enue loss from the surety bonds may have reached billions of pesos in gov-
ernment collectibles.
Insurance Commissioner Atty. John Apatan confirmed that the BoC
was not able to collect the surety bond payments because a number of the
surety companies already closed shop. He estimated the amount uncollected
could amount to hundreds of millions of pesos.
Customs Deputy Commissioner Alexander Arevalo said importations
are released only upon full payment of customs duties in cash or surety
bonds by the importer.

The Garcia Affair
There has been much noise lately regarding the plea-bargain
agreement involving former Armed Forces of the Philippines
comptroller, retired Maj. Gen. Carlos Flores Garcia, with the
Sandiganbayan bearing the brunt of public criticism on that
agreement. The public flogging of the Sandiganbayan Special Second
Division even hinted of anomalies in the outing of such a plea-bargain
agreement under which the disgraced general will have to surrender
assets and bank deposits valued at over P100 million in exchange for
his release from jail and a guilty plea on a lesser crime deal.
The public outcry centered on why a plea-bargain agreement
should be entertained in the first place when the government has a
tight case over the plunder case. The truth of the matter is that the
Sandiganbayan Second Division’s ruling, when read fully, will bring
out the fact that the resolution on the matter, promulgated on May
4, 2010, was couched in such a language as to ensure that the state’s
interest is fully acknowledged and that the plea-bargain agreement is
conditioned on the return first of the various assets and bank deposits
