OBJECTSAND REASONS

This Bill, divided into six parts,proposesthe enactment


of the
constitutionalReview Act, 2011, for the purposesof establishing
the
constitutionalReview commissionand the secretariat
for colleJting
publicopinionson theconstitutional review.The constitutional review
is intendedto examine-consistency and compatibilityof the existing
constitutionwith regardsto sovereignty, political sysiems,democrac!
andgood governancethroughoutthtuniGd Republicof
ranzania.The
legal'rechanismthatis proposedwill enableparticipation
of thepeople
ofranzania in the constitutionalreviewpro..rr. once enacted
into law,
there shall be a legal frameworkfoi the president
to establisha
commission for reviewing the constitution and to
constitutethe
constituentAssemblyfor purposesof enactinga nervconstitution.

Part I providesfor the preliminarymatterswhich include


the title,
dateof commencement and applicatitnof theproposedAct.It further
providesfor the interpretationof certainterms,designations
andwords
usedin the proposedenactment.

PartII providesfor objectivesofthe proposedAct.Thepart


specify
in detailsthe objectivesandthe essenceof constitutionalreviewprocess,
including oath of membersof the commissionand
membersof the
Secretariatand the procedurethroughwhich the constitutional
review
processwill be undertaken.

PartIII of the Bill providesfor the establishment


of a commission
which will coordinate_and collect public opinions for purposesof
constitutionalreview. This part alsodealswiih the compositi-on
ofthe
comrnissionandTermsofReferenceandmannersin which
they canbe
givenby thePresident;powersof theproposedorgans,
subscriptionof
