General Acts 46, 47 and 48 Capital Budget Excerpted to be

read in conjunction with General Act 82 RCAP Capital


Project Itemization.

Act 46 is the Fiscal Code, which moves money between state


funds—including using Tobacco Settlement Funds to pay pension
costs (typically a General Fund Expenditure).

Act 47 – Authorizes $1.59 billion in bonds to be issued for 2010-11


Capital Budget and specifies some RACP projects to be funded by
this borrowing (including Arlen Specter Library)

Act 48 – Increases RACP debt ceiling; increase needed to allow for


2010-11 borrowing under Act 47.

Act 82 – Further itemizes capital budget projects (including RACP,


transportation, and public building improvements), and increases
total state borrowing allowed under these programs

(Note that Act 82 is the total borrowing cap for each program, not
the 2010-11 borrowing, or the limit on debt outstanding.)

ACT 46 July 6 SB 1042 Tier 3 Against Liberty


This Act implements the unbalanced, unaffordable and
unconstitutional Budget, for example, misusing Tobacco Fund
money by transferring to unauthorized use in General Fund.
ACT 47 July 7 HB 2289 Tier 3 Against Liberty
Capital Budget is infamous for containing $10 million for Arlen
Specter library and 10 million for John Murtha library. Both the
General Fund budget and the Capital Budget contain WAMs, the
Pennsylvania equivalent of Earmarks. The Forgotten Taxpayer is
having his and her money expropriated for projects that do not
benefit the common wealth.
ACT 48 July 7 HB 2290 Tier 3 Against Liberty
This Act is ancillary to General Fund and Capital Budget and is
against for reasons set forth above.

HB 2291 Capital Budget Project Itemization Act of 2010-
2011 also known as RCAP

Tier 3 Against Liberty A “yea” vote deducts 50 points from


grade and “nay” vote adds 50 points to grade.
RCAP Redevelopment Capitalization Assistance Projects and
authorizes $12 BILLION in new debt and covers a vast array of
projects. It seems impossible for any legislator or committee to
evaluate these projects. There are no indications of criteria or the
efficacy of the projects, that is, will the appropriation achieve the
results intended. The cost benefit is not assessed or referenced.
