LAHORE DEVELOPMENT AUTHORITY

NOTIFICATION UNDER SECTION 45 OF THE LAHORE DEVELOPMENT


AUTHORITY ACT 1975 (XXX of 1975)

Whereas it is expedient in the public interest to to make some amendments in the


LDA Building Regulations.

Therefore, in exercise of the powers granted under section 6.2.(v) read with
section 45 of the LDA Act 1975, the Lahore Development Authority is pleased to
amend the LDA Building Regulations notified on 27th February 2008 by adding
the following new section:

Section 12.13 Regularization of Works Carried Out in Violation of Building


Regulations

Notwithstanding the provisions under section10.11.1 and any other provision


under any other section of these regulations, the multi-storey buildings including
double storey commercial buildings , constructed prior to the notifications of the
LDA Building Regulations notified on 27th February 2008, may be compounded
subject to the following provisions:

12.13.1 Review Committee

A Review Committee shall be notified by the Government to review the violations


committed in various buildings. The Review Committee shall consist of the
following:

12.13.2 Listing of such buildings

The Review Committee shall prepare a list of all such buildings constructed /
under construction prior to the 27th Febuary2008 and notify the same for record.
12.13.3 One Time Composition

The composition of violations of the sanctioned building plans shall be a one time
exercise only for the multi-storey buildings including double storey commercial
buildings, constructed prior to the notifications of the LDA Building Regulations
notified on 27th February 2008;

12.13.4 Applicable building regulations

While determining and compounding violations in a building the building


regulations applicable at the time of construction / sanction shall be followed;

12.13. 5 Structural Stability Certificate

The Review Committee shall obtain a Structure Stability Certificate from an


approved structural engineer for each building before its composition.

12.13. 6 Restriction on Composition

The Review Committee shall not compound a building:

a. which is structurally not sound as per Structure Stability


Certificate from an approved structural engineer;
b. which has been constructed in violation of reservation of set back
required for road widening; and
c. which is in any hazardous use.

12.13.7 The Penalty Rates / Regularization Fee

The penalty rates / regularization fee for composition of the violations shall be as
determined and notified by the Review Committee.

12.13.8 The Approving Authority

The Review Committee shall submit its recommendations for each building for
approval by the District Planning and Design Committee constituted under the
LDA Land Use (classification, reclassification and redevelopment) Rules 2009.

12.13.9 The Additional Car Parking Requirements

Where a builder has constructed / added additional covered area and or there is
shortage of car parking requirements as per the Building Regulations applicable
at the time of sanction of building plans, the Review Committee may fix a special
composition rate per car parking space and regularize the violations. The
Authority shall use such funds for the construction of car parking plazas in the
city.

12.13.10 The Builder is Absconder

Where the builder is absconder the regularization fee computed may be


proportionately distributed on all the units on per square foot basis so that
individual unit owners can be benefited and take advantage of this one time
amnesty scheme to get their units regularized. However, regularization fee
worked out for misuse of common area etc. shall be equally shared by all unit
holders in the building.

12.13.11 The Conversion of Land use

Regularization of violations relating to the conversion of land use shall be


considered to the extent of existing / already constructed building subject to
payment of prescribed conversion fee.

12.13.12 The Revised / Amended Building Plans

After composition of the violations the builder shall get the sanction of the
completion building plans

12.13.13 The Demolition of building

Where violations in a building are not compounded the Authority may require the
builder to alter the works so as to bring it into conformity with the Building
Regulations in a specified period of time. Or
The builder and or Authority shall demolish the whole building or part thereof ,as
the case may be.

12.13.14 The Guide Lines

The Review Committee may prepare further guidelines and procedure for
undertaking the work.

12.13.15 Validity of this Section

This Section shall remain in force for a period of two years from the date of
commencement of the Notification and thereafter the same shall seize to exist
