Action by CWLW to cancel private ownership of 2 female elephants by Great Golden


Circus, violated Project Elephants guidelines dated 8-1-2008, regular complaints lodged by
OIPA: Indian People for Animals with Scouts & Guides for animals & birds, whereas CZA
recall its recognition under section 38-H of the Wildlife Protection Act, 1972, due to tireless
services of Sukanya Berwal with Abhishek Kadyan & Suman Kadyan.
As per CZA reports, Great Golden Circus have NO funds for treatment, care & shelter,
these 2 Elephants, being property of Government, Great Golden Circus have NO legal
rights to handed over the custody to some religious establishment, hence CWLW of
Gujarat may take custody of abused elephants without any further delay, cancelling
private ownership & recommending criminal proceedings against the Proprietor of Great
Golden Circus, violation of many cognizable offenses, submitting false & fabricated
documents, elephants travelling by goods transport vehicle without permission, performing
with unregistered animals with AWBI & so on.
Rajkot Police of B-Division may cancel the baseless FIR was lodged by him.

SUBJECT: Legal Notice under section 55 of the Wildlife Protection Act, 1972 read with the
Prevention of Cruelty to Animals Act, 1960 & IPC.
Memo:
Kindly refer to the complaint lodged with the Rajkot Police in Gujarat against Great Golden
Circus but Wildlife officials never performed their officials duties being cognizable offence,
committed by Great Golden Circus, in legal terms as elephant in the custody is unlawful & illegal,
violated section 39 of the Wildlife Protection Act, 1972 read with 188, 268, 289, 120-B, 420 IPC and
Prevention of Cruelty to Animals Act, 1960, threat to public life & property, whereas No
equipments to tranquilize elephants in emergency condition, handled by iron ankush.
It has been learnt that CZA terminate recognition under section 38-H of the Wildlife Protection
Act, 1972 but appeal accepted by the Secretary of the Ministry conditionally, which also against the
law, keeping in view the instructions of Project Elephants issued as on 8-1-2008 as ownership never
renewed, AWBI ban elephant performances in Circus as PETA India inspected 16 Circuses
including Great Golden Circus, after considering this report, AWBI issued Advisory.
United Nation affiliated International Organisation for Animal Protection: OIPA in India, served
legal Notice upon you under section 55 of the Wildlife Protection Act, 1972 because microchip
numbers of the elephants is different, which is procured adopting unlawful mechanism, whereas
elephant of the microchip number allowed by the CZA, died due to cruel handling but Great
Golden Circus concealed the information, cheating all enforcement agencies as criminal conspiracy.
The CWLW of Gujarat alerted, spoken that OIPA in India, ready to take the custody of elephants
during court trials for treatment, care & shelter, hence confiscate the elephants at once, direction
Rajkot Police to add different sections of IPC being cognizable offense & lodge FIR.

Greetings,
Kindly refer to the CZA reply with AWBI recognition & MoEF Project Elephant
guidelines for care & management of captive elephants - instructions dated 8-1-2008,
whereas performance age of animals has been passed, which are replaced with new
animals, additional animals never been disclosed keeping in view AWBI confirmation as
advisory prohibiting elephant performance.
It is humbly submitted that:
1. Rajkot Police complaint lodged against Great Golden Circus for the violations of non
cognizable offenses instead different sections of IPC & Wildlife Protection Act, 1972.
2. Great Golden Circus performing with unregistered animals at two places without
approval of CZA & AWBI, concealing facts with all concerned Authorities, whereas CZA
reported that 10 Dog Common, 3 Elephant Indian, 2 Goat Common, 7 Horse & 8 Mcaw,
vide its letter dated 14-9-2012, keeping in view above said animals either dead or not
capable to perform due to old age because every animals have age span, deep investigation
required as animals replaced with another unregistered animals, which is an offense as
breaching of trust, cheating enforcement agencies, bluffing them with wrong information’s.
3. As per MoEF Project Elephant guidelines for care & management of captive elephants -
instructions dated 8-1-2008, after every 5 years, ownership of elephants be renewed,
keeping in view all legal provisions, which are not followed.
Rajkot Police lodged complaint against Great Golden Circus, while stationed at Vadodara,
said circus was penalized due to violations, whereas Rajkot Police, needs to reviews the
offenses being cognizable, performances with all unlawful animals may be stopped &
confiscated for further rehabilitation. Scouts & Guides for Animals & Birds can take the
charge of all animals during court trials, whereas CZA restore their recognition,
conditionally under section 38-H of Wildlife Protection Act, 1972 but as per AWBI
Advisory, circus not authorized to perform with elephant.

Appeal against De-recognition of Great Golden Circus by CZA, accepted by the Appellate
Authority, which is illegal & unlawful, because:
1. No tranquilizer gun with other equipments with the Circus, never compliance the
terms & conditions.
2. AWBI issue advisory after detailed discussion, considering PETA India report of
investigation, Great Golden Circus was one of them, claimed cruel treatment with
animals, hence AWBI – CZA recognition be withdrawn at once.
