SYNOPSIS OF PAYROLL INFORMATION For more detailed information, contact your servicing CPAC.

____ FLSA (Fair Labor Standards Act) status for non-exempt employees will be changed from non exempt to exempt under Foreign Exemption criteria, for the period the employee is deployed. This means that a non-exempt GS employees pay becomes subject to the hourly cap described below, as opposed to their regular overtime entitlement of time and a half of their current hourly earnings. WG employees continue to receive hourly overtime in accordance with Federal Wage System rules. ____ GS employees hourly rate of overtime pay will be capped at the greater of time and half of the GS-10 step 1 (found on Block 5 of your LES), or your hourly rate of pay. ____ ____ WG employee overtime rate will continue to be time and a half of their current hourly rate of pay. NSPS employees: The overtime rate for various categories of NSPS employees are:
A) employees hourly adjusted rate of pay serves as the overtime hourly rate for: 1) Employees assigned to pay band 3 of the following schedules: Professional and Analytical (YA) pay schedule under the Standard Career Group; Engineering and Scientific Professional (YD) pay schedule under the Scientific and Engineering Career Group; Medical Professional (YH) pay schedule under the Medical Career Group; and Investigative and Analytical (YK) pay schedule under the Investigative and Protective Services Career Group. 2) Employees assigned to pay band 4 of the Fire Protection (YL) pay schedule, Investigative and Protective Services Career Group. 3) Employees assigned to pay bands 2 and 3 of the Supervisor/Manager pay schedule under all career groups. B) Employees assigned to 602 Physician and 680 Dentist occupations in the Physician/Dentist (YG) pay bands 2 and 3 are not eligible for overtime. C) Employees assigned to all other pay bands are paid for overtime at the employees hourly adjusted rate of pay multiplied by 1.5.

____ Bi-weekly earnings are capped at the level of GS-15 step 10. Presently for work in support of Operation Enduring/Iraqi Freedom, an exception to the bi-weekly cap is authorized. To invoke this exception, the employees supervisor must submit a memorandum through your Payroll Customer Service Representatives (CSR), specifying beginning and then the ending of service under the exception. ____ Annual earnings (taking into consideration all regular, overtime and premium pay) cannot exceed that of a GS-15 step 10. Any applicable exceptions are granted by OSD on a year to year basis, and earnings beyond the cap other than straight time salary, is non-deferrable. ____ Aggregate annual earnings to include all pay such as Danger Pay, Post Differential, Awards, regular pay, overtime and premium pay cannot exceed the Aggregate limit of Executive Schedule Level I. There is no waiver to this cap however, earnings in these categories exceeding the cap are deferrable until the following pay year. ____ Annual leave carry over beyond the maximum of 240 (or 360 if applicable) that cannot be used due to deployment should be scheduled on an SF-71 or its equivalent, and denied by the supervisor, for a record to be used when requesting restoration of the leave next leave year.
