172.1 Applicability.

(a) This part formalize the requirements for authorizations and/ or certification to provide:

(1) Air Traffic Services.

(2) Aeronautical Information Services

(3) Aeronautical Charts.

(4) Search and Rescue.

(5) Meteorological Service for International Air Navigation and the privileges and limitations
of such authorization .

(b) This part shall not apply to Air traffic operated by and under the control of the Minister
for Deference.

172.3 Definitions.

When the following terms are used in this part they have the following meaning:
Aerodrome: A defined area on land or water (including any building , installations and
equipment) intended to be used either wholly or in part for the arrival , departure and
surface movement of aircraft.

Aerodrome control service : Air traffic control service for aerodrome traffic.

Aerodrome traffic: All traffic on the maneuvering area of an aerodrome and all aircraft
flying in the vicinity of an aerodrome.

Aeronautical charts means representation of apportion of the earth , its culture and relief ,
specifically designated to meet the requirements of air navigation.

Aeronautical Information Circular (AIC): A notice containing information that does not
qualify for the origination of a NOTAM or for inclusion in the AIP, but which relates to flight
safety, air navigation, technical, administrative or legislative matters.

Aeronautical information service : A service established within the defined area of


coverage responsible for the provision of aeronautical information/data necessary for the
safety, regularity and efficiency of air navigation.

AIP Amendment: Permanent changes to the information contained in the AIP.


AIP Supplement. Temporary changes to the information contained in the AIP which are
published by means of special pages.

AIRAC: An acronym (aeronautical information regulation and control) signifying a system


aimed at advance notification based on common effective dates, of circumstances that
necessitate significant changes in operating practices.

Aeronautical information system: means the integrated aeronautical information


package as defined in the Tenth Edition of the ICAO Annex 15 to the Convention
( International Standards and Recommended Practices – Aeronautical Information Services )
at Amendment 31;

Aeronautical Fixed service (AFS): A telecommunication service between specified fixed


points provided primarily for the safety of air navigation and for the regular , efficient and
economical operation of air service .

Aeronautical Information Publication (AIP): A Publication issued by or with the


authority of a State and containing aeronautical information of a lasting character essential
to air navigation.

Air Traffic: All aircraft in flight or operating on the maneuvering area of an aerodrome.

Air traffic Control Service: Means a service provided for the purpose of:

(a) Preventing collisions


1. Between aircraft.

2. On the maneuvering area , between aircraft and obstructions , and

(b) Expediting and maintaining an orderly flow of air traffic.


Air Traffic Control Unit . A generic term meaning variously area control centre , approach
control unit or aerodrome control tower.

Air Traffic Service: A generic term meaning variously , flight information service, alerting
service , air traffic advisory service , air traffic control service ( area control service ,
approach control service or aerodrome control service).

Air Traffic Service Unit: A generic term meaning variously area control unit flight
information centre or air traffic services reporting office.

Alerfa: The code word used to designate an alert phase.


Alerting Service: A services provided to notify appropriate organizations regarding aircraft
in need of search and rescue aid, and assist such organizations as required.

Alerting Post: A unit designated to receive information from the general public regarding
aircraft in emergency and to forward the information to the associated rescue coordination
center

Alert Phase: A situation wherein apprehension exists as to the safety of an aircraft and its
occupants.

Appropriate ATS authority: The relevant authority designated by the State responsible
for providing air traffic services in the airspace concerned.

Area Control Centre: A unit established to provide air traffic control service to controlled
flights in control areas under its jurisdiction.

Control Area: A controlled airspace extending upwards from a specified limit above the
earth.

Controlled Aerodrome: An aerodrome at which air traffic control service is provided to


aerodrome traffic.

Date quality: A degree or level of confidence that the data provided meets the
requirements of the data user in terms of accuracy . resolution and integrity.

Detresfa : The code word used to designate a distress phase.

Distress Phase: A situation wherein there is reasonable certainty that an aircraft and its
occupants are threatened by grave and imminent danger or require immediate assistance

Emergency Phase: A generic term meaning, as the case may be, uncertainty phase, alert
phase or distress phase.

Flight Information Region: An airspace of defined dimensions within which flight


information service and alerting service are provided.

Flight information service: A service provided for the purpose of giving advice and
information useful for the safe and efficient conduct of flights.

Forecast: A statement of expected meteorological conditions for a specified time or period,


and for a specified area or portion of airspace
Human Factors Principles: Principles which apply to aeronautical design, certification,
training, operations and maintenance and which seek safe interface between the human and
other system components by proper consideration to human performance.

INCERFA: The code word used to designate an uncertainty phase.

Integrity (aeronautical data): A degree of assurance that an aeronautical data and its
value has not been lost nor altered since the data origination or authorized amendment.

International NOTAM Office: An office designated by a State for the exchange of NOTAM
internationally.

Meteorological office: An office designated to provide meteorological service for


international air navigation.

Meteorological Service for International Air Navigation: Means a service provided for
the purpose of:

Supplying the following users: operators , flight crew members, air traffic services units,
search and rescue services units airports managements and other concerned with the
conduct or development of international air navigation , with the meteorological information
necessary for the performance of their respective functions.

NOTAM: A notice distributed by means of telecommunication containing information


concerning the establishment, condition or change in any aeronautical facility, service,
procedure or hazard, the timely knowledge of which is essential to personnel concerned with
flight operations.

Radiotelephony: A form of radio communication primarily intended for the exchange of


information in the form of speech.

Rescue coordination centre: A unit responsible for promoting efficient organization of


search and rescue services and for coordinating the conduct of search and rescue
operations within a search and rescue region.

Rescue sub centre: Untie subordinate to rescue coordination center established to


complement the latter within a specified portion of search and rescue region.

Search and Rescue: Means a service provided for the purpose of which is to assist states
in meeting their search and rescue needs and obligations accepted under the convention on
international civil aviation .
SIGMET information: Information issued by a meteorological watch office concerning the
occurrence or expected occurrence of specified en-route weather phenomena which may
affect the safety of aircraft operations

The Chicago Convention: Has the meaning ascribed to it in the civil Aviation law (50) of
the 1985;

The Convention: Means the Chicago Convention;

The Law : The Civil Aviation Law NO.( 150 of 1985) as amended.
The Personnel Licensing Order: Means the Civil Aviation Authority (Personal Licensing)
2000 ( part 65) as amended;

The personal in charge of an aerodrome: Means in the case of a licensed aerodrome,


the licensee and , in the case of any other aerodrome, the owner or licensees of the property
concerned.

Uncertainty phase: A situation wherein uncertainty exists as to the safety of an aircraft


and its occupants.

172.5 Provision_of_Air_Traffic_Services

In the case of an aerodrome in respect of which there is equipment for providing a holding
aid let down aid or approach aid by radio communication or signals or by radar , the person
in charge of that aerodrome shall:

(a) Inform the Authority and the users of that aerodrome in advance by means of the
aeronautical information system of the periods during and times at which any such
equipment is to be in operation for the purpose of providing such aid as is specified by the
said person; and

(b) During any period and at such times as are notified cause an air traffic control service to
be provided at that aerodrome;

(c) Ensure that any call sign, where the aerodrome has been provided with a means of two-
way radio communication, is not used for a purpose other than-that for which the call sign
has been notified:

(1) A person in charge of the provision of an air traffic control service shall not provide such
a service in respect of an aerodrome or generally in respect of an area of airspace within
that airspace otherwise than under and in accordance with the terms of an air traffic control
approval certificate granted to that person by the Authority;

(2) The Authority may grant an air traffic control approval certificate if it is satisfied that the
applicant is competent , having regard to that applicant’s organization , staffing ,
equipment and systems and their maintenance and –other- arrangements to provide such a
service which is safe for use by aircraft;

(3) An air traffic control certificate may be granted subject to such conditions and
requirements as the Authority thinks fit and shall , unless suspended or revoked , remain in
force for the period specified in the approval certificate;

(4) The holder of an approved certificate under this article to provide an air traffic control
service at any place shall :

(i) Not permit a person to act as an air traffic controller in the provision of the service unless
that person is the holder of a current air traffic controller license appropriately rated for the
service to be provided at that place in accordance with the Personnel licensing Order if
required by that Order ;
(ii) Provide an air traffic control service in accordance with :

(A) The Standards specified in the {Thirteenth } Edition of Annex 11 to the Convention
( International Standard and Recommended Practices – Air Traffic Services ) , and

(B) Such of the Recommended Practices of Annex 11 as are required pursuant to a direction
under this Article and .

(C) Insofar as possible the other Recommended Practices of Annex 11 and

(D) Such procedures as are specified in a manual of air traffic services , incorporating the
Standards and Recommended Practices specified above, in respect of that place .

(5) The manual of air traffic services referred to in sub-paragraph (b) of paragraph 4 above
shall be produced to the Authority on request and shall incorporate such amendments and
additions as the Authority may from time to time require.

172.7 Provision of Aeronautical information Services.

The certificated Aeronautical Information Services provider shall provide Aeronautical


information services in accordance with:

(a) The standards specified in Twelfth Edition of Annex 15 to the convention international
standards and recommended practices, Aeronautical information services and

(b) Such of the Recommended Practices of Annex 15 as are required pursuant to a direction
under this Article , and

(c) Insofar as possible the other Recommended Practices of Annex 15 , and

(d) Such procedures as are specified in a manual of air traffic services, incorporating the
Standards and Recommended Practices specified above, in respect of that place.

172.9 Provision of Aeronautical char

The certificated Aeronautical Charts Services provider shall:

(a) Provide Aeronautical charts in accordance with The standard specified in Twelfth Edition
of Annex 4 to the convention International Standards and Recommended Practices,
Aeronautical Information Services and

(b) Such of the Recommended Practices of Annex 4 as are required pursuant to a direction
under this Article and.

(c) Insofar as possible the other Recommended Practices of Annex 4 and

(d) Such procedures as are specified in a manual of air traffic services , incorporating the
Standards and Recommended Practices specified above , in respect of that place to:.
(1) Produce the chart or a sheet itself, or

(2) Arrange for its production by another contracting state or by an agency, or

(3) Provide another contracting state prepared to accept an obligation to produce the chart
or sheet with the date necessary for its production.
(4) Ensure that the information it provides and the aeronautical charts made available are
adequate and accurate and that they are maintained up to date by an adequate revision
service.

172.11 Provision of Search and Rescue.

Royal Jordanian Air Force (RJAF) with co-ordination with Air Traffic Services provider shall
provide Search and Rescue in accordance with:

(a) The standards specified in the Eighth Edition of Annex 12 to the convention (International
standards and recommended practices, Search and Rescue) and

(b) Such of the Recommended Practices of Annex 12 as are required pursuant to a direction
under this Article and.

(c) Insofar as possible the other Recommended Practices of Annex 12 and

(d) Such procedures as are specified in the manual of air traffic services, incorporating the
Standards and Recommended Practices specified above, in respect of that place.

172.13 Provision of Meteorological Service.

(a) The Meteorological Department, hereinafter is referred to as the Meteorological


Authority, to provide or to arrange for the provision of Meteorological service on its behalf
for International Air Navigation in accordance with the Fifteenth Edition of Annex 3 to the
convention.

(b) The Meteorological Department shall ensure that the Department complies with The
requirements of the World Meteorological Organization (WMO) in respect of qualifications
and training of metrological personnel providing service for international air navigation.

172.15 Safety Management standards.

(a) The air traffic services provider shall establish and implement a safety management
standards (SMS) for the provisions of air traffic services standards by December 2007.
A(SMS) shall ensure a formalized , explicit and proactive approach to safety which enable
air traffic service to:
(1) Meet its safety responsibilities within the provision of ATS;
(2) Ensure the general safety policy statement by the high management levels which define
the fundamental approach of ATS to managing safety;

(3) Ensure that the achievement of satisfactory safety levels in the provision of ATS shall be
afforded the highest priority over commercial, operational , environmental or social
pressures;

(4) Ensure while providing ATS, principle safety objective is to minimize the contribution of
the ATS to the risk of an aircraft accident;

(5) Ensure that risk assessment and mitigation are conducted to an appropriate level to
ensure that due consideration is given to all aspects concerning ATS management;

(6) Ensure that safety – related enhancement are implemented without delay whenever
necessary; and

(7) Ensure that all persons involved in the safety aspects of the provision of ATS have an
individual safety responsibility for their own actions;

(8) Ensure the implementation of any remedial or preventive measures to eliminate and/or
mitigate a risk;

172.17 Occurrences Reporting.

Air Traffic Services provider shall ensure that all safety related occurrences are reported
without delay and all required actions are taken

172.19 Directions for the provision of Air Traffic Services standards.

(a) The Authority may , in the interests of safety , direct the person in charge of an aerodrome or
more generally , a person in charge of the provision of air traffic services that there shall be
provided in respect of that aerodrome or a specified area of airspace such an air traffic control
service , flight information service or a means of two-way radio communication as the Authority
considers appropriate and specifies in such a direction :

(b) The Authority may specify in a direction under this part the periods during which , the
manner in which and the area of airspace within which , such service or such means shall be
provided;
(c)The person who has been directed in accordance with paragraph (a) or (b) of this Article
shall cause such a service or means to be provided in accordance with that direction .

(d) The Authority may give directions for carrying out the purposes of this part and may
exempt a person from any provision of this part subject to any conditions specified which
shall be complied with by that person; and
(e) Directions under this part may be given in the from of Aeronautical Notices or
Aeronautical Information Circulars or by notice sent by registered post to the person
affected.
172.21 Fees.

An application to the Authority for an approval pursuant to article 172.17 of this part shall be
in writing and shall be accompanied by the appropriate fee which will be determined from
time to time by the Authority.
