2011-368

Parking Ordinance

WHEREAS, Roosevelt City is a municipal corporation, duly organized and existing under the laws of
the State of Utah; and

WHEREAS, It is the goal of Roosevelt City to ensure the safety of its citizens and the accessibility of
its streets; and

WHEREAS, Roosevelt City is charged with the responsibility of cleaning its streets and keeping them
accessible to emergency vehicles, the street sweeper and garbage collection contractor.

NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THIS MUNICIPALITY


AS FOLLOWS:

Section I Unlawful to disobey parking regulations

a. It is unlawful to disobey signs or markings placed by the City which prohibit parking or
regulate the hours thereof. It is unlawful to park in violation of curb or painted roadway markings
designated by the City.
b. It is unlawful to erect any signs or to mark publicly owned curbs in such a manner that
attempts to prohibit parking or regulate traffic without the consent of the City.
c. Exemptions include, but are not limited to, emergency vehicles, government and City
vehicles, while acting in an official capacity.

Section II Double parking

a. It is unlawful for any person to park or leave upon any street, any vehicle, attended or
unattended, along the side of any parked vehicle where such vehicle is parked parallel with the curb,
except for temporary loading and unloading of passengers, or when directed by traffic signals or a
police or enforcement officer.

Section III Unlawful types of parking


In addition to types of standing, stopping or parking declared illegal in other sections of this
code, it is illegal to park a motor vehicle or trailer under the following circumstances, except when
directed by a police or enforcement officer.

a. No person shall park a vehicle or trailer on the public right-of-way for more than a
consecutive seventy two hour period. A person may not move a vehicle or trailer or leave and re-enter a
parking space for the sole purpose of avoiding the effect of this section.
b. No person shall park a vehicle on the public right-of-way for the purpose of repairing the
vehicle, except in emergency situations.
c. No person shall park a vehicle or trailer between the back of the curb and the sidewalk.
d. No person shall park a vehicle on a street, public property or private property for the principle
purpose of displaying the vehicle for sale or displaying advertising, unless the person or his agent has a
valid, appropriate City license.

Section IV Obstructing traffic


a. No person shall park any vehicle upon a street in such a manner as to leave available less than
ten feet of roadway for vehicular movement or when any vehicle creates a safety hazard for other
motorists or pedestrians.
b. Vehicles parked in violation of this ordinance may be removed at the direction of a police or
enforcement officer.

Section V Parallel parking

a. All parking shall be parallel, except as designated with signage and/or markings.

Section VI Trailers

a. It is unlawful to park or keep in the public right-of-way any trailer, unattached boat or camper
for more than a seventy two hour period.

Section VII Fire lanes

a. It is unlawful for any person to park or stop a vehicle on any designated fire lane, regardless
of whether or not the driver remains with the vehicle. This section shall not apply to any public safety
vehicle on official business.
b. Designated Fire Lane means any area in front of the entrance to a commercial business or
public building, which has been marked or posted as a fire lane.
c. Any vehicle parked in violation of this section is declared a public hazard and may be
removed at the direction of the property owner or his agent or a police or enforcement officer.

Section VIII Enforcement

a. All violations of this chapter shall be deemed infractions and shall be punishable by a fine not
to exceed seven hundred fifty dollars per violation.
b. Citations issued for violations of this chapter may be issued to the registered owner of the
vehicle in violation by leaving a uniform summons and citation affixed to the vehicle in a conspicuous
location. A summons and information will be served on registered owners failing to comply with the
uniform summons and citation within a fourteen day period.

NOW THEREFORE, BE IT FURTHER ORDAINED, that this ordinance shall take effect upon
publication as required by law.
