RESOLUTION AWARDING A PROFESSIONAL SERVICE AGREEMENT TO

CAMP, DRESSER & McKEE, INC. TO SERVE AS AN EXPERT IN THE
LITIGATION OF CITY OF JERSEY CITY V. RELIABLE PAPER RECYCLING, INC.

COUNCIL offered and moved adoption of the following resolution:

WHEREAS, the City of Jersey City fied suit against Reliable Paper Recycling, Inc. in Superior
Court of New Jersey alleging defendant's business has caused and continues to cause the emission
of trace amounts of substances created by the decomposition of woody materials creating and/or
discharging into the air, vile, obnoxious, nauseating and/or noxious odors; and

WHEREAS, the City of Jersey City wil require the services of an expert to assist the City of Jersey
City in understanding the cause, magnihide and potential mitigation measures at Reliable
Recycling; and

WHEREAS, Camp, Dresser & McKee, is qualified to perform these services and wil provide these
services at the hourly rates ranging from $84.42 to $190.59, including expenses, for a total sum not
to exceed $17,452; and

WHEREAS, these services qualify as professional services exempt from public bidding under the
Local Public Contracts Law, N.IS.A. 40A:1l-1 gl seq.; and

WHEREAS, the City is acquirig these services directly and openly as a statutorily permitted
contract pursuant to the provisions of N.I.S.A. 19:44A-20.4 gl ~ (Pay-to-Play Law); and

WHEREAS, Camp, Dresser & McKee has completed and submitted a Business Entity Disclosure
Certification which certifies that Camp, Dresser & McKee has not made any reportable
contributions to political or candidate committees in the previous one year which would preclude
or disqualify Camp, Dresser & McKee from being awarded this contract, and that the contract wil
prohibit Camp, Dresser & McKee from màking any reportable disqualifying contributions during
the term of the contract; and

WHEREAS, Camp, Dresser & McKee has submitted a Chapter 271 Political Contribution Disclosure
Certification at least 10 days prior to the award of this contract; and

WHEREAS, Camp, Dresser & McKee has submitted its Certification of Compliance with the City's
Contractor Pay-to-Play Reform Ordinance 08-128 adopted on September 3, 2008; and

WHEREAS, funds in the amount of $17,452 are available for the C0st of these services from the PPG
Environmental Trust Fund Account No.04-226-55-000-034.

NOW, THEREFORE, BE IT RESOLVED by the Muncipal Council of the City of Jersey City that:
1. An agreement is awarded to Camp, Dresser & McKee to consult with and to provide advice
to Jersey City in understanding the cause, magntude, and potential mitigation measures and to
develop enforceable orders while allowing the facility to continue its operation, for a total amount
not to exceed $17,452.;

2. Ths agreement is awarded without competitive bidding as a professional services

agreement under the Local Public Contracts Law, N.r.S.A. 40A:1l-1 gj ~ , .

3. This contract shall be subjectto the condition that the vendor provides satisfactory
evidence of compliance with the Affirmative Action Amendments to the Law Against
~A, Discrimination; N.I.S.A. 10:5-31 gj~.

ijV(¡1 .4. The Mayor or Business Administrator is hereby authorized to execute an agreement in .
substantially the form. attached subject to such modification as the Corporati()n Counsel deems
appropriate or necessary.

5. A copy of this resolution wil be published in a newspaper of general circulation in the

City of Jersey City as required by law wîtl1In (10) days of the adoption of the resolution.

6. The Business Entity Disclosure Certification, Chapter 271 Political Contribution

Disclosure Certification, Certification of Compliance with the City's Contractor Pay-to-Play
reforII Ordinance,. and the Determination of Value Certifcation attached hereto and
incorporated herein by reference shall be placed on file with this resolution.
