CONCERNED:

All the above-listed government agencies have been consulted and did
not oppose the proclamation issuance.
VI. POTENTIAL PROBLEMS :

There is no legal impediment to the processing and approved of the


request for issuance of presidential proclamation in favor of the City Government
of Lapu-lapu.

VII. RECOMMENDATION :

This office respectfully recommends the issuance of Presidential


Proclamation Established of the Mactan North Reclamation and Development
Project (MNRDP) over a tract of foreshore and submerged land of the public
domain coveting an aggregate are 4, 082, 329 square meters, more or less as a
mixed industrial/commercial estate and tourism estate, situated in the barangays
of Ibo, Buaya, Mactan and Punta Engaño, Lapu-lapu.
