Scouting for restoration of five freedoms for Animals: Smt. Sukanya
Berwal, conducting her research in Gujarat, on Effectiveness of Natural Environment and Animal Welfare Awareness Programme for Secondary School Students of std. IX, being volunteer of Wildlife Crime Control Bureau with the Honorary Animal Welfare Officer, behind Commissioner of Education, Scouts and Guides for Animals and Birds with United Nation affiliated OIPA: Indian People for Animals, convinced me, performing her fundamental duties as a part of Community Policing, as: 1. Animals five freedoms, recognised all around Universe, even court of law also endorsed, MMSME/E/2020/01373 with GOVGJ/E/2020/13730 and MOEAF/E/2020/02120 with MOEAF/E/2020/02157 needs immediate attention along with GOVGJ/E/2020/14482. 2. GOVGJ/E/2019/02489 and GOVGJ/E/2020/13478 was lodged, because as per section 2(1) of the Gujarat Police Act, 1951: Cattle defined, including elephants, camels, horses, asses, mules sheep, goats and swine, whereas Elephant is a scheduled 1, protected wild animals, under the Wildlife Protection Act, 1972, besides its decorated as National Heritage animal. 3. Section 33 of Chapter IV: Power to make rules for regulation of traffic and for preservation of order in public place, etc but movement of Elephants in captivity, never regulated, even banned Iron ankush applied to handle, whereas Elephant power is more strong then horse power but to control horse power, there is mechanism, why not for Elephant power? Section 33(f), regulating the leading, driving, conducting or conveying of any elephant or wild or dangerous animal through or in any street. 4. Destruction of stray dogs, defined under section 44: The Commissioner and the District Superintendent in areas under their respective charges, may from time to time, by public notice, proclaim that any stray dogs found, during such period as may be specified in the said notice, wandering in the streets or in any public place may be destroyed, and any dog so found within such period may be destroyed accordingly. 5. Destruction of suffering or unfit animals, also clarified under section 45 of said Act. , Police officer may take charge of stray cattle, as per section 89, Power to establish cattle-pounds and appoint pound-keepers, as per section 90. 8. No suitable vehicle to carry Elephants as GJ-37-T-9758 was caught, without RTO permission, to carry sick elephants, 11208051201148 of 2020, crime was lodged with B-Division Police Station, Rajkot city for the offences punishable under Section 342, 384, 506(2), 170 and 114 of I.P.C., 1860. 9. Omit IVORY under the Gujarat Khadi and Village Industries Act, 2006: Group-IV: Polymer and Chemical Based Industry (53) Horn and Bone including ivory products. The Indian Penal Code, 1860: Section 429: Mischief by killing or maiming cattle, etc., of any value or any animal of the value of fifty rupees: Whoever commits mischief by killing, poisoning, maiming or rendering useless, any elephant, camel, horse, mule, buffalo, bull, cow or ox, whatever may be the value thereof, or any other animal of the value of fifty rupees or upwards, shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. Public Grievance: Elephant, being National Heritage Animal, covered under protection cover of schedule 1 of the Wildlife Protection Act, 1972 then being Govt. property, under section 39 of the said Act, how anybody assessed value of Elephant in Indian currency as whatever may be the value thereof, or any other animal of the value of fifty rupees or upwards, hence omit Elephant word without any further delay, under the definition of 429 IPC. Hence, Omit IVORY under the Gujarat Khadi and Village Industries Act, 2006: Elephant had been omitted from the definition of Cattle in Punjab, 2 legislations in Haryana but Cattle Trespass Act, Indian Forest Act, Delhi Police Act along with Bombay Police Act and Gujarat Police Act with the definition of 429 IPC, needs amendment at once, keeping in view observations of Smt.
