On 100110, I was on duty conducting traffic enforcement in the school zone at Indiana St. and Rock Creek Pkwy.
Town of Superior, Boulder County, Co. At approximately 1435 hrs radar indicated that an eastbound vehicle

driven by Robert McIntosh Jr. was driving at a speed of 41 mph in a posted and flashing 20 mph school zone. The

defendant was on radar 2 seconds and was the only eastbound vehicle at this. The school zone lights were in
working order and not obstructed.

The driver made a right southbound turn. As he passed I saw him talking on a cell phone. I then drove behind him

with my lights flashing. I had to hit my siren button, as the driver was still talking on his cell phone and oblivious

that I was behind him.

I approached the driver who was still talking on his cell phone. He asked me why he was stopped. I informed him

that he stopped in the right place as he had pulled over in front of a flashing school zone light for southbound
Indiana. I pointed to the flashing school zone sign.

I then informed McIntosh of the reason. I stated it was for speeding 41mph in a 20 mph a school zone. I asked for

his license, insurance and registration. He gave these items to me and said nothing more. I then wrote out the

ticket and returned to McIntosh. When McIntosh was presented with the ticket he became profane and verbally
abusive. At first he tried staring me down then stated with a spiteful look that a warning would have been

sufficient.

I responded by saying not at "41 mph in a 20 mph school zone". McIntosh said the speed is usually 35 and that I

was being a "fucking ass" and that "You know it". He then stated he would see me in "fucking court". I replied that
if he continued his abusive language I would arrest him.
McIntosh then signed the summons, again trying to stare me down. He was given his documents then loudly
yelled, "Screw you". McIntosh was enraged. I told him to hand me his keys. I then returned to my car and
requested backup. Sgt Oehlkers responded and was informed of the situation. Arrangements were made to take
care of the dog in the car and permission was given by McIntosh to park his car in the recreation center lot.
McIntosh was transported to jail where he was booked and released on Superior Municipal charges.
Recommended Case Status: Cleared by Arrest
