District Court, DC – invalid court records in a Simulated Litigation
Only invalid Summons appears in the docket, no valid Minutes or Judgment records… Simulated Litigation
involving the Chief Judge of the US Court, Washington DC, in a landmark case …

A. Author

Dr Zernik has gained substantial experience over the past decade in examination of computerized records in
large corporate and government systems. His opinions in such matters have been supported by those of
highly reputed fraud and computer science experts. Papers he authored on the subject were peer-reviewed and
published in a computer-science journal and presented in international computer-science and criminology
conferences.
Report, authored by Dr Zernik, and based in part on analysis of computerized court records, was incorporated
into the official 2010 Staff Report of the United Nations Human Rights Council, as part of the Universal
Periodic Review of Human Rights in the United States, with a reference note stating:
Corruption of the courts and the legal profession and discrimination by law enforcement in California.

8 Feb 24, 2010 NEF (Notice of Electronic Filing) of US Supreme Court Judgment, as it appears in the 54
US District Court Docket (Dkt #73)

C. General:
The case as a whole shows invalid docket records, including, but not limited to:
• Summons as issued
• Summons as executed
z Page 2/6 May 23, 2011

• Minutes
• US Supreme Court Judgment.
• Judgment Index
Therefore, the case as a whole is opined as Simulated Litigation. [ii ]
See also records and comments on validity, or lack thereof, of records of the US Supreme Court in the
corresponding case – Citizens United v Federal Elections Commission (08-205). [iii ]

D. Comments:
1. US District Court PACER Docket
The PACER docket as a whole is opined as an invalid docket: [iv ]
a. As previously shown in other cases, the PACER dockets of the US District Court, in
themselves, are no guarantee of valid litigation. [v ]
b. It should be noted that the authority of the Clerk of the US District Court Nancy Mayer-
Whittington, is never invoked in the PACER docket per se.
c. The only record, where the authority of Clerk of the Court is invoked in this case, is the
Summons (Dkt #15), see below, and that record is opined as an invalid Summons, since it fails
to show the Seal of the Court.
2. December 13, 2007 Summons as issued
12/13/2007 SUMMONS (3) Issued as to FEDERAL ELECTION COMMISSION, U.S. Attorney and U.S.
Attorney General. (jf, ) (Entered: 12/14/2007)

No valid record of the Summons as issued exists:

a. The Summons as issued has no Docket Number designated, and no link to a record.
Therefore, no NEF could possibly be issued, and the Summons as issued is not authenticated
and no deemed entered by the Court. [vi ]
b. The Summons as issued was not docketed, in apparent violation of the Federal Rules of Civil
Procedure.
3. Dec 17, 2007 Summons as executed, (Dkt #15)
z Page 3/6 May 23, 2011

The record, which appears in the PACER docket as Summons, as executed on Federal Election Commission,
is an invalid Summons record:
a. The record of the Summons as executed on Federal Election Commission (Dkt #15) is an
invalid record, since it fails to show the Seal of Court, as required by US law.
b. FOIA request was filed with the Federal Election Commission for the record, in order to
exclude the possibility that the Seal of the Court was missing as a result of photocopying or
scanning. [vii ]
c. Since the Summons record is the only record in the docket that could possibly be deemed as
the record of Assignment of the case to Judge Lambert, there is no valid Assignment to a
judge, either.
4. January 10, 2008 Minutes of Proceeding before Three Judge Panel
01/10/2008 Minute Entry Proceedings held before a Three Judge Panel of Circuit Judge A Raymond Randolph and
United States District Judges Royce C. Lamberth and Richard W. Roberts : Preliminary Injunction held on
1/10/2008. (Court Reporter Wendy Ricard.) (rje) (Entered: 01/10/2008)

No valid record exists for the January 10, 2008 Minutes:

a. The January 10, 2008 Minutes of Proceeding before Three Judge Panel – the only Minutes of
proceeding, listed in the docket - was not docketed, in apparent violation of the Federal Rules
of Civil Procedure.
b. The January 10, 2008 Minutes of Proceeding before Three Judge Panel has no Docket
Number designated, and no link to a record. Therefore, no Minutes record could possibly be
issued, and the Minutes record, if one exists, is not authenticated and no deemed entered by
the Court. [viii ]
5. Feb 24, 2010 US Supreme Court Judgment, as it appears in the US District Court Docket (Dkt
#73) [ix ]

The record, which appears in the PACER docket as Feb 24, 2010 US Supreme Court Judgment, is an invalid
Judgment record:
a. It is a record dated January 21, 2010, whereas the online docket of the US Supreme
Court noted the issuance of a Judgment on February 22, 2010.
z Page 4/6 May 23, 2011

b. It is an unsigned record, which bears a stamp certifying that it is a “true copy” of an

unsigned original record.
c. The stamp itself is signed, but not dated. Moreover, the name and authority of the person who
signed the stamp (Cynthia Rapp) were not printed below the signature line. Therefore, the
signature on the stamp, certifying “true copy” is invalid as well.
d. No authentication by the Clerk of the US Supreme Court was filed with the Judgment record.
[x ]
6. Docket notation of the Feb 24, 2010 US Supreme Court Judgment, as it appears in the US
District Court Docket (Dkt #73)
02/24/2010 73 US SUPREME COURT JUDGMENT as to 67 Notice of Appeal, filed by CITIZENS UNITED
(znmw, ) (Entered: 02/24/2010)

The PACER docket notation of the Feb 24, 2010 US Supreme Court Judgment, is an invalid notation:
a. The docket notation states that the record was filed by Plaintiff Citizens United, but no face
page or notice by Citizens United was filed with the record.
b. The filer “znmw” is not counsel for Citizens United, but a court employee, whose name and
authority remain unknown, as is made clear by the Docket Activity Report
c. The Judgment is not “as to 67 Notice of Appeal”
Entered: Category: appeal
02/24/2010 Event: US Supreme
09:06:09 Court Judgment znmw
Filed: Document: 73 Type: crt
02/24/2010

7. NEF of the Feb 24, 2010 US Supreme Court Judgment, as it appears in the US District Court
Docket (Dkt #73)

The NEF of the Feb 24, 2010 US Supreme Court Judgment is an invalid authentication record:
a. As noted above, the docket notation states that the record was filed by Plaintiff Citizens
United, but the NEF was issued by a court employee “znmw”, whose identity and authority as
Deputy Clerk remains unknown.
b. No “Filer Name” is listed in the NEF
z Page 5/6 May 23, 2011

c. No “Original filename” is listed in the NEF

Simulated Litigation here refers to cases, where the evidence shows conduct defined in the Texas Criminal Code as follows:
Texas Penal Code - Section 32.48. Simulating Legal Process
§ 32.48. SIMULATING LEGAL PROCESS.
(a) A person commits
an offense if the person recklessly causes to be delivered to
another any document that simulates a summons, complaint, judgment,
or other court process with the intent to:
(1) induce payment of a claim from another person; or
(2) cause another to:
(A) submit to the putative authority of the
document; or
(B) take any action or refrain from taking any
action in response to the document, in compliance with the
document, or on the basis of the document.
(b) Proof that the document was mailed to any person with
z Page 6/6 May 23, 2011

the intent that it be forwarded to the intended recipient is a

sufficient showing that the document was delivered.
The practice is widespread in both the state and US courts at all levels.
